I DECLARATION OF INTEREST

II NEW ROADS - ROAD CONSTRUCTION CONSENTS
There was submitted Agenda Note AN5-2016, making reference to Article IV of the minute of meeting of the Policy and Resources Committee of 27th April, 2009, wherein the Committee delegated the grant of road construction consent to the Executive Director of City Development with the provision that any consents granted be reported to the City Development Committee as soon as practicable thereafter.
It was reported that the undernoted applications had been submitted and the Executive Director of City Development had approved the applications, subject to conditions which had been agreed with the applicants:-

III SITE PLANNING BRIEF - FORMER KINGSPARK SCHOOL
There was submitted Report No 11-2016 detailing amendment proposed to the abovementioned Site Planning Brief following issues raised by residents.
The Committee acceded to a request for a deputation to address the Committee relative to the above item. After the deputation had stated its case and answered questions from members of the Committee it was thanked for its attendance and withdrew.
Thereafter, the Convener, seconded by Councillor Campbell, moved approval of the recommendation that the Committee amend the open space to an east west orientation and remit the Executive Director of City Development to redraft the Brief to reflect this change and ensure access for maintenance, the retention of trees to the east, and the overlooking of open space by new housing.
As an amendment, Councillor Keenan, seconded by Bailie Borthwick, moved that the report be not approved pending further consultation.
On a division, there voted for the motion - the Convener, Lord Provost Duncan, Depute Lord Provost Roberts, Bailie Sawers, and Councillors Guild, Alexander, Black, Bowes, Campbell, Cordell, Hunter, Lynn, McDonald, Murray and Ross (15); and for the amendment - Bailies Wright, Borthwick and Scott, and Councillors Keenan, Asif, Bidwell, Brennan, Cruickshank, Ferguson, Gordon, McCready, McGowan and Macpherson (13) - whereupon the motion was declared carried.
IV DUNDEE LOCAL DEVELOPMENT PLAN - NON-STATUTORY PLANNING GUIDANCE - THE DUNDEE GREEN NETWORK
There was submitted Report No 13-2016 by the Executive Director of City Development summarising the representations received to the proposed non-statutory planning guidance on the Dundee Green Network from the period of public consultation, and seeking approval of the proposed modifications to the planning guidance in response to the representations.
The Committee agreed:-
(a) to note the summary of the issues raised in the representations received to the proposed non-statutory planning guidance and the response to these by the Council, and to approve the proposed modifications as set out in Appendix 1;
(b) to the adoption of the non-statutory planning guidance; and
(c) that the City Development Department work in partnership with Neighbourhood Services to ensure that the non-statutory planning guidance was kept up-to-date.
V BRIDGEVIEW STATION CAFE, RIVERSIDE DRIVE (VARIATION OF WAITING RESTRICTIONS) ORDER 2016
There was submitted Report No 12-2016 by the Executive Director of City Development relative to a request for alterations to waiting restrictions on a section of Riverside Drive at Bridgeview Station Cafe to preserve and improve local amenities including local businesses and the viewpoint location, and to create a turnover of parking to promote this viewpoint as a tourism attraction.
The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Order for Dundee.
VI DUNSINANE AVENUE, DUNDEE - STOPPING-UP ORDER
There was submitted Report No 10-2016 by the Executive Director of City Development relative to a proposal to stop-up and remove from the List of Public Roads a length of carriageway and associated parking areas in the Dunsinane Avenue area utilising the powers of the Town and Country Planning (Scotland) Act 1997.
The Committee approved the preparation of a Stopping-Up Order to stop-up and remove from the List of Public Roads a section of carriageway and associated parking areas in the Dunsinane Avenue area, Dundee, as detailed in the report.
VII NEW MENZIESHILL PRIMARY AND NURSERY SCHOOLS
There was submitted Report No 392-2015 by the Executive Director of City Development advising of the procurement and tendering process utilised for the new Menzieshill Primary and Nursery Schools and seeking a decision on the acceptance of the tender price and allowances.
The Committee approved the acceptance of the tender price submitted by Wilmott Dixon Construction Ltd in the amount of 11,136,900, together with allowances amounting to 2,115,000, giving a total cost of 13,251,900.
VIII TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY
There was submitted Report No 1-2016 by the Head of Design and Property detailing tenders received in respect of the undernoted projects:-
(a) RIVERSIDE RECYCLING CENTRE - REED BID SYSTEM
The Committee agreed to accept an offer from Tayside Contracts in the sum of 324,484.20, to which required to be added allowances amounting to 81,515.20, giving a total of 401,000.
(b) KIRKTON NEIGHBOURHOOD CENTRE - REFURBISHMENT OF ANDY IRELAND LOUNGE
The Committee agreed to accept an offer from the Environment Department (Construction Services) in the sum of 117,925.98, to which required to be added allowances amounting to 18,043, giving a total of 135,968.98.
(c) VARIOUS PROPERTIES - SERVICING AND MAINTENANCE OF MULTI-STOREY TANK AND PUMP SYSTEMS
The Committee agreed to accept the lower offer from Scan Building Services in the sum of 49,007.50, to which required to be added allowances amounting to 7,000, giving a total of 56,007.50.
(d) REGIONAL PERFORMANCE CENTRE FOR SPORT - ENABLING WORKS CONTRACT
The Committee agreed to accept an offer from Tayside Contracts in the sum of 612,222.69, to which required to be added allowances amounting to 228,637.72 giving a total of 840,860.41.
IX SUPPLY OF PLANT AND VEHICLES 2015/2016
There was submitted Report No 20-2016 by the Executive Director of City Development seeking approval for the purchase of plant and vehicles required by Dundee City Council to ensure ongoing operational efficiency and to support the delivery of front-line services.
The Committee approved the purchase of the vehicles listed in Appendix 1 to the report, at a total cost of 214,157.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
X SITE ON THE LAW, DUNDEE
There was submitted Agenda Note AN6-2016 relative to an area of ground at the top of the Law leased to the Scottish Police Authority (as statutory successor to Tayside Joint Police Board) until 27th July, 2020, and used for the erection and operation of a mast to accommodate transmitting and radio signals.
Under the terms of the aforementioned lease, the consent of Dundee City Council is required to approve any new site sharing arrangements.
It was reported that the Police Authority had sought approval for site sharing with two companies in this connection, and this request was approved by the Executive Director of City Development in view of the timescales involved, in consultation with the Convener, Labour Group Spokesperson, Bailie Borthwick, Bailie Scott and Councillor Macpherson, on the terms and conditions detailed in the note.
The Committee noted accordingly.
XI 102 FOUNDRY LANE AND ADJACENT GROUND DUNDEE
There was submitted Agenda Note AN7-2016, making reference to Article X of the minute of meeting of this Committee of 27th October, 2014, wherein the Committee granted approval to renew the leases of the above subjects with the Trustees of Cats Protection for a five year period from 28th November, 2014 to 27th November, 2019.
It was reported that the Cats Protection sought consent from the Council to extend the lease term in order that it could benefit from making significant remedial works.
It was reported for the information of members that the foregoing was approved by the Executive Director of City Development in view of the timescales involved, in consultation with the Convener, Labour Group Spokesperson, Bailie Borthwick, Bailie Scott and Councillor Macpherson, on the terms and conditions detailed in the note.
The Committee noted accordingly.

XIII PROPOSED COMPULSORY PURCHASE OF LAND AT COUPAR ANGUS ROAD, DUNDEE AND SUBSEQUENT SALE
There was submitted Report No 21-2016 by the Executive Director of City Development seeking approval to promote a Compulsory Purchase Order in respect of land at Coupar Angus Road, Dundee and its subsequent proposed sale.
The Committee remitted to the Head of Democratic and Legal Services to promote a Compulsory Purchase Order in respect of the 0.033 ha site, to, and, subject to successfully completion of the proposed Compulsory Purchase Order, the Committee approved the subsequent sale of the 0.17 ha or thereby as detailed in the report.
XIV PROPOSED SALE OF LAND AT 91 KINGHORNE COURT, DUNDEE
There was submitted Report No 2-2016 by the Executive Director of City Development seeking approval for the sale of land to the south of 91 Kinghorne Court, Dundee.
The Committee approved the proposed sale of land extending to 0.0017 ha or thereby on the terms and conditions detailed in the report.
XV PROPOSED SALE OF LAND AT 5 SIDLAW AVENUE, DUNDEE
There was submitted Report No 3-2016 by the Executive Director of City Development seeking approval for the sale of land to the east of 5 Sidlaw Avenue, Dundee.
The Committee approved the proposed sale of land extending to 0.0044 ha or thereby on the terms and conditions detailed in the report.
XVI PROPOSED DEVELOPMENT OF SITE 6, DUNDEE CENTRAL WATERFRONT
There was submitted Report No 17-2016 by the Executive Director of City Development seeking approval to appoint a preferred development partner for a mixed use development of Site 6 at Dundee Central Waterfront and to subsequently proceed with negotiations on the terms for a Development Agreement.
The Committee approved the appointment of the recommended preferred development partner for Site 6 at Dundee Central Waterfront and authorised officers to enter into detailed negotiations on the proposed detailed terms for a Development Agreement under the SCAPE framework and report these back to Committee for final approval as detailed in the report.
XVII PROPOSED DEVELOPMENT OF SITES 2 AND 5, DUNDEE CENTRAL WATERFRONT
There was submitted Report No 18-2016 by the Executive Director of City Development seeking approval to appoint a preferred development partner for a mixed use development of Site 2 and part of Site 5 at Dundee Central Waterfront and to subsequently proceed with negotiations on the terms for a Development Agreement.
