I REVIEW AND UPDATE OF SITE PLANNING BRIEFS
There was submitted Report No 593-2005 by Director of Planning and Transportation advising the Committee of the Site Planning Briefs that remain valid as material considerations in making planning decisions.
The Committee noted the current status of the Site Planning Briefs as listed in the Appendices to the Report, and their relevance as material considerations in dealing with planning applications for the sites as appropriate.
II SCOTTISH PLANNING POLICY 21- GREEN BELT - CONSULTATION DRAFT
There was submitted Report No 628-2005 by Director of Planning and Transportation advising the Committee of the comments proposed to be forwarded to the Scottish Executive in relation to the proposed Scottish Planning Policy 21: Green Belts: Consultation Draft, and seeking approval of provisional representations submitted to the Scottish Executive by the Director of Planning and Transportation on behalf of Dundee City Council.
The Committee agreed to:-
(i) note that formal representations were invited by the Scottish Executive by 28 October 2005 and that a provisional response had been issued to meet the consultation deadline.
(ii) approve the formal representations made by the Director of Planning and Transportation, in consultation with the Convener of the Planning and Transportation Committee in relation to Scottish Planning Policy 21 - Green Belts: Consultation Draft.
(iii) note that the advent of City Region Planning, Green Belt policy may be an option to prevent uncontrolled development in Dundee's housing market area.
III PITALPIN VILLAGE SITE PLANNING BRIEF - CPO
There was submitted Agenda Note AN398-2005 whereby reference was made to Article VI of the minute of meeting of this Committee of 26 April 2004 when the above Site Planning Brief was approved as guidance for the comprehensive development of the area around Pitalpin Works. The various landowners have appointed an architect and an outline planning application has been submitted to the Council for the majority of the site. Regular meetings have been held with the various developers and their architect and Draft Heads of Agreement agreed. In progressing the proposals an issue has emerged regarding the ownership of one small pocket of land, 51.7 sq m in area on the south side of Donald's Lane. Whilst searches have been carried out it has not been possible to identify the owner of this site. As such it is appropriate that a Compulsory Purchase Order be promoted in order to purify the title of this piece of ground to enable the proper development of this area in terms of the approved terms of the approved Site Planning Brief. Dundee City Council would seek to recover the costs incurred from the developers.
The Committee agreed to remit the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to promote a Compulsory Purchase Order for the sites identified.
IV INVERGOWRIE DRIVE - PROPOSED WAITING RESTRICTIONS
There was submitted Report No 598-2005 by Director of Planning and Transportation advising the Committee of the effects of introducing waiting restrictions in Invergowrie Drive.
The Committee approved the preparation of a Traffic Regulation Order to introduce waiting restrictions in Invergowrie Drive.
V OLYMPIA LEISURE CENTRE - TRAFFIC WORKS
There was submitted Agenda Note AN431-2005 advising that the Leisure and Communities Department had expressed concern about the volume and speed of traffic using the service road at Earl Grey Place near the ground floor access to the Olympia Leisure Centre. As part of their commitment to customer safety, the Leisure and Communities Department requested a scheme be promoted to improve road safety. Proposals included improved signage, road marking, pedestrian barrier and the introduction of road cushions to reduce vehicle speeds. The scheme would be financed by Leisure and Communities Department and approval was obtained by Leisure and Arts Committee on 22 August 2005. The Road Humps (Scotland) Act 1998, in terms of the Road (Scotland) Act 1984, requires formal consultation to be carried out.
The Committee agreed to approve the traffic calming proposals and allow consultation to proceed.
VI TRAFFIC ORDERS ETC
There was submitted Agenda Note AN432-2005 detailing the undernoted traffic orders:-
(a) DUNDEE CITY COUNCIL (A92 DUNDEE - ARBROATH ROAD AT CLAYPOTTS)
(PROHIBITION OF LEFT-HAND) ORDER 2005
Reference was made to Article IV of the minute of meeting of this Committee of 18th April 2005 instructing and authorising the preparation of an Order to improve safety by preventing left turning vehicles from impeding the main flow of traffic on the dual carriageway.
The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Order was duly advertised and one objection was received. Copy correspondence had been placed in the Members' Lounge with Group Secretaries.
The Committee agreed to make the Order despite the objection.
(b) DUNDEE CITY COUNCIL (MENZIESHILL CONTROLLED PARKING ZONE AND DICKSON AVENUE AREA, DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2005
Reference was made to Article IV of the minute of meeting of this Committee of 24th May 2004 instructing and authorising the preparation of an Order to (1) create more visitor and overnight parking in Charleston Drive, (2) adjust the balance of residents and visitor parking in Dickson Avenue and Spey Dive to cater for the respective demands, (3) include Deveron Terrace and Deveron Crescent within the Controlled Parking Zone, (4) cater for long-term visitors to residents by introducing a scheme whereby a parking voucher can be purchased to allow use of the "permit holders only" spaces, (5) create a passing place in Earn Crescent, (6) relieve congestion in Dickson Avenue and (7) afford protection for proposed pedestrian refuges in Charleston Drive and Dickson Avenue.
The proposed Order was duly drafted and during the statutory consultation period, one objection was received. As a result of the objection, the Order was amended to include Deveron Crescent and Terrace as streets which qualify for the issue of a resident's permit, and the deletion of the proposed restrictions for these streets prior to the Order being advertised.
The Order was duly advertised and there were no objections.
The Committee agreed to make the Order as advertised.
(c) DUNDEE CITY COUNCIL (WEST BELL STREET MULTI-STOREY CAR PARK, DUNDEE) (VARIATION OF REGULATIONS) ORDER 2005
Reference is made to Article II of the minute of meeting of this Committee of 11 July 2005 instructing and authorising the preparation of an Order to be to re-introduce a mid range parking tariff to West Bell Street Multi Storey Car Park. The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received. The Order was duly advertised and there were no objections. The Committee is therefore requested to make the Order as advertised.
VII TENDERS RECEIVED BY CITY ENGINEER
There was submitted Report No 644-2005 by Director of Planning and Transportation giving details of offers received for the undernoted contract:-
(i) ERSKINE STREET YARD - DEMOLITION
The Committee agreed to accept the lowest offer by Dundee Plant Company amounting to 75,744.00 which required to be added an allowance of 31,000.00 making a total for expenditure of 106,444.00.
