The minute of meeting of this Committee of 23rd September, 2013 was held as read.

I ADOPTION OF DUNDEE LOCAL DEVELOPMENT PLAN

 

There was submitted Report No 403-2013 by the Director of City Development, outlining the Examination Report on the Proposed Dundee Local Development Plan 2013, the modifications recommended in the Examination Report and the Proposed Local Development Plan as modified for adoption. In addition, it presented the updated Environmental report, Habitats Regulation Appraisal Record and Action Programme which had taken into account the modifications made to the Proposed Dundee Local Development Plan.

 

The Committee agreed to:-

 

(a) note the contents of the Examination Report on the Proposed Dundee Local Development Plan;

 

(b) make the modifications recommended in the Examination Report to the Proposed Dundee Local Development Plan, as set out in Appendix 1 to the report;

 

(c) adopt the updated Environmental Report and Habitats Regulation Appraisal record;

 

(d) approve the updated Action Programme and agree to its publication on the adoption of the Dundee Local Development Plan;

 

(e) remit the Director of City Development to notify the Scottish Ministers of the Councils intention to adopt the Proposed Dundee Local Development Plan as modified; and

 

(f) agree to the adoption of the Proposed Dundee Local Development Plan following completion of the relevant pre-adoption statutory procedures as set out in Appendix 2 to the report.

 

II FLOOD RISK MANAGEMENT (SCOTLAND) ACT 2009

 

There was submitted Report No 414-2013 by the Director of City Development, advising the Committee of progress towards production of a Flood Risk Management Plan for the Tay Estuary and Montrose Basin Local Plan District to be delivered in fulfilment of the requirements of the Flood Risk Management (Scotland) Act 2009, and seeking approval of the proposed governance arrangements in respect of Flood Risk Management Strategies being prepared by SEPA.

 

The Committee agreed to:-

 

(a) note the progress being made towards production of the statutory Flood Risk Management Plan; and

 

(b) approve the proposed governance arrangements in respect of Flood Risk Management Strategies being prepared by SEPA.

 

III PUBLIC CONSULTATION - DRAFT BROUGHTY FERRY CONSERVATION AREA APPRAISAL

 

Councillor Bidwell declared a non-financial interest in this item by virtue of residing within the Conservation Area.

 

There was submitted Report No 415-2013 by the Director of City Development, seeking approval to consult on the Draft Broughty Ferry Conservation Area Appraisal.

 

The Committee agreed to approve the proposed Broughty Ferry Conservation Area Appraisal and remitted the Director of City Development to consult with the local community and interested parties and report back with the results of the consultation process.

 

IV CONSULTATION ON ASSISTED AREAS MAP 2014-2021

 

There was submitted Agenda Note AN113-2013 advising the Committee that a response had been submitted at the end of September on behalf of Dundee City Council to a consultation on the new Assisted Areas Map that is due to come into force on 1st July, 2014 for a period of seven years.

 

The consultation response made the argument for the retention of assisted areas coverage in Dundee and highlighted relative levels of economic disadvantage in Dundee, the citys strong track record in utilising assisted areas status and the future opportunities which exist to attract investment, particularly in relation to the Waterfront Development. Responses were being considered by the Department for Business Innovation and Skills and Scottish Government.

 

The Committee noted the above.

 

V DUNDEE AREA WAITING RESTRICTIONS VARIATION 2013

 

Councillor Hunter declared a non-financial interest in this item by virtue of having children attending Camperdown Primary School.

 

There was submitted Report No 374-2013 by the Director of City Development considering all the requests during the last 12 months for additions and alterations to waiting restrictions throughout the city.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to affect the changes to the waiting restrictions in the relevant Traffic Regulation Orders for Dundee, as detailed in the report.

 

VI TRAFFIC ORDERS

 

There was submitted Agenda Note AN114-2013 outlining the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (SHORE TERRACE AREAS, DUNDEE) (VARIATION TO TRAFFIC REGULATIONS) ORDER 2013

 

Reference was made to Article IV of the minute of meeting of this Committee of 20th May, 2013, wherein the Committee authorised the preparation of an Order to allow for the Waterfront Masterplan to be implemented facilitating the next stage of the redevelopment of Dundee Central Waterfront.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order as drafted.

 

(b) DUNDEE CITY COUNCIL (VARIATION OF BUS STOP CLEARWAY) ORDER 2013

 

Reference was made to Article VIII of the minute of meeting of this Committee of 24th June, 2013, wherein the Committee authorised the preparation of an Order to allow enforceability of additional bus stop cages on new routes to keep them clear from the possibility of indiscriminate parking. Redundant bus cages would also be removed from the Order.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order as drafted.

 

(c) DUNDEE CITY COUNCIL (VARIATION TO WEIGHT LIMITS ON BRIDGES) ORDER 2013

 

Reference was made to Article VII of the minute of meeting of this Committee of 24th June, 2013, wherein the Committee authorised the preparation of an Order to remove weight limits which were no longer required and add exemptions to the existing Orders allowing an increased weight limit for road maintenance vehicles.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order as drafted.

 

(d) DUNDEE CITY COUNCIL (BLINSHALL STREET AREA, DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2013

 

Reference was made to Article VII of the minute of meeting of this Committee of 25th March, 2013, wherein the Committee authorised the preparation of an Order to alter the waiting restrictions in the Blinshall Street area due to the changing parking requirements of the area.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order as drafted.

 

VII TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 409-2013 by the City Architect detailing tenders received in respect of the undernoted projects:-

 

(a) MILL OMAINS PRIMARY SCHOOL EXTERNAL LIGHTING

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 2,943.92, to which required to be added allowances amounting to 442, giving a total of 3,385.92.

 

(b) RELOCATION AND UPGRADE OF COMMUNITY ALARM FACILITIES

 

The Committee agreed to accept a negotiated offer from Tunstall Healthcare (UK) Ltd, Whitby, in the sum of 12,613.01, to which required to be added allowances amounting to 12,400, giving a total of 25,013.01.

 

VIII TENDERS RECEIVED BY CITY ENGINEER

 

There was submitted Report No 395-2013 by the City Engineer detailing tenders received in respect of the undernoted projects:-

 

(a) LOCHEE PHYSICAL REGENERATION HIGHGATE REDEVELOPMENT INFRASTRUCTURE WORKS

 

The Committee agreed to accept an offer from Tayside Contracts in the sum of 620,770.43, to which required to be added allowances amounting to 314,229.57, giving a total of 935,000.

 

(b) SALVATION ARMY BUILDING DEMOLITION

 

The Committee agreed to accept the lowest offer from Masterton Ltd, in the sum of 150,215, to which required to be added allowances amounting to 128,000, giving a total of 278.215.

 

IX TENDERS RECEIVED BY HEAD OF PROPERTY

 

There was submitted Report No 402-2013 detailing a tender in respect of the resurfacing of the access road at Foresters House (Elms).

 

The Committee agree to accept an offer in the sum of 28,841.28, including allowances.

 

X DUNDEE CENTRAL WATERFRONT EXTENSION AND REFURBISHMENT OF SHORE TERRACE CAR PARK -SUPPLEMENTARY PAY ON FOOT PARKING SYSTEM

 

There was submitted Agenda Note AN119-2013 by the Director of City Development, advising that tenders had been invited in respect of a supplementary pay on foot parking system for Dundee Central Waterfront Shore Terrace Car Park. Four offers had been received and it was recommended that the second lowest offer from Metric Group in the sum of 79,995 be accepted. This was because the Metric system was more compatible with the existing Dundee City Council car parking systems than the lowest tenderer Designa UK Ltd (79,716.46) however, the Metric Group offer also included for additional pin hole cameras. Allowances for contingencies and miscellaneous works in the amount of 45,000 required to be added, giving a total expenditure of 124,995. In order to keep to the scheduled programme, this expenditure was approved by the Convener and Spokespersons for the other groups.

 

The Committee noted the foregoing.

 

XI TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 451-2013 by the City Architect detailing a negotiated offer for the Relocation of the Environment Department to City Square East Wing from the Environment Department (Construction Services) in the sum of 735,000, to which required to be added allowances amounting to 348,250, giving a total of 1,083,250.

 

Councillor Dawson, seconded by Councillor Guild, moved approval of the report. As an amendment, Councillor Macpherson, seconded by Councillor McCready, moved deferral of the report.

 

On a division, there voted for the motion - the Convener, Lord Provost Duncan, Depute Lord Provost Roberts, Bailie Sawers and Councillors Guild, Alexander, Black, Bowes, Campbell, Cordell, Hunter, Lynn, McDonald, Melville, Murray and Ross (16); and for the amendment - Bailies Wright, Borthwick and Scott and Councillors Keenan, Asif, Bidwell, Brennan, Cruickshank, Ferguson, Gordon, McCready, McGovern and Macpherson (13) - whereupon the motion was declared carried and the report approved.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XII COMMERCIAL LEASES

 

There was submitted Report No 412-2013 by the Director of City Development detailing leases in respect of the undernoted properties:-

56 Dundee Road, Broughty Ferry

Area of Ground at Law Crescent

Unit 11, Peddie Street

 

The Committee noted and approved accordingly.

 

XIII RENT REVIEWS

 

There was submitted Report No 411-2013 by the Director of City Development detailing a rent review in respect of Unit 1, Miln Street, Dundee.

 

The Committee approved accordingly.

 

XIV PROPOSED SALE OF LAND ADJACENT TO STRATHMARTINE ROAD, DUNDEE

 

There was submitted Report No 406-2013 by the Director of City Development relative to the proposal to dispose of an area of land adjacent to Strathmartine Road, Dundee.

 

The Committee approved the sale on the terms and conditions detailed in the report.
