I PLANNING AND TRANSPORTATION DEPARTMENT SERVICE PLAN ANNUAL PERFORMANCE REPORT
There was submitted Report No 244-2006 by the Director of Planning and Transportation reporting on the Department's Service Plan Annual Performance for the period ending 31st March, 2006 as part of the Council's Performance Management Framework and Best Value policy.
The Committee noted the summary of key highlights and achievements together with the evaluation of performance achieved on the targets and trends in the core performance indicators as outlined in Appendix 1 to the report, and the evaluation of progress on key projects and areas for improvement as set out in Appendix 2 to the report.
II STREET LIGHTING PARTNERSHIP
There was submitted Report No 331-2006 by the Director of Planning and Transportation providing an update on progress with the Street Lighting Partnership with Tayside Contracts on the delivery of the street lighting service to 31st March, 2006.
The Committee noted the content of the report and agreed that the Director of Planning and Transportation be remitted to report back annually on the ongoing progress of the Partnership.
III STREET LIGHTING AND OTHER UNMETERED ELECTRICAL SUPPLY CONTRACT
There was submitted Report No 347-2006 by the Director of Planning and Transportation advising the Committee on recent tenders for the procurement of unmetered electricity for Street Lighting and seeking agreement for Dundee City Council to remain a member of the purchasing consortium.
The Committee noted the tenders received by Highland Council and agreed to the Council remaining a member of the purchasing consortium.
IV THE FINALISED FIFE STRUCTURE PLAN 2006-2026
There was submitted Report No 335-2006 by the Director of Planning and Transportation advising the Committee of the publication of the Finalised Fife Structure Plan, and seeking approval for the Director of Planning and Transportation to submit formal objections and comments on behalf of the City Council to Scottish Ministers.
The Committee agreed to:-
(i) note that the Finalised Fife Structure Plan was submitted to Scottish Ministers on 5th June, 2006, and that formal objections were invited by 17th July, 2006;
(ii) note that whilst the representations submitted by the City Council in response to the Draft Fife Structure Plan in terms of housing land release had been partly taken into account the main objection regarding the extended timescale of the plan had not been accepted by Fife Council in the preparation of the Finalised Structure Plan; and
(iii) approve the report which sets out Dundee City Council's formal objections and comments on the Finalised Fife Structure Plan and remit the Director of Planning and Transportation to submit these to Scottish Ministers.
V CYCLING, WALKING AND SAFER STREETS (CWSS) PROJECTS COMMENCING 2006-2007
There was submitted Report No 336-2006 by the Director of Planning and Transportation seeking Committee approval for a programme of works for the year 2006-2007 funded from additional grant capital ring-fenced by the Scottish Executive for Cycling, Walking and Safer Streets (CWSS) projects.
The Committee approved the proposed programme of works as detailed in the report.
VI ROAD SAFETY SCHEMES - IMPLEMENTATION 2006-2007
There was submitted Report No 337-2006 by the Director of Planning and Transportation advising the Committee of a programme of road safety measures to be implemented at locations in the city.
The Committee agreed:-
(i) to approve the implementation of the Road Safety Schemes as set out in Appendix A to the Report; and
(ii) that engineering measures required would be awarded to Tayside Contracts under the agreed Schedule of Rates.
VII CASINOS AND THE USE CLASSES ORDER - CONSULTATION PAPER FROM THE SCOTTISH EXECUTIVE
There was submitted Report No 339-2006 by the Director of Planning and Transportation summarising the content of the consultation paper "Casinos and the Use Classes Order" issued by the Scottish Executive in April 2006, and making recommendations relative to the options suggested by the Scottish Executive.
The Committee agreed to support Option 2, that is, that all casinos are treated as sui generis, with no permitted development rights, for the reasons specified in the report and remitted the Director of Planning and Transportation to convey this view to the Scottish Executive.
VIII McVICARS LANE - STOPPING UP
There was submitted Report No 341-2006 by the Director of Planning and Transportation advising the Committee that in order to facilitate a housing development it would be necessary to stop-up lengths of McVicar's Lane.
The Committee approved the preparation of an Order under the powers of the Town and Country Planning (Scotland) Act 1997 to stop-up lengths of McVicar's Lane as depicted on the plan appended to the report.
IX DUNDEE CITY COUNCIL BUS SHELTER ADVERTISING CONTRACT
There was submitted Report No 328-2006 by the Director of Planning and Transportation detailing tenders received and requesting a decision on acceptance thereof.
The Committee agreed that approval be given for the Director of Planning and Transportation to negotiate with J C Decaux on the detailed content of their proposal.
X HOUSING LAND - REVIEW OF LAND SUPPLY
There was submitted Report No 330-2006 by the Director of Planning and Transportation providing an updated assessment of housing land supply within the Dundee City Council Administrative area.
The Committee noted the content of the report and authorised its use as a material consideration in the determination of planning applications.
XI DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2006
There was submitted Agenda Note AN188-2006 whereby reference was made to Article III of the minute of meeting of this Committee of 20th June, 2005 instructing and authorising the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.
It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received. Thereafter, the Order was duly advertised and five objections were received, one of which was later withdrawn.
The Committee agreed to make the Order despite the objections, subject to relaxation of the restrictions on the north side of Jack Martin Way to provide unrestricted parking in three lengths for 26 cars in total.
XII DUNDEE CITY COUNCIL (BROOMHILL ROAD AND KINNOULL ROAD, DUNDEE) (PROHIBITION OF DRIVING) ORDER 2006
There was submitted Agenda Note AN189-2006 making reference to Article II of the minute of meeting of this Committee of 15th August, 2005 instructing and authorising the preparation of an Order to remove vehicular access to the site and to prohibit vehicular traffic on the adjacent roads in the interests of preserving environmental quality and thereby preserving the amenity of the area.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received. Thereafter, the Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
XIII VACANT AND DERELICT LAND FUND PROGRAMME 2006 TO 2008
There was submitted Agenda Note AN190-2006 whereby reference was made to Article VII of the minute of meeting of this Committee of 10th April, 2006, whereby it was noted that the Scottish Executive had provisionally allocated a further 4m under the Vacant and Derelict Land Fund to help deal with vacant and derelict land and property in Dundee. The Committee also approved a draft programme as a bid for the fund.
The Committee noted that in May 2006 the Scottish Executive confirmed a grant of 4m (2m for 2006/2007 and 2m for 2007/2008) and approved the draft programme of works.
XIV COMMERCIAL STREET/MURRAYGATE ENVIRONMENTAL IMPROVEMENTS
There was submitted Agenda Note AN191-2006 advising that as part of the ongoing City Centre improvements, proposals had been prepared for carrying out environmental improvement works at the Commercial Street/Murraygate junction, in order to improve road safety. It was reported that SET were unable to commit any funding to the project at present, and it was therefore proposed to undertake these works in two stages.
The first stage would involve all of the "off-carriageway" works in the form of tactile surfacing adjacent to footway crossings, street furniture and landscaping works. The second stage of works involving carriageway construction including textured surfacing, widening of setted paving and installation of carriageway markings was proposed following a period of monitoring and evaluation of the off-carriageway works.
It was further reported that Tayside Contracts had offered to carry out these works under this partnership agreement for the sum of 54,500. This amount, together with allowances of 13,000 for professional fees and 7,500 for contingencies would give an overall expenditure of 75,000 for the first stage works, which could be met from allowances within the Planning and Transportation Department Capital Plan 2006/2007.
The Committee agreed to note the above and approved the proposals.
XV FURTHER CYCLING/FOOTPATH WORKS AT WALKWAY BETWEEN STANNERGATE AND DOUGLAS TERRACE
This item was withdrawn.
XVI HOUSES IN MULTIPLE OCCUPANCY - SUPPLEMENTARY PLANNING GUIDANCE
There was submitted Agenda Note AN194-2006 whereby reference was made to Article II of the minute of meeting of this Committee of 12th September, 2005 which agreed to the publication of proposed Supplementary Planning Guidance for consultation purposes. In addition, it was agreed that the Director of Planning and Transportation would report back on the results of the exercise within six months with any proposed modifications with a view to adopting the Guidance as a material planning consideration.
The Committee noted that the public consultation exercise on the supplementary planning guidance was now being undertaken, the results of this consultation exercise were being analysed and it was intended to report the findings of the consultation exercise and any proposed modifications to the supplementary guidance to the meeting of this Committee in August, 2006.
XVII SCOTLAND'S NATIONAL TRANSPORT STRATEGY: A CONSULTATION
There was submitted Agenda Note AN195-2006 informing the Committee of the Scottish Executive consultation document "Scotland's National Transport Strategy: A Consultation" and the timing of the consultation period.
"Scotland's National Transport Strategy: A Consultation" was issued by the Scottish Executive on 20th April, 2006 for a twelve week consultation period which would end on 13th July, 2006.
It was noted that the timing of the consultation period and National Conference permitted no time to report Dundee City Council's response to the Planning and Transportation Committee prior to the deadline of 13th July, 2006. Accordingly, the Committee agreed to delegate powers to the Director of Planning and Transportation to respond to the consultation and report that response to the Planning and Transportation Committee on 14th August, 2006.
XVIII CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - PROPOSED NEW STREET NAMES
There was submitted Agenda Note AN294-2006 detailing proposed new street names.
The Committee approved the undernoted new street names.

XIX INSTITUTE OF HIGHWAYS AND TRANSPORT NATIONAL AWARDS
There was submitted Agenda Note AN295-2006, advising the Committee that intimation had recently been received that the Planning and Transportation Department had been short listed as finalists for the highly prestigious Environmental Award at the Institute of Highways and Transportation National Awards.
It was reported that in view of the timescales involved, authority had been granted by the Director of Planning and Transportation and the appropriate elected members, for the attendance of the Convener at the awards ceremony.
