The Licensing (Scotland) Act 2005

Under the new Licensing (Scotland) Act 2005, each council must establish a Local Licensing Forum for their area.  The Act is detailed below, however, here is a quick summary of some of the main points.

  • The Forums must meet at least 4 times and have one joint meeting with the Board each year
  • A Forum is to consist of between 5 and 20 members
  • At least one of the members must be a Licensing Standards Officer for the council's area
  • The other members are to be representative of the 5 key interest areas which are:
    • holders of premises licenses and personal licences (licensees)
    • the chief constable for the police area in which the Forum is situated
    • persons having functions relating to health, education or social work
    • young people
    • persons resident within the Forum's area
