I DECLARATIONS OF INTEREST

 

Councillors Bidwell, Murray, Lynn and McDonald declared non-financial interests in relation to Article VII (Commercial Lease at 152 Nethergate) by virtue of their Council appointment as Directors of Dundee Contemporary Arts.

 

II NEW ROADS - ROADS CONSTRUCTION CONSENTS

 

There was submitted Agenda Note AN241-2014, making reference to Article IV of the minute of meeting of the Policy and Resources Committee of 27th April, 2009, wherein the Committee delegated the grant of road construction consent to the Director of City Development with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.

 

It was reported that the undernoted applications had been submitted and the Director of City Development had approved the applications, subject to conditions which had been agreed with the applicants:-

III PROTECTED FOOD NAME - DUNDEE CAKE

 

There was submitted Agenda Note AN247-2014, advising the Committee that Dundee's Baker Trade, supported by Dundee City Council, had submitted their application for Dundee Cake to be registered under the EC Protected Food Name (PFN) Scheme under the Protection of Geographical Indication (PGI) designation. Parties who wished to comment/object were required to state their intention to do so within four weeks of the launch which took place the previous week. They would then have a further eight weeks to complete details of their comments/objections. The full process for approval could take up to two years to complete.

 

The Committee agreed that Dundee City Council submit a comment supporting the application for protected status.

 

IV CRAIGOWL ROAD, DUNDEE - STOPPING-UP ORDER

 

There was submitted Report No 409-2014 relative to the proposal to stop-up and remove from the list of public roads a section of carriageway on Craigowl Road utilising the powers of the Town and Country Planning (Scotland) Act 1997.

 

The Committee approved the preparation of a Stopping-Up Order to stop-up a short section of carriageway on Craigowl Road in order to facilitate a new development which altered the perimeter fence line following planning consent.

 

V 28 ROSEANGLE - PROPOSED REPAIRS NOTICE UNDER SECTION 43 OF THE PLANNING (LISTED BUILDING AND CONSERVATION AREAS)(SCOTLAND) ACT 1997

 

It was reported that a request had been received for a deputation to address the Committee in relation to this item of business.

 

After the deputation had stated their case, they were thanked for their attendance and withdrew.

 

Thereafter, there was submitted Report No 413-2014, seeking Committee approval to serve a Repairs Notice under Section 43 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 on the owner of the property at 28 Roseangle, Dundee.

 

The Committee approved the serving of a Repairs Notice under Section 43 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 as detailed in Appendix 1 of the Report; together with the Schedule of Works outlined within the Repairs Notice.

 

VI TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 377-2014 by the City Architect detailing tenders received in respect of the undernoted projects.

 

(a) LOGIE AVENUE DEPOT - ALTERATION WORKS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 452,832.19, to which required to be added allowances amounting to 88,283, giving a total of 541,115.19.

 

(b) NEW OLYMPIA POOL - OPERATIONAL ENHANCEMENT WORKS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 59,838.15, to which required to be added allowances amounting to 20,155, giving a total of 79,993.15.

 

(c) CAIRD HALL - REFURBISHMENT OF FIRST FLOOR TOILETS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 85,317.95, to which required to be added allowances amounting to 24,054, giving a total of 109,371.95.

 

(d) ARDLER COMMUNITY CENTRE - UPGRADE FIRST FLOOR TOILETS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 25,432.79, to which required to be added allowances amounting to 5,892, giving a total of 31,324.79.

 

(e) ARDLER COMMUNITY CENTRE - SMALL HALL LIGHTING

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 7,151.53, to which required to be added allowances amounting to 1,094, giving a total of 8,245.53.

 

(f) KIRKTON COMMUNITY CENTRE - WINDOWS AND CURTAIN WALLING REPLACEMENT

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 43,190.02, to which required to be added allowances amounting to 6,609, giving a total of 49,799.02.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

There was submitted Agenda Note AN212-2014 relative to a request to change the use class at the above premises.

 

It was reported for information that the foregoing was approved by the Director of City Development in view of the timescales involved, in consultation with the Convener, Labour Group Spokesperson, Bailie Borthwick, Bailie Scott and Councillor Macpherson.

 

The Committee noted accordingly.

 

X ASDA STORES LTD - GROUND AT MAGDALENES KIRKTON, DUNDEE

 

There was submitted Agenda Notice AN243-2014 relative to a request for permission to undertake alterations to the existing gates and service yard area at the subjects in order that double-decker vehicles could undertake deliveries to the site.

 

It was reported, for information, that the foregoing was approved by the Director of City Development in view of the timescales involved, in consultation with the Convener, Labour Group Spokesperson, Bailie Borthwick, Bailie Scott and Councillor Macpherson, on the terms and conditions detailed in the note.
