I DECLARATION OF INTEREST

 

Councillor Dawson declared a non-financial interest in Article V by virtue of being a director of the East of Scotland Investment Fund.

 

II CITY DEVELOPMENT DEPARTMENT SERVICE PLAN REVIEW

 

There was submitted Report No 256-2012 by the Director of City Development reviewing the performance of the City Development Department in relation to its Service Plan 2010/2012.

 

The Committee agreed to:-

 

(a) note the contents of the City Development Department Service Review; and

 

(b) note that a new departmental plan was being drawn up based on the Council's new plan and structure.

 

III ROAD SAFETY PROGRESS REPORT 2012

 

There was submitted Report No 267-2012 by the Director of City Development advising the Committee of the progress made in reducing road accident casualties in Dundee.

 

The Committee noted the progress made in reducing road accident casualties on the local road network towards the Scottish Government road safety targets for 2015 and 2020.

 

IV ROAD SAFETY SCHEMES - IMPLEMENTATION 2012/2013

 

There was submitted Report No 268-2012 by the Director of City Development seeking Committee approval for a programme of road safety measures to be implemented at various locations in the city.

 

The Committee approved the implementation of the Road Safety Schemes as set out in Appendix B to the report.

 

V EAST OF SCOTLAND INVESTMENT FUND

 

There was submitted Agenda Note AN131-2012 advising that Dundee City Council had been a member of the East of Scotland Investment Fund (ESIF) since 2010. The fund which was supported by the European Regional Development Fund (ERDF) provides loans to businesses based in Dundee who have experienced difficulty, through normal routes, in raising all of the funding they require to continue a development project.

 

Under the current rules the maximum amount of any loan is 50,000.

 

The Directors of ESIF wished to increase the maximum amount that can be loaned to 100,000 and require the permission of Dundee City Council, as a member, to agree such a change.

 

The Committee agreed to the above increase in the maximum loan available.

 

VI URBACT - CITYLOGO PROJECT

 

There was submitted Agenda Note AN132-2012 advising that Dundee City Council had been chosen as a partner in an URBACT (a European Funding programme that promotes sustainable urban development which enables cities to work together to develop solutions to urban challenges) project called CityLogo, which had secured funding and would commence the implementation phase in January, 2013.

 

It was reported that the City Council had been allocated a budget of approximately 65,000 over the 27 month duration of the project, to meet staff costs, research support costs, travel costs for attending international dissemination/knowledge exchange events and support for the ongoing development of the One City, Many Discoveries Campaign.

 

The Committee noted the Department's participation in this initiative.

 

VII CENTRAL WATERFRONT - DOCK STREET AND WHITEHALL CRESCENT ENVIRONMENTAL IMPROVEMENTS AND SHORE TERRACE CAR PARK EXTENSION

 

There was submitted Agenda Note AN133-2012 advising that major Environmental Improvement Works were planned in Dock Street, Whitehall Crescent and Shore Terrace as part of the Central Waterfront Development. These works were being programmed to coincide with the redevelopment of the former Tay Hotel Building and opening of the Malmaisson Hotel in May 2013. There is a significant lead-in time associated with the high quality paving materials required for the works and it is therefore necessary to issue orders and monies in advance of the works commencing to ensure timely delivery.

 

The value materials that require an order to be placed at this stage is in the region of 350,000. These monies will be reported as part of the tender report for Dock Street and Whitehall Crescent Environmental Improvement Works and Shore Terrace Car Park Extension which is to be reported to the City Development Committee on 24th September, 2012. This budgeted expenditure will be met from the City Development Central Waterfront Capital Budget 2012/2014.

 

The Committee approved accordingly.

 

VIII TREE PRESERVATION ORDER

 

There was submitted Agenda Note AN122-2012 advising of the undernoted Tree Preservation Order:-

 

08/2012 - Dundee College, Gardyne Road, Dundee

 

It was reported that on 30th May, 2012, the Council made a Tree Preservation Order on the above mentioned site in order to protect the arboreal amenity of the area.

 

No objections had been received, therefore this Committee authorised the Head of Democratic and Legal Services and the Director of City Development to undertake the necessary procedures and confirm the Tree Preservation Order.

 

IX CASHLESS PAYMENTS FOR PARKING

 

There was submitted Agenda Note AN123-2012 making reference to Article IV of the minute of meeting of this Committee of 28th March, 2011, wherein the introduction of mobile phone payment system for pay and display parking in Dundee for a trial period of 18 months was approved.

 

It was reported that customer uptake of the Ring Go mobile payment option had been growing steadily and proving popular with customers and the Committee agreed to extend the pilot period by six months to a total of 24 months' pilot.

 

X DISABLED PERSONS PARKING PLACES - ANNUAL REPORT 2011/2012

 

There was submitted Report No 275-2012 by the Director of City Development advising the Committee of the changes in Disabled Persons' Parking Places in Dundee.

 

The Committee noted the information contained within this report, which would be sent to Transport Scotland for data analysis and processing.

 

XI DISABLED PERSONS PARKING PLACES (ADDITIONS) ORDER 2012 - DISABLED PERSONS PARKING PLACES (REMOVALS) ORDER 2012

 

There was submitted Report No 216-2012 detailing all additional disabled parking spaces that had been approved and all the spaces that had been removed as unnecessary in the past 12 months.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the on-street disabled parking bay provision in the relevant Traffic Regulation Order for Dundee, as detailed in the report.

 

XII TRAFFIC ORDERS

 

There was submitted Agenda Note AN124-2012, advising of the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2011

 

Reference was made to Article V of the minute of meeting of this Committee of 27th February, 2012, wherein the Committee authorised the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order.

 

(b) DUNDEE CITY COUNCIL (ABERCRAIG CAR PARK, DUNDEE) (NAME AND TARIFF CHANGE) ORDER 2012

 

Reference was made to Article IV of the minute of meeting of this Committee of 28th November, 2011, wherein the Committee authorised the preparation of an Order to provide more clarity for visitors accessing the area and to provide a tariff more suited to the amenities of the area.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(c) DUNDEE CITY COUNCIL (NORTH LINDSAY STREET, DUNDEE) (VARIATION TO WAITING RESTRICTIONS) ORDER 2012

 

Reference was made to Article VII of the minute of meeting of this Committee of 28th November, 2011, wherein the Committee authorised the preparation of an Order to allow access for both visitors and servicing to Dundee House since its redevelopment.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(d) DUNDEE CITY COUNCIL (RIVERSIDE DRIVE LAY-BY, DUNDEE) (VARIATION OF TRAFFIC REGULATIONS) ORDER 2012

 

Reference was made to Article III of the minute of meeting of this Committee of 28th November, 2011, wherein the Committee authorised the preparation of an Order to allow for servicing of Dundee Railway Station following the closure of South Union Street.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(e) DUNDEE CITY COUNCIL (SOUTH MARKETGAIT AREA, DUNDEE) (VARIATION OF TRAFFIC REGULATIONS) ORDER 2012

 

Reference was made to Article VI of the minute of meeting of this Committee of 31st October, 2011, wherein the Committee authorised the preparation of an Order to allow effective traffic management during the next phase of the Dundee Central Waterfront project.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(f) DUNDEE CITY COUNCIL (ST COLUMBA GARDENS, NORTH LINDSAY STREET AND SOUTH MARKETGAIT, DUNDEE) (ONE-WAY AND VARIATION TO WAITING RESTRICTIONS) ORDER 2012

 

Reference was made to Article III of the minute of meeting of this Committee of 31st October, 2011, wherein the Committee authorised the preparation of an Order to reduce vehicle congestion on St Columba Gardens while promoting safety for vehicles, pedestrians and school children by reducing potential for vehicle conflict; and to allow for the Waterfront Masterplan to be implemented facilitating the next stage of the redevelopment of Dundee Central Waterfront.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(g) DUNDEE CITY COUNCIL (COUPAR ANGUS ROAD, RIVERSIDE DRIVE/RIVERSIDE AVENUE AND MONIFIETH ROAD/DALHOUSIE ROAD, DUNDEE) (VARIATION TO SPEED RESTRICTIONS) ORDER 2012

 

Reference was made to Article II of the minute of meeting of this Committee of 12th December, 2011, wherein the Committee authorised the preparation of an Order to increase safety on a number of lengths of carriageway and to decrease the potential for accidents.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(h) DUNDEE CITY COUNCIL (WHITEHALL CRESCENT AREA, DUNDEE) (VARIATION OF TRAFFIC REGULATIONS) ORDER 2012

 

Reference was made to Article V of the minute of meeting of this Committee of 23rd January, 2012, wherein the Committee authorised the preparation of an Order to allow for the Waterfront Masterplan to be implemented facilitating the next stage of the redevelopment of Dundee Central Waterfront.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(i) DUNDEE CITY COUNCIL (COUPAR ANGUS ROAD UNDERPASS, LOCHEE, DUNDEE) (STOPPING-UP OF FOOTPATH) ORDER 2012

 

Reference was made to Article IV of the minute of meeting of this Committee of 23rd April, 2012, wherein the Committee authorised the preparation of an Order to facilitate the redevelopment of the area historically known as Bank Street, Lochee.

 

The Order was duly prepared and advertised in the Evening Telegraph and the Edinburgh Gazette, and the relevant statutory undertakers were consulted. One objection was received from Scotland Gas Networks which was later withdrawn.

 

The Committee therefore agreed to authorise and confirm the Order, and authorise formal publication of the confirmation, after which the Order would become operative.

 

(j) DUNDEE CITY COUNCIL (MILEY/RADIAL CYCLE ROUTES) ORDER 2012

 

Reference is made to Article XII of this Committee of 26th March, 2012, wherein the Committee authorised the preparation of an Order to promote road safety by designating shared use footpaths where it becomes dangerous for cycles to remain on the main vehicle carriageway.

 

The Order was duly prepared and advertised in the Evening Telegraph and the Edinburgh Gazette, and the relevant statutory undertakers were consulted. No objections were received.

 

The Committee therefore agreed to authorise and confirm the Order, and authorise formal publication of the confirmation, after which the Order would become operative.

 

XIII NEW ROADS - ROAD CONSTRUCTION CONSENTS

 

There was submitted Agenda Note AN125-2012, making reference to Article IV of the Policy and Resources Committee of 27th April, 2009, wherein the Committee delegated the grant of road construction consent to the Director of City Development with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.

 

It was reported that the undernoted application had been submitted and the Director of City Development had approved the application, subject to conditions, which have been agreed with the applicant:-

XIV TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 289-2012 by the Director of City Development detailing the undernoted tenders:-

 

(a) NEW PARK VICTORIA PRIMARY SCHOOL REMOVALS

 

The Committee agreed to accept an offer from Dundee Removal Services Ltd in the sum of 20,500, to which required to be added allowances amounting to 1,500, giving a total of 22,000.

 

(b) VARIOUS SCHOOLS CARETAKERS' HOUSES UPGRADING WORKS

 

The Committee agreed to accept an offer from Environment Department (Construction Services) in the sum of 28,486, to which required to be added allowances amounting to 4,272.90, giving a total of 32,758.90.

 

(c) ST MARY'S PRIMARY SCHOOL UPGRADING WORKS - PHASE 2

 

The Committee agreed to accept an offer from Environment Department (Construction Services) in the sum of 13,750.71, to which required to be additional allowances amounting to 2,062.61, giving a total of 15,813.32.

 

(d) CLEPINGTON PRIMARY SCHOOL - STORM DAMAGE - REPAIRS TO WOODWORK

 

The Committee agreed to accept an offer from Environment Department (Construction Services) in the sum of 35,897.73, to which required to be added allowances amounting to 5,384.66, giving a total of 41,282.39.

 

(e) BLACKNESS LIBRARY - NEW ACCESS AND UPGRADING TO FIRST FLOOR

 

The Committee agreed to accept an offer from Environment Department (Construction Services) in the sum of 234,805.20, to which required to be added allowances amounting to 19,567.48, giving a total of 254,872.68.

 

It was reported that the Convener had agreed that the undernoted item of business be considered as a matter of urgency in terms of Standing Order 17(b) in view of the timescales involved.

XV NATIONAL TRANSPORT AWARDS

 

There was submitted Agenda Note AN147-2012, advising the Committee that following the success of the Dundee Wayfinding Scheme at the Scottish Transport Awards, Dundee City Council was again shortlisted for the National Award in London on 11th October. Dundee City Council was the only Scottish Local Authority nominated in the category of Excellence in Walking and Public Realm at these very prestigious awards.

 

The Committee authorised the attendance of the Convener, having noted that costs, including accommodation and travel, would be approximately 400.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
