I THE E-PLANNING COMPACT

 

There was submitted Report No 306-2004 by Director of Planning and Transportation seeking the agreement of the Committee to the adoption of the E-Planning Compact as the basis of a common approach to modernising planning service delivery in Scotland through the use of the Internet.

 

The Committee agreed to:-

 

(i)confirm the E-Planning Compact as the basis for modernising the planning service delivery in Dundee City Council through the use of the Internet, and;

 

(ii)approve the purchase of the software and hardware necessary to commence the implementation of Internet based service delivery at a cost of 175,000.

 

II NORTH LINDSAY STREET DEVELOPMENT BRIEF

 

There was submitted Report No 372-2004 by Director of Planning and Transportation seeking approval of a draft site planning brief for the North Lindsay Street area as the basis of consultation with interested parties and for pursuing a comprehensive redevelopment of the site.

 

The Committee agreed to:-

 

(i)approve the draft site planning brief for the purposes of consultation;

 

(ii)remit the Director of Planning and Transportation to consult with the other owners and interested parties on the terms and content of the draft site planning brief;

 

(iii)remit the Director of Planning and Transportation to report back on the results of the consultation exercise within a period of two months; and

 

(iv)remit the Director of Planning and Transportation to put forward the final brief as a basis for the assembly of the development site.

III HILLTOWN - JAMAICA WORKS - SITE PLANNING BRIEF

 

There was submitted Report No 419-2004 by Director of Planning and Transportation seeking approval for a draft Site Planning Brief for the Jamaica Works site as the basis of consultation with adjacent site owners and interested parties.

 

The Committee agreed to:-

 

(i)approve the draft Site Planning Brief for the purposes of consultation;

 

(ii)remit the Director of Planning and Transportation to consult with the other owners and interested parties on the terms and content of the draft site planning brief; and

 

(iii)remit the Director of Planning and Transportation to report back on the results of the consultation exercise within a period of two months.

 

IV MAKING DEVELOPMENT PLANS DELIVER - CONSULTATION PAPER BY THE SCOTTISH EXECUTIVE

 

There was submitted Report No 423-2004 by Director of Planning and Transportation providing a review of the Consultation Document "Making Development Plans Deliver" and confirming the Council's response to the Scottish Executive.

 

The Committee agreed that the comments detailed in the report be forwarded to the Scottish Executive in response to its Consultation Document.

 

V SCOTTISH EXECUTIVE CONSULTATION PAPER "RIGHTS OF APPEAL IN PLANNING"

 

There was submitted Report No 427-2004 by the Director of Planning and Transportation informing the Committee of the contents of the Scottish Executive's Consultation Paper "Rights of Appeal in Planning" and setting out the Council's responses to the questions set out in the paper.

 

The Committee agreed to note the contents of the Consultation Paper and approved the proposed responses.

 

VI HIGHWAY STRUCTURES INSPECTION, ASSESSMENT AND WORK PROGRAMME 2004/2005

 

There was submitted Report No 341-2004 by the Director of Planning and Transportation seeking to update the Committee on progress with the highway structures inspection, assessment and works programme and to obtain approval for the proposed expenditure in 2004/05.

 

The Committee agreed to:-

 

(i)note the position on current progress;

 

(ii)authorise the expenditure outlined in the report; and

 

(iii)authorise the appointment of Tayside Contracts to carry out the works identified in this report on a partnering arrangement.

 

VII KIRKTON CENTRAL CORE - ENVIRONMENTAL IMPROVEMENT PROJECT AND TRAFFIC MANAGEMENT

 

There was submitted Report No 340-2004 by the Director of Planning and Transportation seeking to develop the Kirkton Central Core brief approved by this Committee at its meeting of 1st December, 2003, following a public consultation exercise. The report detailed the Traffic Regulation Orders to be promoted as required to enable the implementation of the Kirkton Central Core Site Development.

The Committee approved implementation of the scheme and the preparation of the necessary Traffic/Roads Order to:-

 

(i)prohibit vehicular traffic except for cycles on a short length of Ashmore Street at its junction with Derwent Avenue;

 

(ii)re-adopt Keswick Terrace between its junction with Derwent Avenue and the link road to Ashmore Street/Beauly Avenue;

 

(iii)open its junction with Derwent Avenue;

 

(iv)close Beauly Avenue at its junction with Ashmore Street to enable parking bays to be formed; and

 

(v)require the stop-up of a short length of Derwent Avenue to facilitate the relocation of the bus terminus.

 

VIII GLENESK AVENUE - TRAFFIC MANAGEMENT

 

There was submitted Report No 446-2004 by the Director of Planning and Transportation seeking to assess the need to introduce a No Entry prohibition to Glenesk Avenue at each end as a means of removing through traffic.

 

The Committee approved the preparation of a Traffic Regulation Order to restrict entry at each end of Glenesk Avenue leaving the only remaining entry via Glenisla Terrace, having noted that cyclists would be exempt from the restriction.

 

IX OLD GLAMIS ROAD - PROPOSED PUFFIN PEDESTRIAN CROSSING

 

There was submitted Report No 426-2004 by the Director of Planning and Transportation recommending the installation of a Puffin crossing on Old Glamis Road adjacent to Dundee College Kingsway campus, together with associated traffic management.

 

The Committee approved the installation of a Puffin crossing on Old Glamis Road adjacent to Dundee College Kingsway campus.

 

X WALTON STREET, DUNDEE - STOPPING UP

 

There was submitted Report No 421-2004 by the Director of Planning and Transportation considering the necessity to stop-up the length of Walton Street, Dundee to facilitate new housing developments on Brook Street.

 

The Committee approved the preparation of a Stopping Up Order under the powers of the Town and Country Planning (Scotland) Act 1997 to stop up the length of Walton Street, Dundee to allow for new housing.

 

XI KINGSWAY EAST SERVICE ROAD - ONE WAY RESTRICTION

 

There was submitted Report No 430-2004 by the Director of Planning and Transportation considering the necessity to introduce a one-way restriction on Kingsway East Service Road.

 

The Committee approved the preparation of a Traffic Regulation Order to introduce a one-way eastbound restriction on the service road between Pitkerro Road and Westhall Court.

 

XII PLANNING AND TRANSPORTATION DEPARTMENTAL SERVICE PLAN ANNUAL PROGRAMME REPORT

 

There was submitted Report No 490-2004 by the Director of Planning and Transportation reporting on the Department's Service Plan Annual Performance for the period ending 31st March 2004 as part of the Council's Performance Management system and Best Value policy.

 

The Committee noted the Summary of Key highlights and achievements together with the evaluation of performance achieved on the targets and trends in the core performance indicators.

 

XIII DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2004

 

There was submitted Agenda Note AN271-2004 whereby reference was made to Article X of the minute of meeting of this Committee held on 29th September, 2003 instructing and authorising the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

The proposed Order was duly drafted and during the statutory consultation period comments were received regarding Glamis Drive and Hazel Drive. As a result of these comments it was proposed to amend the Order to the extent that the single yellow lines in Glamis Drive and Hazel Drive be effective only from Monday to Friday.

 

The Order was duly advertised and seventeen objections were received. Four objections were later withdrawn.

 

The Committee agreed to make the Order despite the objections.

 

XIV AREA WASTE PLAN RECYCLING FACILITIES WITHIN DUNDEE

 

There was submitted Agenda Note AN272-2004 whereby it was noted that the finalised Dundee Local Plan Review outlined how the land use implications of the AWP would be addressed. It was reported that while incorporating a general policy for the provision of waste management facilities, it also recognised that further work was required by the Area Waste Group in order to formulate more specific planning policy guidance. Subsequent discussions had been undertaken with SEPA and the City Council's Waste Management Department in order to progress this matter. Following from these, there had been further discussion with SEPA which had resulted in agreed rewordings of the Local Plan which would provide a more detailed policy framework to address the Area Waste Plan requirements. These acknowledged the need to safeguard existing waste management sites and to identify sites for additional recycling infrastructure. They also incorporated the requirement for new housing and commercial developments to incorporate suitable recycling facilities. They also made provision for more information relating to the production of Supplementary Guidance to flesh out the plan's policy framework and thereby assist policy implementation in respect of these facilities.

 

Included in this, the Supplementary Guidance would specify the requirements for the provision of recycling facilities within new residential and commercial developments and the nature and standard of facilities to be provided. It would also provide criteria to guide the siting of new mini recycling points. The rewordings had been examined by the Reporter responsible for considering these matters at the recent Public Local Inquiry into the Finalised Dundee Local Plan Review. Following consideration of the Reporter's findings (yet to be received) the Committee would be recommended to approve the publication of Post Inquiry Modifications to the Local Plan in respect of these matters.

 

The assistance and advice of the Area Waste Group would be sought as appropriate in the course of developing the Supplementary Guidance. In addition, the City Council was represented on a Scottish Executive working group which was addressing matters associated with the implementation of the Area Waste Plan. It was expected that this would also provide important inputs to the implementation process.

 

The Committee noted the above.

XV SCOTTISH ROAD MAINTENANCE CONDITION SURVEY

 

There was submitted Agenda Note AN273-2004, whereby reference was made to Article XIV of the minute of meeting of this Committee of 29th April, 2002 when approval was given to participate in the Scottish Road Maintenance Condition Survey.

 

It was reported that the first year's survey had comprised a trial across Scotland and in Dundee only included the 'A' class roads and the second year of the survey had included all of the 'A' class roads but extended the survey to include a pre-determined proportion of the other road categories and therefore form a baseline Performance Indicator.

 

It was noted that the detailed results of the survey were currently being reviewed to assess the implications for future road maintenance and would also be used to assist in identifying areas for future maintenance and would act as benchmark for monitoring the ongoing condition of the road asset.

 

XVI BRINGING CONFIDENCE TO PUBLIC TRANSPORT - VICTORIA ROAD AND NETHERGATE GROUNDWORKS

 

There was submitted Agenda Note AN274-2004 whereby it was noted that as part of the Bringing Confidence to Public Transport (BCPT) scheme to improve public transport facilities within Dundee, two additional areas had been identified which would benefit from the provision of new high quality bus shelters for the travelling public. These would be in Victoria Road opposite the Wellgate Centre and in the Nethergate outside the Nethergate Centre.

 

It was proposed to construct the necessary foundations and groundworks at these locations, to follow on from the completion of the works currently on site in Crichton Street. The shelter erection programme would be due to commence following completion of the groundworks.

 

The Committee authorised the City Engineer to negotiate an extension to the existing contract with Land & Building Services, based on the competitive rates obtained in tender for the sum of 86,225.21 and approved an overall allowance of 105,000 including an allowance of 8,600 for professional fees and 10,174.79 contingencies.

 

XVII DUNDEE LOCAL PLAN REVIEW - PUBLIC LOCAL INQUIRY

 

There was submitted Agenda Note AN275-2004, advising the Committee that the review of the Dundee Local Plan was well on target for adoption early next year having completed a Public Local Inquiry (PLI) into objections to the Plan in early June.

 

It was reported that the Reporters would now consider the evidence placed before the Inquiry before issuing their findings, expected in December this year. The Council would then decide on possible modifications to the Plan as a result before moving to adopt it.

 

The Committee noted that the adoption of the Dundee Local Plan Review would complete the updating of the Development Plan for Dundee City, the Dundee and Angus Structure Plan having been approved by Scottish Ministers in October 2002, and clear the way for the commencement of preparation of a new Dundee City Region Plan in line with the Scottish Executive's review of the Planning System.

 

XVIII NATIONAL PLANNING FRAMEWORK FOR SCOTLAND

 

There was submitted Agenda Note AN276-2004 advising the Committee that the Scottish Executive had published the National Planning Framework for Scotland as part of the Review of Strategic Planning process. It supported a perceived need from that exercise for the provision of a 'National Context' for strategic planning and would provide guidance, along with Scottish Planning Policies (SPPs), for those areas that in future would be beyond the proposed 4 new 'City Region' areas.

 

The Committee noted the purpose of the Framework and the key issues and implications for the City.

The Committee approved the applications, subject to conditions agreed with the Director of Planning and Transportation.

 

It was further agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Rods (Sotland) Act 1984.

 

XX TENDERS RECEIVED BY CITY ENGINEER

 

There was submitted Report No 437-2004 by City Engineer tenders received in respect of Estuary Ambassador Routes (Greendykes Road/Broughty Ferry Road).

 

The Committee approved acceptance of the lowest offer, from T & N Gilmartin Limited, in the sum of 117,245.06, together with allowances amounting to 37,754.94 giving a total expenditure of 155,000.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XXI SUBJECTS ADJACENT TO LAWSIDE WORKS, PATERSON STREET, DUNDEE

 

There was submitted report No 447-2004 by the Director of Planning and Transportation advising of progress on the redevelopment of the former Lawside Works for new housing.

 

The Committee agreed to promote a Compulsory Purchase Order to acquire subjects adjacent to Lawside Works, Paterson Street, on the terms and conditions detailed in the report.

 

XXII PURCHASE OF PROPERTY AT 13 DURA STREET AND 53 ERSKINE STREET, STOBSWELL

 

There was submitted Agenda Note AN278-2004 relative to the proposed acquisition of properties at 13 Dura Street and 53 Erskine Street through the Vacant and Derelict Land Fund Programme, with a view to clearance of the site and its subsequent marketing.

 

The Committee approved the acquisition of the six flats at 13 Dura Street and the six flats and one shop at 53 Erskine Street and gave remit to the Depute Chief Executive (Support Services) to conclude the purchase of all of the above properties through the use of the Vacant and Derelict Land Fund, having noted that the actual cost of these acquisitions would be reported back to the Committee in due course.

 

XXIII SUBJECTS AT EAST DOCK STREET, DUNDEE

 

There was submitted Agenda Note AN279-2004 whereby reference was made to Article I of the minute of meeting of the Planning and Transportation Committee of 25th August 2003 agreeing to promote a Compulsory Purchase Order to acquire the subjects situated in the southwest corner of the development site at East Dock Street, Dundee subject to conditions agreed with the developer.

 

It was reported that the developer had requested that following the CPO, the subjects be conveyed to a wholly owned subsidiary of the developer instead of the developer itself.

 

The Committee approved this amendment to the terms of agreement.
