I PLANNING AND TRANSPORTATION DEPARTMENTAL SERVICE PLAN - ANNUAL PERFORMANCE REPORT
There was submitted Report No 280-2007 by the Director of Planning and Transportation reporting on the Department's Service Plan Annual Performance for the period ending 31st March, 2007 as part of the Council's Performance Management Framework and Best Value Policy.
The Committee agreed to note:-
(a) the Summary of Key Highlights and Achievements, together with evaluation of performance achieved on the targets and trends in the core performance indicators; and
(b) the evaluation of progress on key projects and areas for improvement as set out in Appendix 2 to the report.
II CENTRAL DUNDEE CAR PARKING STRATEGY
There was submitted Report No 279-2007 by the Director of Planning and Transportation detailing a Parking Strategy for Central Dundee which included a series of objectives and measures for the Council's parking service.
The Committee approved the Central Dundee Car Parking Strategy as contained in Appendix 1 to the report and agreed that the Director of Planning and Transportation be remitted to report back on proposals for Resident's Parking for the city centre and surrounding area.
III VACANT AND DERELICT LAND FUND 2007-2008 - PROJECT PROGRAMME AND PROPOSED PROJECT AT207 STRATHMARTINE ROAD
There was submitted Agenda Note AN165-2007, making reference to Article VII of the minute of meeting of this Committee of 17th April, 2006 which approved the draft programme of works proposed under the Vacant and Derelict Land Fund for 2006-2008.
It was reported that the 2 million programme of works for the period 2006-2007 had been successfully implemented and that to date, the majority of the 2 million budget for the period 2007-2008 had been allocated to the projects listed below.
For a variety of reasons, not all of the projects within the fund programme could be implemented within the timescales allowed for by the Vacant and Derelict Land Fund and therefore, to avoid an underspend, it had been necessary to identify and implement alternative projects.
One new project which had received Scottish Executive approval as an acceptable substitute was the refurbishment of an industrial unit at 207 Strathmartine Road. It was recommended that a contribution of 150,000 should be made to the Economic Development Department towards the refurbishment of the unit to allow the relocation of a business currently operating from Erskine Street Yards. Any additional costs would be met by the Economic Development Department.
The Committee noted accordingly and agreed that a contribution of 150,000 should be made towards the project at Strathmartine Road.

IV WEIGHT LIMITS ON BRIDGES
There was submitted Report No 212-2007 by the Director of Planning and Transportation, seeking approval to promote a Traffic Regulation Order to vary the terms of the relevant weight limit orders following reassessment of the various weight limits on bridges.
The Committee agreed that a Traffic Regulation Order be prepared to vary the maximum gross weight restrictions on various bridges following their reassessment, as detailed in the report.
V KELLAS ROAD - EXTENSION TO SPEED LIMIT
There was submitted Report No 229-2007 by the Director of Planning and Transportation relative to a proposal to extend the 30 mph speed limit in Kellas Road, Dundee.
The Committee approved the preparation of a Joint Traffic Regulation Order with Angus Council to extend the 30 mph speed limit in Kellas Road to cover new housing developments.
VI DECRIMINALISATION OF PARKING ENFORCEMENT - PERSISTENT EVADERS OF PENALTY CHARGE NOTICES (PCN's)
There was submitted Report No 259-2007 by the Director of Planning and Transportation, seeking approval of a Council Policy in connection with Persistent Evaders of Penalty Charge Notices under Decriminalisation of Parking Enforcement legislation.
The Committee approved the policy of uplifting persistent evader vehicles in Dundee, as detailed in the report.
VII ONGOING MAINTENANCE OF PUBLIC TRANSPORT INFORMATION SYSTEMS
There was submitted Report No 265-2007 by the Director of Planning and Transportation, seeking approval for the continuation of maintenance agreements associated with the Dundee Public Transport Information Systems.
The Committee remitted the Director of Planning and Transportation to finalise contractual negotiations for the maintenance agreements relating to the Dundee Public Transport Information Systems with a contract duration of three years and a two year extension option (based on satisfactory performance).
VIII ROAD SAFETY SCHEMES - IMPLEMENTATION 2007/08
There was submitted Report No 266-2007 by the Director of Planning and Transportation, advising of a programme of road safety measures to be implemented at locations in the city.
The Committee agreed:-
(a) to approve the implementation of the Road Safety Schemes as set out in Appendix 1 to the report; and
(b) that engineering measures required would be awarded to Tayside Contracts under the agreed Schedule of Rates.
IX STATUTORY UNDERTAKERS REINSTATEMENT PERFORMANCE IN DUNDEE 2006-2007
Councillor Will Dawson declared a non-financial interest in this item by virtue of being an employee of Scottish and Southern Energy.
There was submitted Report No 267-2007 by the Director of Planning and Transportation reporting on the performance of Statutory Undertakers operating in Dundee during 2006-2007 based on inspections and coring of their reinstatements under the New Roads and Street Works Act 1991 (NRSWA); and updating the Committee on the status of the Transport (Scotland) Act 2005, Part 2 - Road Works.
The Committee agreed to note:-
(a) the performance of Statutory Undertakers reinstatements in Dundee based on the visual sample inspection regime and the local and national coring results for the last year; and
(b) the status of the Transport (Scotland) Act 2005, Part 2 - Road Works, different parts of which were expected to be implemented on 1st October, 2007 and 1st April, 2008.
X CYCLING, WALKING AND SAFER STREETS (CWSS) PROJECTS COMMENCING 2007-2008
There was submitted Report No 270-2007 by the Director of Planning and Transportation, seeking approval for a programme of works for the year 2007-2008 funded from additional grant capital ring-fenced by the Scottish Executive for Cycling, Walking and Safer Streets (CWSS) projects.
The Committee approved the proposed programme of works for the year 2007-2008, as detailed in the report.
XI UPDATE ON SITE PLANNING BRIEFS
There was submitted Report No 197-2007 by the Director of Planning and Transportation, advising the Committee of the Site Planning Briefs that remained valid as material considerations in making planning decisions.
The Committee agreed:-
(a) to reaffirm the status of the Site Planning Briefs listed in Appendix 1 to the report as material considerations in dealing with planning applications for the sites as appropriate; and
(b) that the Site Planning Briefs detailed in Appendix 2 to the report be withdrawn.
XII DRAFT SITE PLANNING BRIEF, FORMER FOUNDRY SITE AT LOONS ROAD/LAWSIDE ROAD
There was submitted Report No 251-2007 by the Director of Planning and Transportation advising the Committee on the results of the consultation stage for the draft site planning brief for the former foundry site at Loons Road/Lawside Road and seeking its approval as guidance to the owners, design teams or developers.
The Committee agreed to:-
(a) note the response to the consultation stage;
(b) confirm the terms of the site planning brief as indicated in Appendix 1 to the report;
(c) remit the Director of Planning and Transportation to make available the final approved site planning brief to any interested party; and
(d) refer the final site planning brief to the Development Quality Committee as a relevant material planning consideration.
XIII DUNDEE CITY REGION STUDY - IMPLEMENTATION
There was submitted Report No 263-2007 by the Director of Planning and Transportation seeking the Committee's agreement to a programme of implementation measures arising from the Dundee City Region Retail Study.
The Committee agreed to the proposed actions set out in the report and its Appendix.
XIV TAY STREET LANE - DRAFT SITE PLANNING BRIEF
There was submitted Report No 269-2007 by the Director of Planning and Transportation seeking approval for the draft Tay Street Lane Site Planning Brief to proceed to consultation with owners and interested parties.
The Committee agreed to:-
(a) approve the draft Site Planning Brief consultation;
(b) remit the Director of Planning and Transportation to consult with the local communities and interested parties on the draft Site Planning Brief; and
(c) remit the Director of Planning and Transportation to report back on the result of the consultation at the November Committee meeting.
XV THE PUBLIC CONSULTATION AND ENGAGEMENT PROGRAMME FOR THE DRAFT HILLTOWN PHYSICALREGENERATION FRAMEWORK
There was submitted Joint Report No 273-2007 by the Director of Planning and Transportation and Director of Housing advising the Committee of the first stages of the consultation and engagement programme on the content of the Draft Hilltown Physical Regeneration Framework.
The Committee agreed to support the continuation of the consultation programme and remitted to the Director of Planning and Transportation and the Director of Housing to report the findings of the consultation programme to the Committee meeting on 10th September, 2007.
XVI DEVELOPING THE NEW PLANNING PERFORMANCE ASSESSMENT FRAMEWORK
There was submitted Report No 275-2007 by the Director of Planning and Transportation seeking the agreement of the Committee to a response to the Scottish Executive's Consultation Paper on Developing a New Planning Performance Assessment Framework.
The Committee agreed to respond to the Scottish Executive Consultation Paper in the terms set out in the Appendix to the report.
XVII NEW ROADS
There was submitted Agenda Note AN166-2007 detailing the undernoted applications for Road Construction Consent.
The Committee approved the applications subject to conditions agreed by the Director of Planning and Transportation.

The Committee approved the proposed new names.
In addition, reference was made to Article XVIII of the minute of meeting of this Committee of 12th June, 2006, wherein the street name of "Linlathen Road" (North of A92 Arbroath Road) was approved. Due to the potential for further development in the area, approval was given to use the name "Linlathen", adding on the appropriate title of Lane, Grove etc to new roads which may be created as a result of this further development and which would lead directly off Linlathen Road.
XIX STREET LIGHTING PARTNERSHIP
There was submitted Report No 292-2007 by the Director of Planning and Transportation, giving an update on progress and performance of the Street Lighting Partnership with Tayside Contracts on the delivery of Street Lighting Services to 31st March, 2007.
The Committee noted the contents of the report and agreed that the Director of Planning and Transportation be remitted to report back annually to the Committee with the ongoing progress of the Partnership.
XX SITE PLANNING BRIEF - WIMBERLEY HALLS OF RESIDENCE
There was submitted Agenda Note AN168-2007 making reference to Article II of the meeting of the Committee of 14th August, 2006, whereby approval was given to the Director of Planning and Transportation to proceed with external consultation on the draft Site Planning Brief for Wimberley Halls of Residence and to report back on the completion of the consultation exercise.
It was reported that the draft Site Planning Brief for the Wimberley Halls of Residence site was issued to over 180 households in the local area, the West End Community Council and the University of Dundee as owners of the site.
44 responses were received representing 39 households. In addition, a petition containing 72 signatures from 47 households from Hillside Terrace, Hillside Road and Hillside Drive was submitted.
However, it was further reported that during the consideration of responses to the draft Site Planning Brief, the University chose to market the site. In the absence of an approved Site Planning Brief, the Council was obliged to rely on the Dundee Local Plan Review 2005 as the basis for guidance to prospective developers interested in purchasing the site.
Marketing of the site had now concluded and it was reasonable to expect that offers for the site were submitted on the basis of the Dundee Local Plan Review 2005. As such, it was inappropriate to seek the Council's approval of a Site Planning Brief for the Wimberley Halls Site, and instead, planning applications would be considered in the context of the Local Plan.
The Committee noted accordingly.
XXI TRAFFIC ORDERS
There was submitted Agenda Note AN169-2007 relative to the undernoted Traffic Orders:-
(a) DUNDEE CITY COUNCIL (EAST HENDERSON'S WYND AND ST DAVID'S LANE, DUNDEE) (STOPPING-UP) ORDER 2007
Reference was made to Article III of the minute of meeting of this Committee of 12th February, 2007, wherein it was agreed to stop-up lengths of roads and footways at East Henderson's Wynd and St David's Lane, Dundee in order to accommodate a new development.
It was reported that the Order was duly prepared and advertised in the Evening Telegraph and Post and the Edinburgh Gazette, and the relevant statutory undertakers were consulted. No objections were received.
The Committee therefore agreed to authorise and confirm the Stopping-Up Order, and authorise formal publication of the confirmation, after which the Order would become operative.
(b) DUNDEE CITY COUNCIL (ARBROATH ROAD, DUNDEE) (VARIATION OF SPEED LIMITS) ORDER 2007
Reference was made to Article VIII of the minute of meeting of this Committee of 13th November, 2006, wherein the Committee authorised the preparation of an Order to improve safety for pedestrians attempting to cross Arbroath Road.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received. Thereafter, the Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
(c) DUNDEE CITY COUNCIL (RESTRICTED ROADS) ORDER 2007
Reference was made to Article V of the minute of meeting of this Committee of 12th March, 2007, wherein the Committee authorised the preparation of the above Order.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Committee therefore agreed to make the Order as advertised.
(d) DUNDEE CITY COUNCIL (40 MPH SPEED LIMITS) ORDER 2007
Reference was made to Article V of the minute of meeting of this Committee of 12th March, 2007, wherein the Committee authorised the preparation of the above Order.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Committee therefore agreed to authorise formal publication of the Order as drafted.
(e) DUNDEE CITY COUNCIL (50 MPH SPEED LIMITS) ORDER 2007
Reference was made to Article V of the minute of meeting of this Committee of 12th March, 2007, wherein the Committee instructed and authorised the preparation of the above Order.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Committee therefore agreed to authorise formal publication of the Order as drafted.
