I DECLARATION OF INTEREST
Councillor Gordon declared a non-financial interest in item XXII by virtue of being a neighbouring resident.
II 20 MPH SPEED LIMITS IN RESIDENTIAL AREAS
The Committee acceded to requests for deputations to address the Committee in support of the proposal. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.
There was submitted Agenda Note AN28-2015, advising that this item has been placed on the agenda at the request of Councillor Macpherson who asked the Committee to approve a consultation process on introducing further 20 mph limits in Dundee, in light of the recent Transport Scotland guidance Good Practice Guide on 20 mph Speed Restrictions.
Thereafter, there was submitted Report No 43-2015 by the Director of City Development advising the Committee of the new Good Practice Guide on 20 mph Speed Restrictions published by Transport Scotland, intended for use by all Scottish local authorities.
The Committee noted that:-
- 20 mph zones and 20 mph limits significantly decrease the risk of being injured in a collision.
- lowering the speed limit from 30 mph to 20 mph can reduce child accidents by up to 70%.
- half of people who are hit by a car at 30 mph will die and only 10% of people hit by a car at 20 mph will die.
The Committee believed lower speed limits would make streets safer for pedestrians, cyclists and car users alike and would encourage people to walk and cycle with the consequential benefits for health and quality of life.
In light of recent "Good Practice Guide on 20 mph speed restrictions" published by Transport Scotland referred to in the Director's report the Committee called for the development of a policy on the implementation of 20 mph zones and limits, and, as a first step, the Director of City Development was instructed, to consult widely with community councils, tenants and residents associations, other representative community organisations and the public across all eight Local Community Planning Partnership areas to discuss their views of where 20 mph limits would be appropriate and would be of benefit to residential amenity and road safety in each community.
The Director of City Development was thereafter instructed to bring a report to the Committee on the outcomes of such a consultation exercise as far as practicable by December, 2015, with a view to thereafter considering commencement of a phased programme of introducing 20 mph limits on residential roads from 2016/2017 onwards, giving due consideration to the revenue and capital and enforcement implications of such a programme.
III MENZIESHILL AREA MASTERPLAN - PROCUREMENT OF PRIMARY AND NURSERY SCHOOLS AND COMMUNITY/NHS FACILITY
There was submitted Agenda Note AN13-2015, making reference to Article IV of the minute of the meeting of the Education Committee of 26th November, 2012 and to Article XII of the minute of the meeting of the Policy and Resources Committee of 26th November, 2012, where the Committees considered Report No 4452012 and agreed inter alia to build a replacement for Hillside and Gowriehill Primary Schools and Menzieshill Nursery School and consider options for the replacement of Menzieshill Community Centre on the sites of the former multi-storey blocks between Dickson Avenue and Earn Crescent.
It was reported that subsequent to the above decision, NHS Tayside had intimated their desire to provide a range of medical services within the Menzieshill area co-located with the DCC community facilities and that with the new schools and proposed community/NHS facility being built on adjacent plots, it would be expedient if both projects were designed and constructed with overlapping timescales using the same contractor.
Accordingly, the Committee agreed to the procurement of the construction of the Menzieshill Nursery and Primary Schools and the Menzieshill Community/NHS facility via an award of contract through the Scape Framework to Willmott Dixon Capital Works Ltd with Willmott Dixon Holdings Ltd as Guarantor. In turn the performance obligations of the contract would then be sub-contracted to Robertson Construction Group Ltd, with a report back to Committee on the details in due course.
IV NEW STREET NAMES - MELROSE COURT AND MELROSE GARDENS
There was submitted Agenda Note AN14-2015, advising of the result of a consultation for the suggestion of new street names at the former Dundee College site off Melrose Terrace, Dundee.
The Committee noted the response and approved the following new street names:-
- Melrose Court; and
- Melrose Gardens.
V NEW ROADS - ROAD CONSTRUCTION CONSENTS
There was submitted Agenda Note AN15-2015, making reference to Article IV of the Policy and Resources Committee on 27th April, 2009, wherein the Committee delegated the grant of road construction consent to the Director of City Development with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.
It was reported that the undernoted applications had been submitted and the Director of City Development had approved the applications subject to conditions which have been agreed with the applicants:-

VI TREE PRESERVATION ORDER - 04/2014 - SEYMOUR LODGE, 259 PERTH ROAD, DUNDEE, DD2 1JP
There was submitted Agenda Note AN16-2015, advising the Committee that on 7th October, 2014, the Council made a Tree Preservation Order on the above-mentioned site, within West End Suburbs Conservation Area. Unauthorised tree works had recently been carried out.
The Committee authorised the Head of Democratic and Legal Services and Director of City Development to undertake the necessary procedures and confirm the above Tree Preservation Order.
VII LINLATHEN ROAD (VARIATION TO SPEED RESTRICTIONS) ORDER 2015
There was submitted Report No 33-2015 by the Director of City Development relative to a review of the existing speed limit on Linlathen Road, Broughty Ferry, Dundee.
The Committee approved the preparation of the necessary Traffic Regulation Order which would reduce the existing 40 mph speed restriction to 30 mph on Linlathen Road, Broughty Ferry, Dundee.
VIII HARRIS ACADEMY (PERTH ROAD, DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2015
There was submitted Report No 37-2015 by the Director of City Development relative to a request for additions to waiting restrictions for Perth Road adjacent to Harris Academy.
The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Order for Dundee.
IX SUMMERFIELD AVENUE, DUNDEE (STOPPING-UP AND EXTENSION TO 20 MPH ZONE) ORDER 2015
There was submitted Report No 39-2015 by the Director of City Development relative to the requirement to promote a Traffic Regulation Order to reduce the speed limit on Summerfield Avenue and adjacent residential streets to promote road safety following residential development, and to stop‑up and remove from the list of public roads lengths of road, footpath, footway in the Summerfield Avenue area, utilising the powers of the Town and Country Planning (Scotland) Act 1997.
The Committee approved the preparation of the necessary Traffic Regulation Order to effect the changes of the traffic regulations on Summerfield Avenue and adjacent residential streets which would be added to the Dundee City Council (Whitfield Area, Dundee) (20 mph Zone) Order 2012, and the stopping-up and removal from the list of Public Roads of the lengths of road, footway, footpath and grass verge detailed in the report.
X DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2015
There was submitted Agenda Note AN18-2015, making reference to Article VI of the minute of meeting of this Committee of 28th October, 2013, wherein the Committee authorised the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.
It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received. Thereafter, the Order was duly advertised and one objection was received in respect of Mains Gardens and Mains Loan. After consultations it was agreed that the proposed waiting restrictions would be removed from this Order.
The Committee agreed to make the Order as amended.
XI DUNDEE DEVELOPMENT PLAN SCHEME 2015
There was submitted Report No 58-2015 by the Director of City Development setting out the 2015 Development Plan Scheme for the Dundee Local Development Plan.
The Committee agreed to:-
(a) approve the Development Plan Scheme 2015 as set out in Appendix 1 to the report;
(b) refer the Development Plan Scheme 2015 to the Scottish Government for information; and
(c) remit the Director of City Development to publish and implement the Development Plan Scheme 2015.
XII DUNDEE LOCAL DEVELOPMENT PLAN - UPDATE ON SUPPLEMENTARY GUIDANCE AND SITE PLANNING BRIEFS
There was submitted Report No 45-2015 by the Director of City Development, advising the Committee of the status of the supplementary guidance that was required to be prepared as a result of the adoption of the Dundee Local Development Plan 2014, and setting out the Site Planning Briefs that had been updated to take into account the Dundee Local Development Plan 2014 and highlight progress made on particular sites.
The Committee agreed to:-
(a) note that supplementary guidance on air quality and on developer contributions had been adopted;
(b) note that the Site Planning Briefs listed in Appendix 1 had been updated to reflect the policy and guidance in the adopted Dundee Local Development Plan 2014 and confirmed that they remain as material considerations in determining future planning applications;
(c) note that the Site Planning Briefs listed in Appendix 2 would not be updated due to the planning and development status of the sites;
(d) agree that the Site Planning Briefs listed in Appendices 3 and 4 will no longer be required due to them being either superseded by the LDP allocations, or a change in circumstance and should be withdrawn accordingly; and
(e) note the Site Planning Briefs in Appendix 5 that were currently under preparation and would be brought to Committee in 2015.
XIII DRAFT CONSERVATION AREA APPRAISALS - FORTHILL, RERES HILL, GROVE AND BLACKNESS CONSERVATION AREAS
There was submitted Report No 34-2015 by the Director of City Development seeking approval to consult on the Draft Forthill, Reres Hill, Grove and Blackness Conservation Area Appraisals.
The Committee approved the proposed Conservation Area Appraisals and remitted the Director of City Development to consult with the local community and interested parties on the terms of the Draft Conservation Area Appraisals and to report back with the results of the consideration process.
XIV FLOOD RISK MANAGEMENT (SCOTLAND) ACT 2009
There was submitted Report No 40-2015 by the Director of City Development advising the Committee of progress towards the production of a Flood Risk Management Plan for the Tay Estuary and Montrose Basin Local Plan District to be delivered in fulfilment of the requirements of the Flood Risk Management (Scotland) Act 2009, and seeking approval of the draft Delivery Plans for the two Potentially Vulnerable Areas which cover Dundee City which will be published for consultation in March, 2015.
The Committee agreed to:-
(a) note the progress being made towards production of the statutory Flood Risk Management Plan for the Tay Estuary and Montrose Basin Local Plan District; and
(b) approve the draft Delivery Plans for the two Potentially Vulnerable Areas which cover Dundee City which will be published for consultation in March, 2015.
XV STREET LIGHTING PARTNERSHIP
There was submitted Report No 72-2015 by the Director of City Development, giving an update on the progress and performance of the Street Lighting Services within Dundee City Council to 31st March, 2014, and seeking approval to extend the existing partnership with Dundee City Council, Perth and Kinross Council and Tayside Contracts for the shared service delivery of street lighting across the geographical areas of both Councils.
That the Committee noted the content of the report and agreed the following:-
(a) to extend the Partnership to 31st March, 2018; and
(b) that the Director of City Development continue to report back annually to the Committee advising on the progress and performance of the Partnership.
XVI ROAD MAINTENANCE PARTNERSHIP
There was submitted Report No 75-2015 by the Director of City Development giving an update on the progress and performance of the Road Maintenance Partnership with Tayside Contracts on the delivery of road maintenance and minor works services within Dundee City Council to 31st March, 2014, and seeking approval to extend the existing partnership with Dundee City Council and Tayside Contracts for the service delivery of road maintenance in Dundee.
The Committee noted the contents of the report and agreed:-
(a) to extend the Partnership to 31st March, 2018; and
(b) that the Director of City Development continues to report back annually to Committee advising on the progress and performance of the Partnership.
XVII TENDERS RECEIVED BY CITY ENGINEER
There was submitted Report No 65-2015 by the City Engineer detailing tenders received in respect of the undernoted projects:-
(a) RIVERSIDE RECYCLING FACILITY - UPGRADE OF WRIGHT AVENUE AND ACCESS ROAD
The Committee agreed to accept an offer from Tayside Contracts in the sum of 281,625.36, to which required to be added allowances amounting to 33,374.64, giving a total of 315,000. Dundee Plant Co Ltd were listed as sub-contractors.
(b) BRIDGE REPAIR WORKS CONTRACT 1
The Committee agreed to accept an offer from Tayside Contracts in the sum of 57,903, to which required to be added allowances amounting to 7,097, giving a total of 65,000.
(c) BRIDGE REPAIR WORKS CONTRACT 2
The Committee agreed to accept an offer from Tayside Contracts in the sum of 6,420, to which required to be added allowances amounting to 1,580, giving a total of 8,000.
XVIII EAST OF SCOTLAND EUROPEAN CONSORTIUM - FAMILIARISATION VISIT
There was submitted Agenda Note AN17-2015 advising that the East of Scotland European Consortium (ESEC) had arranged a familiarisation visit to Brussels from 2nd to 4th June, 2015 to provide members with an opportunity for networking and creating contacts. It would also provide an opportunity for meeting MEP's and attending sessions of interest at the EU Green Week Environmental Policy Conference.
The Convener, as the Council's representative on the ESEC, had been invited to attend. The ESEC would cover accommodation costs, but travelling costs, amounting to approximately 325, would require to be covered by the City Council, as would subsistence costs.
The Convener, seconded by Councillor Hunter, moved that the Convener should attend. As an amendment, Councillor Keenan, seconded by Councillor McCready, moved no member attend.
On a division, there voted for the motion - the Convener, Lord Provost Duncan, Depute Lord Provost Roberts, Bailie Sawers and Councillors Guild, Alexander, Black, Campbell, Cordell, Hunter, Lynn, McDonald, Melville and Murray (14); and for the amendment - Bailies Wright, Borthwick and Scott and Councillors Keenan, Asif, Bidwell, Brennan, Cruickshank, Ferguson, Gordon, McCready, McGovern and Macpherson (13) - whereupon the motion was declared carried.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

There was submitted Report No 60-2015 by the Director of City Development seeking approval for the sale of land at 78 Byron Crescent.
The Committee approved the sale on the terms and conditions detailed in the report.
XXI PROPOSED SALE OF LAND AT RIVERSIDE DRIVE, DUNDEE
There was submitted Report No 64-2015 by the Director of City Development seeking approval for the sale of land at Riverside Drive.
The Committee approved the sale on the terms and conditions detailed in the report.
XXII MILL O MAINS REGENERATION PHASE II
There was submitted Report No 10-2015 by the Director of City Development seeking approval for the sale of land at Mill O'Mains, Dundee.
The Convener, seconded by Councillor Hunter, moved approval of the recommendation in the report. As an amendment, Councillor Gordon, seconded by Councillor Keenan, moved deferral of the recommendation in the report.
