I RAIL FREIGHT POLICY DEVELOPMENT
There was submitted Report No 23-2010 by the Director of City Development outlining the purpose, content and proposals contained within the Scottish Government's Rail Freight Policy Development Consultation and Dundee City Council's response thereto.
The Committee agreed to note the consultation and endorsed Dundee City Council's response, as contained within Appendix 1 to the report, which had been returned to the Scottish Government in order to meet the required deadline.
II DUNDEE AREA WAITING RESTRICTIONS VARIATION
There was submitted Report No 29-2010 by the Director of City Development detailing the requests received during the last year for additions and alterations to waiting restrictions throughout the City.
The Committee approved the preparation of a Traffic Regulations Variation Order to affect the changes to the waiting restrictions in the relevant Traffic Regulations Orders for Dundee, as recommended in the report.
III ANGUS STREET - LIFF ROAD FOOTPATH, DUNDEE - STOPPING-UP
There was submitted Report No 37-2010 by the Director of City Development regarding a proposal to stop-up the entire length of the Angus Street - Liff Road footpath utilising the powers of the Town and Country Planning (Scotland) Act 1997 in order to accommodate a new development following planning consent.
The Committee approved the preparation of the Stopping-Up Order.
IV NEW ROADS - CONSTRUCTION CONSENTS
There was submitted Agenda Note AN31-2010, making reference to Article VI of the minute of meeting of the Policy and Resources Committee of 27th April, 2009, wherein the Committee delegated the grant of road construction consent to the Director of City Development with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.
It was reported that the undernoted application had been submitted and approved by the Director of City Development subject to conditions which had been agreed with the applicant:-

V TRAFFIC ORDERS ETC
There was submitted Agenda Note AN32-2010 relative to the undernoted Traffic Orders.
(a) DUNDEE CITY COUNCIL (KILSPINDIE PLACE, DUNDEE) (STOPPING-UP) ORDER 2009
Reference was made to Article I of the minute of meeting of this Committee of 26th October, 2009, wherein the Committee authorised the preparation of an Order to stop-up lengths of roads situated at Kilspindie Place, Dundee to facilitate the redevelopment of the site to the west and south of Kilspindie Place.
It was reported that the Order was duly prepared and advertised in the Evening Telegraph and Post and The Edinburgh Gazette, and the relevant statutory undertakers consulted. No objections were received.
The Committee therefore agreed to authorise and confirm the Stopping-Up Order, and authorise formal publication of the confirmation, after which the Order would become operative.
(b) DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2010
Reference was made to Article VIII of the minute of meeting of this Committee of 27th April, 2009, wherein the Committee authorised the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received. Thereafter, the Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
(c) DUNDEE CITY COUNCIL (HILLSIDE TERRACE, DUNDEE) (STOPPING-UP) ORDER 2009
It was reported that the Convener had agreed that this Item be considered as a matter of urgency in terms of Standing Order No 17(b) in view of the timescales involved.
Reference was made to Article XII of this Committee of 24th August, 2009, wherein the Committee approved the preparation of a Stopping-Up Order to stop-up a short length of Hillside Terrace to accommodate new development at the former Wimberley Houses.
It was reported that the Order was duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette and the relevant statutory undertakers consulted. Eleven objections had been received.
As there were no objections which were not withdrawn only Scottish Ministers may confirm the Order. The Committee therefore agreed to submit the Order to Scottish Ministers to confirm it in terms of the relevant legislation having noted that the Scottish Ministers must, before confirming the Order, cause a local inquiry to be held.
VI TENDERS RECEIVED BY CITY ENGINEER
There was submitted Report No 3-2010 by the City Engineer detailing tenders received in respect of the undernoted projects:-
(a) SOUTH TAY STREET ENVIRONMENTAL IMPROVEMENTS
The Committee agreed to accept the lowest offer from Kilmac Construction Ltd, in the sum of 112,186.35, to which required to be added allowances amounting to 195,813.65, giving a total of 308,000.
(b) ROBERTSON STREET ENVIRONMENTAL IMPROVEMENTS
The Committee agreed to accept an offer received from Dundee Contract Services in the sum of 56,666, to which required to be added allowances amounting to 9,334, giving a total of 66,000.
VII TENDERS RECEIVED BY CITY ARCHITECTURAL SERVICES OFFICER
There was submitted Report No 68-2010 by the City Architectural Services Officer detailing tenders received in respect of the facade refurbishment of ten ground floor shop units at 201-219 Hilltown.
The Committee agreed to accept the lowest offer from Muirfield (Contracts) Ltd, in the sum of 92,535.87, to which required to be added allowances amounting to 14,824, giving a total of 107,359.87.
The Committee also noted that Muirfield (Contracts) Ltd, had listed the undernoted sub-contractors:-

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
