Licensing
Processing Timescales
(Licences under the Civic Government (Scotland) Act 1982)
If there are no objections, representations or any other adverse comments in relation to your application, and the terms of your application are within any relevant policies of the Licensing Committee, your application will be determined under delegated powers and is likely to be granted after the 21 day period for objections has expired. Please note that this does not apply to applications for Licences for Houses in Multiple Occupation which are all considered at a meeting of the full Committee.
Processing Timescales - Other Licences
(Other Licences dealt with by the Licensing Committee)
Your application will require to be considered at a meeting of the full Committee. This will generally be the first meeting of the Committee after the expiry of the 21 day period for objections. This will be the case even where there are no objections, representations or other adverse comments in relation to the application.
Tacit Consent (1982 Act)
Yes, tacit consent applies to this application. If the Licensing Committee fail to make a final decision upon the application within 6 months (or 12 months if the licence applied for is for a house in multiple occupation) of the date of the lodging of the application, then the licence is automatically granted for a period of 1 year.
Liquor Licence Applications - Operating Plan
New applications must be accompanied by an operating plan. The application form for a new application and operating plan can be found in the Forms Section. Care should be taken when completing the plan as once approved changes to it can only be made by way of variation, or in the case of major changes, a new application.
The operating plan should also take account of the Board's policies.
Tacit Consent (1982 Act) Not Required
No. It is in the public interest that the Council must process your application before it can be granted. If you have not heard from us within a reasonable period, please contact us using the contact details below.
Houses in Multiple Occupation Licence
The Private Sector Services Unit deals with applications for Houses in Multiple Occupation (HMOs).
