I CITY DEVELOPMENT DEPARTMENT SERVICE PLAN 2010/2012
There was submitted Report No 371-2010 by the Director of City Development detailing the City Development Department's Service Plan for 2010/2012.
The Committee approved the Service Plan.
II CONSULTATION ON THE ENVIRONMENTAL IMPACT ASSESSMENT (SCOTLAND) REGULATIONS 2010
There was submitted Report No 344-2010 by the Director of City Development seeking to confirm the views of the Council in response to the Consultation Paper issued by the Directorate for the Built Environment, Scottish Government entitled "The Environmental Impact Assessment (Scotland) Regulations 2010".
The Committee approved Appendix A to the report as the Council's formal response to the Consultation Paper, and authorised the Director of City Development to issue the formal response to the Scottish Government by the deadline of 27th August, 2010.
III CONSULTATION ON TREE PRESERVATION ORDERS
There was submitted Report No 309-2010 by the Director of City Development advising the Committee that the Scottish Government had published a Consultation Paper on Tree Preservation Orders.
The Committee noted the response set out as Appendix 1 to the report which had been submitted by the Director of City Development to the Scottish Government on the Consultation Paper.
IV CONSULTATION OF PLANNING OBLIGATIONS AND GOOD NEIGHBOUR AGREEMENTS REGULATIONS 2010
There was submitted Report No 275-2010 by the Director of City Development seeking approval of the response submitted on behalf of the Council in response to the Consultation Paper issued by the Directorate for the Built Environment, Scottish Government entitled "Consultation on Planning Obligations and Good Neighbour Agreements Regulations 2010".
The Committee noted the response submitted by the Director of City Development on behalf of the Council as outlined in Appendix A to the report.
V DUNDEE CITY COUNCIL RESPONSE TO SCOTTISH PARLIAMENT PUBLIC PETITIONS COMMITTEE
There was submitted Report No 405-2010 by the Director of City Development advising the Committee that the Scottish Parliament Public Petitions Committee was undertaking an investigation into improving compulsory purchase powers for derelict buildings.
The Committee noted the response submitted by the Director of City Development on behalf of Dundee City Council to the Scottish Parliament Public Petitions Committee.
VI DUNDEE PARTNERSHIP BID FOR EUROPEAN STRUCTURAL FUNDS 2011/2012
There was submitted Report No 407-2010 by the Director of City Development advising the Committee that the Dundee Partnership had been invited to bid for a further year of European Social Fund monies in order to continue to operate the Dundee European Employability Programme and that, as the Lead Partner, Dundee City Council was responsible for the administration of funds.
The Committee approved a further Dundee European Programme funding bid for 2011/2012, as detailed in the report.
VII STATUTORY UNDERTAKERS REINSTATEMENT PERFORMANCE IN DUNDEE, 2009/2010
Councillor Will Dawson declared a non-financial interest in this item by virtue of his employment by Scottish and Southern Energy.
There was submitted Report No 281-2010 by the Director of City Development providing a summary of the performance of Statutory Undertakers operating in Dundee during 2009/2010 based on inspections and coring of their reinstatements under the New Roads and Street Works Act 1991 (NRSWA); and updating the Committee on the status of the Transport (Scotland) Act 2005, Part 2 - Road Works.
The Committee agreed:-
(a) to note the performance of Statutory Undertakers reinstatements in Dundee based on the visual sample inspection regime and the local coring results for the last year;
(b) the continuation of the annual local coring programme and participation in the biannual national coring programme; and
(c) to note the status of the Transport (Scotland) Act 2005, Part 2 - Road Works, different parts of which came into force on 1st April, 2008 and 1st October, 2008.
VIII STREET LIGHTING PARTNERSHIP
There was submitted Report No 282-2010 by the Director of City Development providing an update on the progress and performance of the Street Lighting Partnership with Tayside Contracts on the delivery of the Street Lighting Services to 31st March, 2010.
The Committee noted the content of the report and agreed that the Director of City Development be remitted to report back annually to the Committee on the ongoing progress and performance of the Partnership.
IX LOCHEE HIGH STREET, PHASE 2 - VARIATION OF TRAFFIC REGULATIONS
There was submitted Report No 386-2010 by the Director of City Development relative to the necessity to vary traffic regulations as a result of the environmental improvements in Lochee High Street.
The Committee approved the preparation of a Traffic Regulation Order to vary traffic regulations as a result of Phase 2 of the Lochee High Street Environmental Improvements, as outlined in the report.
X DUNDEE AREA WAITING RESTRICTIONS - VARIATIONS
There was submitted Report No 391-2010 by the Director of City Development considering all requests made during the last year for additions and alterations to waiting restrictions throughout the City.
The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Orders for Dundee.
XI SOUTH TAY STREET ENVIRONMENTAL IMPROVEMENTS - VARIATION OF WAITING RESTRICTIONS
There was submitted Report No 392-2010 by the Director of City Development considering the necessity to vary waiting restrictions in South Tay Street as part of the environmental improvements.
The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions, as detailed in the report.
XII FOGGYLEY/BEECHWOOD, DUNDEE - STOPPING-UP
There was submitted Report No 260-2010 by the Director of Economic Development considering the necessity to stop-up various lengths of footpaths and roads and to delete them from the list of roads within Foggyley and Beechwood, utilising the powers of the Roads (Scotland) Act 1984.
The Committee approved the preparation of a Stopping-Up Order under the powers of the Roads (Scotland) Act 1984 to stop-up lengths of footpaths and roads in the Foggyley Gardens area of Dundee, as they would no longer be necessary, following the demolition of multi-storey residential blocks.
The Committee also approved the preparation of a Stopping-Up Order under the powers of the Roads (Scotland) Act 1984 to stop-up lengths of footpaths and roads in the Balshando Place, Hatton Place and Lundie Place areas of Beechwood, as they would no longer be necessary, following the demolition of flatted residential properties some years ago.
XIII DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2011
There was submitted Agenda Note AN97-2010, making reference to Article II of the minute of meeting of this Committee of 2nd February, 2010, wherein the Committee authorised the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.
It was reported that the proposed Order was duly drafted and during the statutory consultation period, one objection was received from Broughty Ferry Traders' Association; however, this was later withdrawn.
The Committee therefore authorised publication of the Order.
XIV TREE PRESERVATION ORDERS
There was submitted Agenda Note AN98-2010 relative to the undernoted Tree Preservation Orders:-
06/2010 - GROUND AT FOREBANK HOUSE, 2 EADIES ROAD, DUNDEE
The Committee noted that on 26th May, 2010, the Council had made a provisional Tree Preservation Order on the above mentioned site in order to protect the arboreal amenity of the area.
No objections had been received.
05/2010 - GROUND AT MOUNT ROSA, 45 SEAFIELD ROAD, BROUGHTY FERRY, DUNDEE
The Committee noted that on 18th March, 2010, the Council had made a provisional Tree Preservation Order on the above mentioned site in order to protect the arboreal amenity of the area.
There was one objection from the owner of the site.
The Committee noted the terms of the objection and the Forestry Officer's response thereto.
The Committee authorised the Depute Chief Executive (Support Services) and the Director of City Development to undertake the necessary procedures and confirm the above Tree Preservation Orders.
XV TENDERS RECEIVED BY CITY ENGINEER
There was submitted Report No 402-2010 by the Director of City Development detailing tenders received in respect of the demolition of 52 Turnberry Avenue.
The Committee authorised acceptance of the lowest offer in the sum of 1,200 from Dundee Plant Co Ltd, to which required to be added allowances amounting to 6,200, giving a total of 7,400.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

XVIII PROPOSED SALE OF LAND AT 41 ULVERSTON TERRACE
There was submitted Report No 401-2010 by the Director of City Development seeking approval for the sale of land to the south of 41 Ulverston Terrace, Dundee.
The Committee approved the sale on the terms and conditions detailed in the report.
XIX SALE OF LAND AT ASH LANE/LOCHEE ROAD
There was submitted Report No 413-2010 by the Director of City Development seeking approval for the sale of land at Ash Lane/Lochee Road.
The Committee approved the sale on the terms and conditions detailed in the report.
XX GROUND LEASE AT LONGHAUGH QUARRY
There was submitted Agenda Note AN99-2010 relative to a request to vary the terms of a ground lease at a site at Longhaugh Quarry.
The Committee noted that the request had been approved after consultation with the Convener and Spokespersons for the other Groups on the terms and conditions detailed in the note.
XXI CIRCUS, RIVERSIDE PARK
There was submitted Agenda Note AN100-2010 relative to an application for consent to operate a circus at Riverside Park.
