The minute of meeting of this Committee of 27th June, 2022 was held as read.

I DECLARATION OF INTEREST

 

Councillor Scullin declared an interest in Article VIII by virtue of owning a City Centre business.

 

II DUNDEE CITY COUNCIL (UNION STREET, DUNDEE) (PROHIBITION OF DRIVING) ORDER 2022

 

Reference was made to Article VIII of the minute of meeting of this Committee of 10th May, 2021, wherein the Committee agreed to instruct and authorise the preparation of an Order to increase road safety and provide a safe space for sustainable transportation links.

 

There was submitted Agenda Note AN39-2022 reporting that the proposed Order was duly drafted and, during the statutory consultation, no objections were received. The Order was duly advertised and three objections were received. Copy correspondence had been circulated to the Group Leaders and the Scottish Conservative and Unionist Party Member.

 

The Committee made the Order despite the objections.

 

III DUNDEE CITY COUNCIL (SCHOOL STREETS) (PART-TIME PROHIBITION OF DRIVING) ORDER 2022

 

Reference was made to Article V of the minute of meeting of this Committee of 24th January, 2022, wherein the Committee agreed to instruct and authorise the preparation of an Order. Due to high traffic volumes and parking issues during school pick up and drop off times at these schools, it was necessary to prohibit vehicular access to stop the potential for conflict between vehicular traffic and school children.

 

There was submitted Agenda Note AN40-2022 reporting that the proposed Order was duly drafted and, during the statutory consultation, no objections were received. The Order was duly advertised and three objections were received relating to Coldside Campus. No objections were received in relation to the other school sites included in the Order.

 

Copy correspondence had been circulated to the Group Leaders and the Scottish Conservative and Unionist Party Member.

 

The Committee made the Order despite the objections.

 

IV ANNUAL ROAD SAFETY AND 20MPH PROGRESS REPORT

 

There was submitted Report No 210-2022 by the Executive Director of City Development providing a progress report and also seeking to inform Committee of new national road casualty reduction targets to 2030 along with the Councils programme of road safety works for 2022/2023 and ongoing 20mph progress.

 

The Committee:-

 

(i) noted the new Scottish Government Casualty Reduction Targets;

 

(ii) approved the programme of road safety works contained in Appendix C attached to the report; and

 

(iii) approved the conversion of areas identified in paragraph 6.2 to 20mph zones.

 

V DUNDEE ROAD WEST (VARIATION OF SPEED RESTRICTIONS)

 

There was submitted Report No 211-2022 by the Executive Director of City Development seeking approval to extend a 30mph section of carriageway on Dundee Road West utilising the powers of the Road Traffic Regulation Act 1984 to improve road safety on approach to a new pedestrian crossing.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to affect changes to the speed restrictions in the relevant Traffic Regulation Orders for Dundee.

 

VI LOCHEE ROAD/CLEGHORN STREET JUNCTION (PROHIBITION OF RIGHT TURN MANOEUVRES) TRAFFIC REGULATION ORDER

 

On a reference to Article VIII of the minute of meeting of this Committee of 6th September, 2021, there was submitted Report No 212-2022 detailing a proposal to prohibit two right turn manoeuvres at the Lochee Road/Cleghorn Street junction.

 

The Committee approved the preparation of the Traffic Regulation Order to prohibit right turn manoeuvres from Lochee Road onto Cleghorn Street, and from Cleghorn Street onto Lochee Road for road safety reasons.

 

VII DISCOVER WORK PARTNERSHIP UPDATE

 

On a reference to Article IX of the minute of meeting of this Committee of 7th March, 2022, there was submitted Report No 206-2022 by the Executive Director of City Development updating Committee on: performance of the Employability Pathway; the commitment of additional employability funding following a competitive Challenge Fund (Round 2) process undertaken by the Discover Work Partnership; the extension of pre-existing commitments relating to Challenge Fund (Round 1); and the publication of the Discover Work Strategy 2022/2027.

 

The Committee:-

 

(i) noted the significant improvement in performance of the Employability Pathway for the period 1st October, 2019-31st March, 2022;

 

(ii) noted the commitment of employability funding following a competitive Challenge Fund (Round 2) process undertaken by the Discover Work Partnership;

 

(iii) delegated the Executive Director of Corporate Services and the Executive Director of City Development to confirm arrangements for the extension of existing Challenge Fund (Round 1) commitments for one year up to 31st March, 2024, subject to successful approval of UK Shared Prosperity Fund Investment Plan by the UK Government; and

 

(iv) noted the publication of the Discover Work Strategy 2022/2027, which set out the strategic vision, goals and context relating to our ambitious Transformation of employability for a new Dundee.

 

VIII OUTDOOR HOSPITALITY SPACE PERMITS

 

There was submitted Report No 213-2022 by the Executive Director of City Development proposing the introduction of a new Council permit scheme for the management and control of outdoor hospitality space.

 

The Convener, seconded by Councillor Rome, moved that Committee:-

 

(i) approves the introduction of a permit scheme as set out in Appendix A of the report; and

 

(ii) delegates authority to the Head of Sustainable Transport & Roads to administer outside space permit applications and to update the permit scheme as required.

 

Bailie Macpherson, seconded by Councillor Coleman, moved that Committee agreed to defer the report.

 

On a division, there voted for the motion - the Convener, Lord Provost Campbell, Depute Lord Provost Cordell, Bailies Dawson, Roberts and Sawers and Councillors Alexander, Anderson, El-Nakla, Hunter, Lynn, Rome, Short, Smith and Tolland (15); and for the amendment - Bailies Macpherson and Scott and Councillors Coleman, Crichton and Duncan (5) - Councillors Cruickshank, Finnegan, McHugh, McIrvine, Malone and Shears declining to vote - whereupon the motion was declared carried.

 

Thereafter, it was further agreed that the permit scheme set out in Appendix A of the report be amended as follows:-

 

6.2 to read In all instances, unless it is inappropriate or impracticable, you will have to provide a portable means of enclosure for the pavement area such as barriers or planters. These should be stable and sturdy, eg, colourful canvas separators on metal uprights, not contain protruding parts and have a tapping rail. Ropes or chains do not provide sufficient positive guidance for the blind and visually impaired and therefore are not considered suitable.

 

7.8 to read Advertising shall be permitted on parasols subject to advertisement consent being secured where necessary. Such advertising should not detract from the appearance of the building and its setting, especially in conservation areas.

 

7.1 to read This guide does not wish to define a standard style of furniture for pavement cafes, but the furniture should be of a high quality, capable of being cleaned and being moved in and out of premises and should not detract from the surrounding architecture. Plastic or picnic/camping style equipment is not suitable and will not be approved. Only furniture approved by the Council may be used. The Council reserves the right to reject applications where inappropriate furniture is proposed.

 

7.6 to read If you intend to use parasols, they must not be attached to the building. You will be required to use a large heavy-duty commercial type of parasol, fitted with wind flaps, and be tested to withstand up to force 8 gales. Garden style umbrellas are not acceptable and reflective colours should be avoided. Their metric dimensions, materials and colour must be specified as part of the application and their proposed locations shown on the site layout plan. Parasols, when opened, should be safely secured and contained entirely within the boundaries of the pavement cafe to ensure they do not cause an obstruction or present a danger to any user of the pavement cafe or any other users of the footway. If heating or lighting is to be provided, the equipment must be electrical and attached to the inside of the parasol, in a safe manner. External gas fuelled heaters are not permitted.

 

8.2 to read The crockery or cutlery used in pavement cafes should be of good quality. Menus should be readily available either at the tables or on request.

 

IX TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY

 

There was submitted Report No 214-2022 by the Executive Director of City Development detailing tenders received and requesting decisions thereon.

 

(a) DUNDEE CENTRAL WATERFRONT SERVICE DIVERSIONARY WORKS

 

The Committee agreed to accept the tender from Dundee Plant Company Ltd in the sum of 120,651.95, together with allowances of 72,251.29, giving a total expenditure of 192,903.24.

 

(b) HAWKHILL/PERTH ROAD CORRIDOR - ACTIVE FREEWAY ROUTE IDENTIFICATION AND CONCEPT DESIGN

 

The Committee agreed to accept the tender from SWECO in the sum of 43,550, together with allowances of 21,450, giving a total expenditure of 65,000.

 

(c) HAREFIELD ROAD, STRATHMORE AVENUE, DENS ROAD CORRIDOR - ACTIVE FREEWAY ROUTE IDENTIFICATION AND CONCEPT DESIGN

 

The Committee agreed to accept the tender from SWECO in the sum of 43,540, together with allowances of 21,460, giving a total expenditure of 65,000.

 

(d) STRATHMARTINE ROAD CORRIDOR - ACTIVE FREEWAY ROUTE IDENTIFICATION AND CONCEPT DESIGN

 

The Committee agreed to accept the tender from SWECO in the sum of 43,540, together with allowances of 21,460, giving a total expenditure of 65,000.

 

(e) PITKERRO ROAD CORRIDOR - ACTIVE FREEWAY ROUTE IDENTIFICATION AND CONCEPT DESIGN

 

The Committee agreed to accept the tender from SWECO in the sum of 43,540, together with allowances of 21,460, giving a total expenditure of 65,000.

 

(f) ARBROATH ROAD CORRIDOR - ACTIVE FREEWAY ROUTE IDENTIFICATION AND CONCEPT DESIGN

 

The Committee agreed to accept the tender from SWECO Dundee in the sum of 43,540, together with allowances of 21,460, giving a total expenditure of 65,000.

 

(g) SERVICE AND MAINTENANCE OF EMERGENCY LIGHTING SYSTEMS - AREA 2

 

The Committee agreed to accept the negotiated offer from Construction Services in the sum of 126,492.70, together with allowances of 12,000, giving a total expenditure of 138,492.70.

 

(h) MAUCHLINE AVENUE (3-13) (SHOPS) - RENEW ROOF COVERING

 

The Committee agreed to accept the negotiated offer from Construction Services in the sum of 102,412.83, together with allowances of 17,600, giving a total expenditure of 120,012.83.

 

(i) GLEBELANDS PRIMARY SCHOOL - CARETAKER'S HOUSE RE-ROOF, DOOR AND WINDOW REPLACEMENT

 

The Committee agreed to accept the negotiated offer from Construction Services in the sum of 47,954.08, together with allowances of 8,000 giving a total expenditure of 55,954.08.

 

X BROUGHTY FERRY TO MONIFIETH ACTIVE TRAVEL IMPROVEMENTS

 

There was submitted Report No 200-2022 by the Executive Director of City Development detailing tenders received for the Broughty Ferry to Monifieth Active Travel Improvement Scheme (BFMAT) and seeking procurement of an artist for the design, manufacture and construction of various artworks throughout the Project.

 

The Committee noted that, due to the timescales involved, the recommendations in the report had been approved by the Executive Director of City Development in consultation with the Convener, Labour Group Spokesperson, Liberal Democrat Group Spokesperson and the Scottish Conservative and Unionist Party Member.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XI COMPULSORY PURCHASE ORDER SETTLEMENT

 

There was submitted Report No 223-2022 by the Executive Director of City Development seeking approval of the settlement of compensation payable, from the proceeds of sale, in respect of the Compulsory Purchase Order for the derelict subjects outlined in the report.

 

The Committee:-

 

(i) approved the final settlement of compensation and associated fees in respect of the Compulsory Purchase Order, to be paid from the proceeds of the recent sale of the property; and

 

(ii) delegated the Executive Director of City Development to agree any outstanding matters related to the process, including payment of fees associated with the compulsory purchase acquisition and sale.

 

XII SUPPORT FOR PROPOSED MAJOR CITY EVENTS IN 2023

 

There was submitted Report No 215-2022 by the Executive Director of City Development seeking approval to support events planned as outlined in the report.

 

The Committee:-

 

(i) authorised the events to proceed as outlined in the report, noting the significant economic benefits to the city;

 

(ii) approved the maximum financial contributions required from the Council in order to host these events;

 

(iii) noted that officers were negotiating and seeking financial contributions from local, regional and national partners to minimise the cost to the Council of hosting these events; and

 

(iv) remitted officers to maximise Community Wealth Building and sustainability.
