I MINUTE OF AGREEMENT - PARKING APPEALS SERVICE
There was submitted Agenda Note AN393-2005 advising that Legislation (Road Traffic Act 1991) required that local authorities involved in the administration of the Decriminalised Parking Enforcement (DPE) scheme contribute to the funding of the Scottish Parking Appeals Service (SPAS).
The original agreement had been between Edinburgh City Council and the SPAS but every local authority subsequently taking up the DPE scheme had been required to sign up for membership through a Minute of Agreement, with the administrative cost of the Appeals Service being shared among participating local authorities on a pro rata basis. The cost incurred by Dundee City Council during the last financial year was 5,337.
The latest local authority to join the scheme was South Lanarkshire Council and all existing members were therefore required to sign up a revised Minute of Agreement.
The Committee agreed that Dundee City Council sign up to the Minute of Agreement, having noted that it was anticipated that there would be a slight reduction in annual costs due to an additional contributing Council.
II GREENMARKET Multi storey car park
There was submitted Agenda Note AN394-2005 whereby reference was made to Article XV of the minute of meeting of this Committee of 15th August 2005 when the City Engineer was authorised to negotiate an offer with Raynesway Construction for advanced water and sewerage diversion works. It was reported that the City Engineer had negotiated an offer of 144,440.11 and authorisation was sought for the Depute Chief Executive (Support Services) to accept this offer from Raynesway Construction Ltd subject to planning permission being granted.
In addition to the above, allowances for Contingencies and Professional fees of 10,000.00 and 15,000.00 respectively should be made giving an overall cost of 169,440.11.
The Depute Chief Executive (Finance) advised that the cost of these works could be met from allowances within the Planning and Transportation Departments Capital Plan 2005/06.
The Committee agreed to approve acceptance of this offer.
III DUNDEE PUBLIC TRANSPORT INFORMATION SYSTEM (PTIS) - ONGOING MAINTENANCE
There was submitted Agenda Note AN395-2005 advising that the PTIS had now been operational for 18 months and that Bi-annual safety checks and ongoing repairs were necessary to ensure the ongoing functionality of the system.
The initial inclusive maintenance had now been completed as detailed in the original tender award.
Within the tender specification Dundee City Council were permitted to further extend the maintenance period for an additional two years. The value of the first 12 months maintenance was included with initial tender submission, thus ensuring Best Value during award process.
The three contractors who supplied and installed the system Steer Davies Gleave (main contractor), Travel Info Systems and Region Services Limited have subsequently supplied annual maintenance costs applicable from 1st May, 2005.
Electronic signs, kiosks and departure boards, Region Services Limited amount to 48,933 per annum from 1st May, 2005 to 31st April, 2007.
The Committee agreed to extend the maintenance period for an additional two years on this basis, having noted that year one costs would be met from Planning and Transportation revenue budgets with future years funding from bus shelter advertising contracts.
IV DUNDEE LOCAL PLAN REVIEW - ADOPTION
There was submitted Agenda Note AN396-2005 whereby reference was made to Article X of the minute of meeting of this Committee of 20th June 2005 wherein the Committee considered a report on the proposed modifications to the Finalised Dundee Local Plan Review and recommended that the Committee remit the Director of Planning and Transportation to proceed with the necessary statutory procedures to formally adopt the Dundee Local Plan Review.
It was reported that this process had now been completed and the City Council, by resolution, formally adopted the Dundee Local Plan Review 2005 on 1st August. Statutory procedures, however, allow for a period of six weeks subsequent to this for the submission of a legal challenge to plan's adoption. This period expired on 16th September 2005 and no such challenge was forthcoming.
It was noted that the Dundee Local Plan Review 2005 had now therefore been formally adopted by the City Council and would act as the statutory basis for all land use planning decision making in future, including the determination of applications for planning permission in future.
The Committee also resolved to formally repeal the previous "Dundee Local Plan 1998" and the "Urban Nature Conservation Subject Local Plan 1995" so that they would no longer be a consideration in land use planning issues.
V CONFIRMATION OF TREE PRESERVATION ORDER - 06/2005 - ST ANDREWS CATHEDRAL, 150 NETHERGATE, DUNDEE

VII DUNDEE CITY COUNCIL (SOUTH MARKETGAIT, UNION STREET AND YEAMAN SHORE AREA, DUNDEE) (PROHIBITION OF LEFT HAND TURN AND VARIATION OF TRAFFIC REGULATIONS) ORDER 2005
There was submitted Agenda Note AN400-2005 whereby reference was made to Article IX of the minute of meeting of this Committee of 21st March, 2005 instructing and authorising the preparation of an Order to accommodate the new road layout of South Marketgait and Yeaman Shore and to maximise the efficiency of the traffic circulation within the new layout.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
VIII DUNDEE CITY COUNCIL (BROOK STREET, BROUGHTY FERRY, DUNDEE) (VARIATION OF TRAFFIC REGULATIONS)
There was submitted Agenda Note AN401-2005 whereby reference was made to Article IV of the minute of meeting of this Committee on 15th August 2005 when approval was granted to make the above Order subject to the deletion of reference to Fisher Street.
Subsequently at the design stage it has been determined that the provision of two bus stops in Brook Street between Fort Street and Gray Street was problematic and it would be better if only one was provided in the central build out. As a result the build out at the eastern end can be shortened thus creating an additional parking space on both sides of the road.
It was reported that in view of the timescales involved, this change was approved by Director of Planning and Transportation in consultation with the convener and spokespersons of the other groups.
The Committee noted accordingly.
IX DUNDEE CITY COUNCIL (VICTORIA STREET, DUNDEE) (REVOCATION OF BUS AND TAXI LANE) ORDER 2005
There was submitted Agenda Note AN403-2005 whereby reference was made to Article III of the minute of meeting of this Committee of 21st February 2005 instructing and authorising the preparation of an Order to remove unnecessary restrictions following the construction of Lower Princes Street.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
X DUNDEE CITY COUNCIL (PANMURE STREET, DUNDEE) (PROHIBITION OF DRIVING EXCEPT FOR BUSES OR TAXIS) ORDER 2005
There was submitted Agenda Note AN402-2005 whereby reference was made to Article II of the minute of meeting of this Committee of 21st February 2005 instructing and authorising the preparation of an Order to accommodate the realignment of the carriageway at Euclid Crescent/Panmure Street and the consequent relocation of signs.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
XI TRAFFIC SIGNAL MAINTENANCE
There was submitted Report No 522-2005 by Director of Planning and Transportation detailing tenders received in respect of traffic signal maintenance and, advising the Committee that in view of the timescales involved, approval had been given by the Director of Planning and Transportation following consultation with the Convener, and spokespersons of the other groups, to accept a joint tender submitted by Siemens Traffic Control Ltd, amounting to 159.139.67 per annum and to extend the existing formal agreement for traffic signal maintenance between Dundee City, Angus and Perth and Kinross Councils to cover the duration of the contract period of five years.
XII MICROCONNECT MOBILE PHONE ANTENNAE
There was submitted Report No 542-2005 by the Director of Planning and Transportation advising the Committee of the outcome of an investigation into the potential to install Microconnect antennae on the Council's street furniture and seeking approval to implement a scheme within Dundee.
The Committee agreed to note the outcome of the investigation into the potential of the Microconnect system outlined in Section 6 of the report, and remit the Depute Chief Executive (Support Services) to conclude negotiations and enter into a contract with British Telecom for the installation of such a scheme in Dundee.
