The minute of meeting of this Committee of 25th August, 2014 was held as read.

I DECLARATION OF INTEREST

 

The Convener declared a non-financial interest in Item VI by virtue of being employed by Scottish and Southern Energy.

 

II PUBLIC CONSULTATION OF CONSERVATION AREA APPRAISALS

 

There was submitted Agenda Note AN212-2014 advising that four Draft Conservation Area Appraisals had been undertaken, and that the Director of City Development sought the remit to consult with the local community and interested parties on the content of the appraisals, thereafter reporting back with the results of the consultation process.

 

The areas that had been reviewed were Maryfield Conservation Area, West End Lanes Conservation Area, West End Suburbs Conservation Area and Logie Conservation Area.

 

As part of the appraisal, a number of minor boundary amendments had been proposed within the Maryfield Conservation Area and the West End Suburbs Conservation Area. The amendments would be subject to public consultation prior to reporting back to the City Development Committee for approval.

 

The Convener, seconded by Councillor Guild, moved approval of the proposal to note the above and remit the Director of City Development to undertake consultation and report back to the Committee.

 

As an amendment, Councillor Macpherson, seconded by Bailie Scott, moved that the item be deferred.

 

On a division, there voted for the motion - the Convener, Lord Provost Duncan, Depute Lord Provost Roberts, Bailie Sawers and Councillors Guild, Alexander, Black, Bowes, Campbell, Cordell, Hunter, Lynn, McDonald, Melville, Murray and Ross (16); and for the amendment - Bailies Wright, Borthwick and Scott and Councillors Keenan, Asif, Bidwell, Cruickshank, Ferguson, Gordon, McGovern and Macpherson (11) - whereupon the motion was declared carried.

 

III CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - STREET NAMES - SITE NORTH OF DRUMGEITH ROAD AND WEST OF SUMMERFIELD AVENUE

 

There was submitted Agenda Note AN213-2014, advising that a consultation had been carried out for the extension of existing/new street names at the site north of Drumgeith Road and west of Summerfield Avenue.

 

Two responses were received from the City Archivist and The Whitfield Development Group who were both in agreement to continue with the existing theme of "Ayrshire towns" in the area.

 

After consideration, Committee approved the following:-

 

(i) the extension of existing street names at Strathaven Terrace, Kilbride Place and Kilwinning Place;

 

(ii) the reinstatement of Fenwick Place; and

 

(iii) the new street names of Summerfield Court and Kilwinning Row.

 

IV WINTER MAINTENANCE POLICY AND LEVEL OF SERVICE 2014/2015

 

There was submitted Agenda Note AN215-2014, making reference to Article VII of the minute of meeting of this Committee of 24th September, 2012, wherein following the severe winter of 2010/2011 and detailed reviews with all stakeholders, improvements to the policy and level of service for winter 2012/2013 were approved. This improvement policy and level of service was adopted for 2013/2014 and it was recommended that it be adopted again for 2014/2015.

 

The Committee approved accordingly.

 

V RESPONSE TO TRANSPORT SCOTLAND CONSULTATION ON BUS SERVICE REGISTRATIONS

 

There was submitted Report No 335-2014, by the Director of City Development seeking approval to respond to the current consultation on bus service registrations being undertaken by Transport Scotland.

 

The Committee approved the response set out in Appendix 1 to the report and authorised officers to submit it on behalf of Dundee City Council.

 

VI STATUTORY UNDERTAKERS REINSTATEMENT PERFORMANCE IN DUNDEE

 

There was submitted Report No 1-2014 by the Director of City Development, giving a summary of the performance of Statutory Undertakers operating in Dundee during 2012/2013 based on inspections and coring of their reinstatements under the New Roads and Streets Works Act 1991 (NRSWA), and updating the Committee on the status of the Transport (Scotland) Act 2005, Part 2 - Road Works.

 

The Committee agreed to:-

 

(i) note the performance of Statutory Undertakers reinstatements in Dundee based on the visual sample inspection regime and the national coring results for the last year;

 

(ii) approve the continuation of the annual local coring programme and participation in the Biannual National Coring Programme; and

 

(iii) note the status of the Transport (Scotland) Act, 2005, Part 2 - Road Works, different parts of which came into force on 1st April, 2008 and 1st October, 2008.

 

VII LOCHEE HIGH STREET (VARIATION TO WAITING RESTRICTIONS) ORDER 2014

 

There was submitted Report No 284-2014 by the Director of City Development relative to a request for alterations to waiting restrictions on High Street, Lochee due to the ongoing regeneration of the town centre.

 

The Committee approved the preparation of a Traffic Regulation Variation Order:-

 

(a) to effect the changes to the waiting restrictions in the Dundee City Council (North‑Western Area, Dundee) (Waiting and Loading Restrictions) Order 2010;

 

(b) to effect the changes to the waiting restrictions in the Dundee City Council (Taxi Rank Clearways) Order 2007; and

 

(c) to effect the changes to the waiting restrictions in the Dundee City Council (Disabled Persons' Parking Places) (On-Street) Order 2011.

 

VIII DUNDEE LOCAL DEVELOPMENT PLAN SUPPLEMENTARY GUIDANCE ON DEVELOPER CONTRIBUTIONS

 

There was submitted Report No 329-2014 by the Director of City Development summarising the representations received to the proposed Supplementary Guidance on Developer Contributions from the period of public consultation, and seeking approval of proposed modifications to the wording of the guidance in response to the representations.

 

The Committee agreed to:-

 

(a) note the summary of the issues raised in the representations received to the proposed Supplementary Guidance, the response to these by the Council, and approve the proposed modifications as set out in Appendix 1 to the report;

 

(b) the adoption of the Supplementary Guidance following completion of the required pre‑adoption procedures; and

 

(c) remit the Director of City Development to submit a copy of the proposed Supplementary Guidance to Scottish Ministers, together with the relevant statements as required by the Town and Country Planning (Development Planning) (Scotland) Regulations, 1998, and the summary of the issues raised in the representations received to the proposed Supplementary Guidance and the response to these by the Council.

 

IX DUNDEE LOCAL DEVELOPMENT PLAN - SUPPLEMENTARY GUIDANCE ON AIR QUALITY CONTROL AND LAND USE PLANNING

 

There was submitted Report No 332-2014 by the Director of City Development summarising the representations received to the proposed Supplementary Guidance on Air Quality Land Use Planning from the period of public consultation and seeking approval of the proposed modifications to the wording of the guidance in response to the representations.

 

The Committee agreed to:-

 

(a) note the summary of the issues raised in the representations received to the proposed Supplementary Guidance and the response to these by the Council, and approve the proposed modifications as set out in Appendix 1;

 

(b) the adoption of the Supplementary Guidance following completion of the required pre‑adoption procedures; and

 

(c) remit the Director of City Development to submit a copy of the proposed Supplementary Guidance to Scottish Ministers, together with the relevant statements as required by the Town and Country (Development Planning) (Scotland) Regulations 2008.

 

X TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 323-2014 detailing tenders received in respect of the undernoted projects:-

 

(a) CRAIGIE HIGH SCHOOL - HOME ECONOMICS CLASSROOM UPGRADE

 

The Committee accepted a negotiated contract with the Environment Department (Construction Services) in the sum of 45,184.81, to which required to be added allowances, amounting to 6,913 giving a total expenditure of 52,097.81.

 

(b) CAIRD PARK WORKSHOPS - ALTERATION WORKS

 

The Committee accepted a negotiated contract with the Environment Department (Construction Services) in the sum of 309,793.93, to which required to be added allowances amounting to 82,455, giving a total expenditure of 392,248.93.

 

(c) CHRISTMAS LIGHTS 2014 - ERECTION OF TREE, LIGHTS AND DECORATIONS

 

The Committee accepted a negotiated contract with the Environment Department (Construction Services) in the sum of 159,439.78, to which required to be added allowances amounting to 4,000, giving a total expenditure of 163,439.78.

 

(d) ST JOHNS HIGH SCHOOL - CONVERSION OF SCIENCE LAB INTO NEW HOME ECONOMICS CLASSROOM

 

The Committee accepted a negotiated contract with the Environment Department (Construction Services) in the sum of 80,000, to which required to be added allowances amounting to 12,240, giving a total expenditure of 92,240.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XI COMMERCIAL LEASES AND RENT REVIEWS

 

There was submitted Report No 330-2014 detailing commercial leases and rent reviews.

 

The Committee noted commercial leases in respect of the undernoted properties:-

Unit 1, Marybank Lane, Dundee

 

It approved rent reviews in respect of the following properties:-

 

291 Hilltown, Dundee

86 Ballindean Road, Dundee
