I SCOTTISH EXECUTIVE CONSULTATION ON PROPOSED ENVIRONMENTAL ASSESSMENT (SCOTLAND) BILL

 

There was submitted Joint Report No 725-2004 by the Assistant Chief Executive (Community Planning) and the Director of Planning and Transportation outlining the proposals from the Scottish Executive on the introduction of the Environmental Assessment (Scotland) Bill and setting out the draft response submitted by Dundee City Council to meet the October consultation deadline.

 

The Committee agreed to:-

 

(a)endorse the draft response to the consultation paper; and

 

(b)remit the Assistant Chief Executive (Community Planning) to submit the approved response to the Scottish Executive on behalf of Dundee City Council.

 

IICONSULTATION ON ROAD USER CHARGING REGULATIONS - PENALTY CHARGES - LIABILITY OF CHARGES - KEEPING OF ACCOUNTS

 

There was submitted Report No 757-2004 by the Director of Planning and Transportation informing the Committee of Scottish Executive consultation on Regulations relating to Road User Charging.

 

The Committee agreed to note the terms of the report subject to the deletion of the word "presently" in paragraph 2.1(b) and the deletion of all of paragraph 2.1(c).

 

III ARDLER REDEVELOPMENT - STOPPING-UP

 

There was submitted Report No 694-2004 by the Director of Planning and Transportation recommending the preparation of Stopping-Up Orders for the roads and footpaths in the Ardler area affected by the continuing redevelopment of the Ardler Housing Estate.

 

The Committee approved the preparation of Orders to stop-up lengths of road and footpaths affected by the redevelopment of Ardler Housing Estate and to delete them from the List of Public Roads where applicable, as detailed in the report.

IV ALEXANDER STREET - STOPPING-UP

 

There was submitted Report No 677-2004 by the Director of Planning and Transportation advising the Committee that in order to improve the environment and remove a redundant length of road permission had been sought to stop-up that superseded length of Alexander Street between Hillbank Road and Dens Road.

 

The Committee approved the preparation of an Order under the powers of the Roads (Scotland) Act 1984 to stop-up that length of road.

 

V DUNDEE - ARBROATH ROAD LAYBY AT BALMOSSIE - STOPPING-UP

 

There was submitted Report No 676-2004 by the Director of Planning and Transportation advising the Committee that in order to facilitate an adjacent development it would be necessary to stop-up a length of the layby adjacent to the south side of the Dundee - Arbroath Road at Balmossie.

 

The Committee approved the preparation of an Order under the powers of the Town and Country (Planning) (Scotland) Act 1997 to stop-up that length of the layby.

 

VI DONS ROAD AND ROSEBANK ROAD - STOPPING-UP

 

There was submitted Report No 675-2004 by the Director of Planning and Transportation advising the Committee that in order to facilitate an adjacent development it would be necessary to stop-up part of the carriageway and footway of Dons Road and Rosebank Road.

 

The Committee approved the preparation of an Order under the powers of the Town and Country (Planning) (Scotland) Act 1997 to stop-up part of the carriageway and footway of Dons Road and Rosebank Road and to delete them from the List of Public Roads.

 

VII DUNDEE CITY COUNCIL (DERWENT AVENUE, DUNDEE) (STOPPING-UP) ORDER 2005

 

There was submitted Agenda Note AN431-2004 whereby reference was made to Article VII of the minute of meeting of this Committee of 28th June 2004 wherein it was agreed to stop-up sections of road and footpath at Derwent Avenue, Dundee which would become unnecessary following the construction of the extended Keswick Terrace.

 

It was reported that the Order had been duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette and the relevant statutory undertakers consulted and no objections were received.

 

The Committee therefore agreed to authorise and confirm the Stopping-Up Order and authorised formal publication of the confirmation after which the Order would become operative.

 

VIIIDUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2005

 

There was submitted Agenda Note AN432-2004 whereby reference was made to Article VI of the minute of meeting of this Committee of 24th May 2004 instructing and authorising the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

It was reported that the proposed Order had been duly drafted and during the statutory consultation period no adverse comments were received.

 

The Committee therefore agreed to authorise publication of the Order.

 

IX PROPOSED COMPULSORY PURCHASE OF 28/30 NELSON STREET AND 85/89 ANN STREET

 

There was submitted Report No 603-2004 by the Director of Planning and Transportation seeking approval to pursue redevelopment, if necessary, by compulsory purchase of property at 28 and 30 Nelson Street and 85 to 89 Ann Street for housing.

 

The Committee agreed to authorise the Depute Chief Executive (Support Services) to commence the preparation of a Compulsory Purchase Order to acquire all interests at 28 and 30 Nelson Street and 85 to 89 Ann Street.

 

X VACANT AND DERELICT LAND FUND 2004/2005

 

There was submitted Agenda Note AN433-2004 advising the Committee that in August 2004 the Scottish Executive had confirmed a grant of 4m (2m for 2004/2005 and 2m for 2005/2006) to help deal with vacant and derelict land and property in Dundee.

 

The Committee noted that the projects included in the Schedule for 2004/2005 included:-

 

(a)peripheral locations - landscaping and remedial works in the Dighty Valley at Baldovie (including development of a BMX track) and Midmill; Longhaugh Quarry; Whitfield and Trottick; and

 

(b)inner city locations - acquisition of derelict property and demolitions by the Council and assistance with demolition by others in the Stobswell and Hilltown areas to remove dereliction and to facilitate development; and roadworks in Stobswell to facilitate development of a vacant site.

 

XI TENDERS RECEIVED BY THE CITY ENGINEER

 

There was submitted Report No 767-2004 by the City Engineer detailing tenders received and requesting a decision on acceptance thereof.

 

The Committee agreed to accept the negotiated offer of 408,296.41 from Dundee Contract Services, to which required to be added allowances amounting to 111,703.59, giving a total of 520,000.
