There was submitted Agenda Note AN12-2021 where reference was made to Article VI of the minute of meeting of the Policy and Resources Committee of 27th April, 2009 delegating the grant of road construction consents to the Executive Director of City Development with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.

IV FLOOD RISK MANAGEMENT (SCOTLAND) ACT 2009 CYCLE 1 UPDATE AND CYCLE 2 CONSULTATION

 

On a reference to Article XIV of the minute of meeting of this Committee of 23rd February 2015 and Article VI of the minute of meeting of this Committee of 28th March 2016, there was submitted Report No 138-2021 by the Executive Director of City Development updating Committee on the status of ongoing actions contained in the 2016 Tay Estuary and Montrose Basin (TEAMB) Local Flood Risk Management Plan (Cycle 1, 2016-2022) and advising of the progress towards the Flood Risk Management Cycle 2 production of SEPAs 2021 TEAMB Flood Risk Management Strategy (2021-2027) and the 2022 TEAMB Local Flood Risk Management Plan (2022-2028) to be delivered in fulfilment of the requirements of the Flood Risk Management (Scotland) Act 2009.

 

The Committee:

 

(i)                            noted the progress being made towards the Cycle 1 actions for the Tay Estuary and Montrose Basin Local Plan District covering the Dundee City Council area;

 

(ii)                           noted the progress being made towards production of the Cycle 2 Flood Risk Management Strategy and Local Flood Risk Management Plan for the Tay Estuary and Montrose Basin Local Plan District; and

 

(iii)                          approved the draft actions proposed for the Cycle 2 Tay Estuary and Montrose Basin Flood Risk Management Strategy and Local Flood Risk Management Plan which related to the two Objective Target Areas (OTAs) within the Dundee City Council area and which were programmed to be published for consultation in the summer of 2021.

 

V BROUGHTY FERRY FLOOD PROTECTION (TRAFFIC MANAGEMENT SCHEME) ORDER 2021

 

On a reference to Article X of the minute of meeting of this Committee of 10th September 2018 there was submitted Report No 139-2021 by the Executive Director of City Development seeking approval to implement waiting restrictions to accommodate works associated with necessary flood protection measures within Broughty Ferry. These works would include improvements to the National Cycle Route 1 which would promote sustainable methods of transportation with increased safety for both cyclists and pedestrians. The report also sought approval to implement One-Way sections of carriageway on Fisher Street and Ambrose Street to accommodate a pinch point which would allow cycling and walking facilities to pass through the area without compromising road safety.

 

The Committee:

 

(i)                            approved the preparation of the necessary Traffic Regulation Order;

 

(ii)                           considered the health benefits of a new cycling and walking facility segregated from the carriageway which could encourage more people to utilise the area for recreation and commuting to their places of work; and

 

(iii)                          considered the increase in road safety that a facility segregated from the carriageway would provide by preventing the vast majority of potential interaction between motorised vehicles, pedestrians and cyclists.

 

VI SPACES FOR PEOPLE (20MPH ZONES) ORDER 2021

 

On a reference to Article VIII of the minute of meeting of this Committee of 12th December 2016, there was submitted Report No 140-2021 by the Executive Director of City Development seeking approval to implement four permanent 20mph zones in Broughty Ferry, Douglas, Fintry and the West End following the successful initial temporary trials of these areas from July 2020.

 

The Committee approved the preparation of the necessary Traffic Regulation Order.

 

VII CITY CENTRE STRATEGIC INVESTMENT PLAN PROGRESS UPDATE

 

On a reference to Article VIII of the City Development Committee of 9th March 2020, there was submitted Report No 141-2021 providing members with an update on the progress made developing the City Centre Strategic Investment Plan (CCSIP) that would provide an ambitious 30-year vision to regenerate this key part of the city. It provided a summary of responses to the recent stakeholder engagement exercise and provided an update on funding secured from the Scottish Governments City Centre Recovery Fund that would be used to commission consultants to support the development of the Plan, engage young people and to progress a trial project in relation to vacant property.

 

The Committee:

 

(i)                            noted the progress made so far in developing ideas for the future regeneration of the city centre, including the responses to the stakeholder consultation exercise undertaken in late 2020;

 

(ii)                           approved the proposed initiatives to be progressed using funding from the Scottish Government City Centre Recovery Fund as outlined in the report;

 

(iii)                          delegated authority to the Executive Director of City Development to engage consultants to support specialist work areas to inform the preparation of the draft City Centre Strategic Investment Plan;

 

(iv)                          approved the proposal to work with organisations in the city to engage with young people to better understand their views on the future development of the city centre;

 

(v)                           delegated the Executive Director of City Development to implement Vacant to Vibrant projects in partnership with colleagues in UNESCO City of Design and Creative Dundee to promote the reuse of empty spaces and animate city centre streets; and

 

(vi)                          noted the successful trial undertaken in Union Street to restrict vehicular access and parking and the proposal to consult on a Traffic Regulation Order to make these changes permanent.

 

VIII UNION STREET (PROHIBITION OF DRIVING) ORDER 2021

 

There was submitted Report No 142-2021 by the Executive Director of City Development considering the restriction of vehicular access and parking within Union Street, except for loading only during the hours of 11.00 pm and 11.00 am, utilising the powers of the Road Traffic Regulation Act 1984.

 

The Committee:

 

(i)                            approved the preparation of the Prohibition of Driving Order which would vary the existing Tayside Regional Council (City of Dundee) (Traffic Management Scheme (Review) Order 1994; and

 

(ii)                           approved the revocation of all of the existing parking restrictions within the prohibited area which would be replaced with an At Any Time restriction covering the same prohibited area. This would vary the Dundee City Council (Central Area, Dundee) (Controlled Parking Zone) Order 2010, Dundee City Council (Disabled Persons Parking Places) (On-street) Order 2011 and the Tayside Regional Council (City of Dundee) (Traffic Management Scheme (Review) Order 1994.

 

IX MURRAYFIELD DRIVE, DUNDEE (STOPPING UP OF ROADS, FOOTPATHS AND FOOTWAYS) ORDER 2021

 

There was submitted Report No 143-2021 by the Executive Director of City Development seeking approval to stop-up and remove from the List of Public Roads various lengths of road, footpaths and footways in the Murrayfield Drive area of Dundee, utilising the powers of the Town & Country Planning (Scotland) Act 1997 to accommodate a housing development.

 

The Committee approved the necessary Stopping-up Order for sections of road, footpaths and footways in Whitfield as attached at Appendix 1 of the report.

 

X SUPPORTED BUS SERVICES TENDERS RECEIVED

 

There was submitted Report No 144-2021 by the Executive Director of City Development detailing the outcome of the local supported bus service procurement exercise undertaken in January 2021. The Councils current local bus service contracts were due to expire in August 2021. It was noted that there had been significant changes to the citys commercial network.

 

The Committee:

 

(i)                            approved the award of six local bus service contracts as detailed in Appendix 1 of the report, which consisted of four off peak routes and two awards associated with the outer circle service; and

 

(ii)                           delegated authority to the Head of Sustainable Transport and Roads to negotiate enhancements and amendments to the supported bus network within the available budget. Specifically, Committee delegated to the Head of Sustainable Transport and Roads to negotiate with the successful tenderer in relation to the Dryburgh Lochee West End City Centre route to test the awarded operators service vehicle through the Ancrum Road/Logie Street junction and if successfully traversable, to ensure that Tullideph Road/Ancrum Road was included in the route, to assist passengers currently without a service including sheltered tenants and to minimise duplication of route between commercial and supported services on City Road. Committee also specifically delegated to the Head of Sustainable Transport and Roads to negotiate with the successful tenderer in relation to the Broughty Ferry circular route to ensure that a single stopping point was provided at Linlathen Road, to benefit passengers currently without a service living in Clearwater Park, Ferryfields and Balgillo Heights areas.

 

XI TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY

 

There was submitted Report No 145-2021 by the Executive Director of City Development detailing tenders received and seeking approval on acceptance thereon:-

 

(i)                            MILL O MAINS PRIMARY SCHOOL COMMUNITY EXTENSION

 

The Committee agreed to accept the offer from Willmott Dixon Construction Ltd in the sum of 2,569,506.07, together with allowances of 695,000, giving a total expenditure of 3,264,506.07.

 

(ii)                           CRAIGIEBARNS PRIMARY SCHOOL ROOF OVER INFANTS AREA

 

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 247,096.07, together with allowances of 42,000, giving a total expenditure of 289,096.07.

 

(iii)                          ST PETER AND PAULS PRIMARY SCHOOL PUPIL TOILETS

 

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 104,547.51, together with allowances of 19,400, giving a total expenditure of 123,947.51.

 

(iv) ANCRUM PRIMARY SCHOOL FIRE ALARM

 

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 46,314.56, together with allowances of 9,800, giving a total expenditure of 56,114.56.

 

(v) ARDLER PRIMARY SCHOOL FIRE ALARM

 

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 60,205.61, together with allowances of 11,700, giving a total expenditure of 71,905.61.

 

 

(vi) ST FERGUS PRIMARY SCHOOL FIRE ALARM

 

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 58,825.66, together with allowances of 11,000, giving a total expenditure of 69,825.66.

 

(vii) ST PIUS PRIMARY SCHOOL FIRE ALARM

 

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 38,723.10, together with allowances of 7,600, giving a total expenditure of 46,323.10.

 

(viii) CLIMATE ACTION PROPERTY ENERGY CONSERVATION PROGRAMME 2020/2021

 

The Committee agreed to accept the offer from Vital Energi Utilities Ltd., Blackburn in the sum of 16,773, together with allowances of 1,677, giving a total expenditure of 18,450.

 

(ix) RIVERSIDE DRIVE NETWORK RAIL EMERGENCY DRAINAGE WORKS

 

The Committee agreed to accept the tender with the highest ranking score for cost and quality from Delson Contracts Ltd in the sum of 164,918.95, together with allowances of 30,081.05, giving a total expenditure of 195,000.

 

XI(A) TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY

 

There was submitted Report No 159-2021 by the Executive Director of City Development detailing tenders received and seeking approval on acceptance thereon:-

 

(i) ST FERGUS PRIMARY SCHOOL ESA ALTERATIONS

The Committee agreed to accept a negotiated offer from Dundee Construction Services in the sum of 76,587.30, together with allowances of 14,000, giving a total expenditure of 90,587.30.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

There was submitted Report No 146-2021 by the Executive Director of City Development seeking approval for the sale of land.

 

The Committee approved the sale on the terms and conditions contained within the report.

There was submitted Report No 156-2021 by the Executive Director of City Development seeking approval for the sale of property.

 

The Committee approved the sale on the terms and conditions contained within the report.

 

XVIII LEASE OF LAND AND PROPERTY

 

There was submitted Report No 149-2021 by the Executive Director of City Development seeking approval for the proposed lease as described within the report.

 

The Committee:

 

(i)                            approved the lease on the terms and conditions contained within the report; and

 

(ii)                           approved the Executive Director of City Development to negotiate any variation in the commercial terms to satisfactorily conclude the lease.

 

XIX COMMERCIAL LEASE REQUEST FOR RENTAL RESTRUCTURE

 

There was submitted Report No 116-2021 by the Executive Director of City Development seeking approval for a rental restructuring.

 

The Committee noted that, in view of the timescales involved, the Executive Director of City Development, in consultation with the Convener, Labour Group Spokesperson, Conservative Group Spokesperson, Liberal Democrat Group Spokesperson, the Independent Member and the Lord Provost had approved the rental restructuring.
