The minute of meeting of this Committee of 8th Septemb er, 2008 was held as read.

 

Unless marked thus * all items stand delegated.

 

I LOCHEE CONSERVATION AREA

 

There was submitted Agenda Note AN187-2008 making reference to Article IV of the minute of meeting of this Committee of 10th March, 2008, wherein the Committee agreed to approve the proposed draft Lochee Conservation Area for consultation purposes and remit the Director of Planning and Transportation to consult with the local community and interested parties on the terms of the Conservation Area Character Appraisal document.

 

It was reported that no negative feedback had been obtained but, due to the potential impact on the character of the area for any future developments, it was recommended that the boundary of the Conservation Area be extended.

 

The Committee agreed that:-

 

(a) the boundary of the Lochee Conservation Area be extended to include the area East of Gray's Lane;

 

(b) the Lochee Conservation Area and Conservation Area Character Appraisal be approved as supplementary planning guidance to the Dundee Local Plan Review 2005 and as a material consideration in the determination of planning applications;

 

(c) the proposed Lochee Conservation Area be formally designated in accordance with the requirements of Section 62 of the Planning (Listed Building and Conservation Areas) (Scotland) Act 1997, and it be remitted to the appropriate Officers publish a notice confirming the designation of the Conservation Area in the Edinburgh Gazette and Evening Telegraph and formally notify Scottish Ministers of the designation of the Conservation Area; and

 

(d) it be remitted to the appropriate Officers to submit Article IV Directions to Scottish Ministers in order to further protect the unique character and appearance of the Conservation Area.

 

II TOURIST SIGNPOSTING

 

There was submitted Report No 496-2008 by the Director of Planning and Transportation proposing a review of the tourist signing policy relating to the signing of catering establishments.

 

The Committee approved the revised Tourist Signing Policy as shown in Appendix I to the report.

 

III FOGGYLEY SITE PLANNING BRIEF - CONSULTATION RESPONSE

 

There was submitted Report No 488-2008 by the Director of Planning and Transportation, advising the Committee of the results of the consultation stage for the draft Foggyley Site Planning Brief. The Committee agreed to:-

 

(a) note the response to the consultation stage for the draft Site Planning Brief;

 

(b) confirm the terms of the Site Planning Brief;

 

(c) remit the Director of Planning and Transportation to issue the final approved Site Planning Brief to the owners, appropriate design teams and developers as part of the sale particulars;

 

(d) remit the Director of Planning and Transportation to prepare a Tree Preservation Order on trees on the site for issue to the prospective purchaser; and

 

(e) refer the final Site Planning Brief to the Development Quality Committee as a relevant material planning consideration.

 

IV DUNDEE AND ANGUS BUS PUNCTUALITY IMPROVEMENT PARTNERSHIP

 

There was submitted Report No 486-2008 by the Director of Planning and Transportation seeking approval for Dundee City Council to participate in the Dundee and Angus Bus Punctuality Improvement Partnership.

 

The Committee approved this proposal.

 

V DUNHOLM ROAD TO SOUTH ROAD FOOTPATH - STOPPING-UP

 

There was submitted Report No 452-2008 considering a proposal to stop-up a length of footpath between Dunholm Road and South Road utilising the powers of the Town and Country Planning (Scotland) Act 1997.

 

The Committee approved the preparation of a Stopping-Up Order to stop-up a length of footpath between Dunholm Road and South Road to accommodate a new development following planning consent.

 

VI CRAIGMORE STREET TO DUNMORE STREET FOOTPATH - STOPPING-UP

 

There was submitted Report No 451-2008 considering a proposal to stop-up the footpath between Dunmore Street and Craigmore Street utilising the powers of the Town and Country Planning (Scotland) Act 1997.

 

The Committee approved the preparation of a Stopping-Up Order to stop-up the footpath between Dunmore Street and Craigmore Street opposite Ashmore Street to accommodate a new development following planning consent.

 

VII DUNDEE CITY COUNCIL (RESTRICTED ROADS) (VARIATION) ORDER 2008

 

There was submitted Agenda Note AN188-2008 making reference to Article IV of the minute of meeting of this Committee of 9th June, 2008, wherein the Committee authorised the preparation of an Order to amend the descriptions of restricted roads following reclassification of the roads.

 

The Order referred to the undernoted roads that were previously classified and required an Order to enforce the 30 mph speed limit. They had since been made unclassified and therefore had to be removed from the Order:-

 

Albert Street

Princes Street

Arthurstone Terrace

Dura Street

Kemback Street

Raglan Street

Lyon Street and West Lyon Street.

 

Dura Street had now been classified and required to be included in the Order.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

The Committee therefore authorised formal publication of the Order as drafted.

 

VIII CONFIRMATION OF TREE PRESERVATION ORDER, DUDHOPE GARDENS

 

There was submitted Agenda Note AN189-2008, advising the Committee that on 4th June, 2008 the Council made a provisional Tree Preservation Order on the above mentioned site in order to protect and preserve the arboreal amenity of the area.

 

It was reported that no objections had been received to the Order.

 

The Committee therefore authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the above Tree Preservation Order.

 

IX NEW ROADS

 

There was submitted Agenda Note AN190-2008, advising that the undernoted applications had been submitted and the Director of Planning and Transportation had recommended that they be approved subject to conditions which have been agreed with the applicants:-

The Committee approved the applications and further agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

X TENDERS RECEIVED BY CITY ENGINEER

 

There was submitted Report No 432-2008 by the City Engineer detailing tenders received in respect of Hilltown Environmental Improvements 2008/2009.

 

The Committee agreed to accept the lowest offer from Dundee Plant Co Ltd in the sum of 106,628.20, to which required to added allowances totalling 43,371, giving a total of 150,000.
