I DECLARATION OF INTEREST

 

Bailie Roberts declared a non-financial interest in Article II(f) by virtue of a family member being employed by the applicant, left the Chamber, and took no part in the debate.

 

II PLANNING APPLICATIONS

 

(a) 18-00827-FULL - PROPOSED WORKS TO ENABLE SERVICES, DRAINAGE SUDS, PONDS AND INFRASTRUCTURE - LAND AT ABERLADY CRESCENT, DUNDEE - FOR D J LAING HOMES LTD

 

It was reported that a request had been received for a deputation to address the Committee in support of the application which was recommended for approval. Having considered objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development and, in the circumstances, declined to hear the deputation.

 

(b) 17-00975-FULL - ERECTION OF 25 NEW HOMES - SITE AT ABERLADY CRESCENT, DUNDEE - FOR DISCOVERY HOMES LTD

 

It was reported that a request had been received for a deputation to address the Committee in support of the application which was recommended for approval. Having considered objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development and, in the circumstances, declined to hear the deputation.

 

(c) 18-00406-FULL - ERECTION OF 26 DWELLINGS WITH ASSOCIATED ROADS, LANDSCAPING AND DRAINAGE PROVISION - SITE OF BENVIE HOUSE, NORTH ROAD, LIFF - FOR MILLER HOMES AND NHS TAYSIDE

 

The Committee acceded to requests for a deputation to address the Committee in support of the above application which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development.

 

(d) 18-00407-FULL - ERECTION OF 28 DWELLINGS WITH ASSOCIATED ROADS, LANDSCAPING AND DRAINAGE PROVISION - SITE OF BENVIE HOUSE, NORTH ROAD, LIFF - FOR MILLER HOMES AND NHS TAYSIDE

 

The Committee acceded to requests for a deputation to address the Committee in support of the above application which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development.

 

(e) 18-00487-FULM - DEMOLITION OF 128 EXISTING COTTAGES AND ONE SHOP TO ENABLE THE CREATION OF 130 NEW HOMES AND ONE SHOP WITH ASSOCIATED NEW ROADS, PEDESTRIAN ROUTES AND PUBLIC GREEN SPACE - SITE AT ELLENGOWAN DRIVE, DUNDEE - FOR NORTHERN HOUSING COMPANY LTD

 

The Committee acceded to requests for a deputation to address the Committee relative to objections to and in support of the above application which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

After considering objections received, the Convener, seconded by Bailie Roberts, moved that the application be approved, subject to the conditions recommended by the Executive Director of City Development.

 

Councillor Richardson moved that the application be refused on the grounds that the proposal is contrary to Policy 9 (Dundee Local Development Plan (2014)) Appendix 3 as it fails to provide a minimum of 18 metres between the facing windows of habitable rooms, but failed to find a seconder, whereupon the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development. Councillor Richardson asked for her dissent to be recorded.

 

(f) 18-00958-ADV - ERECTION OF SIX SIGNS - BARNETTS OF DUNDEE LTD, RIVERSIDE DRIVE, DUNDEE - FOR MR STEVE WILLIAMS

 

The Committee acceded to requests for a deputation to address the Committee relative to objections to and in support of the above application which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

After considering objections received, the Convener, seconded by Councillor Alexander, moved that the application be approved, subject to the conditions recommended by the Executive Director of City Development.

 

As an amendment, Bailie Macpherson, seconded by Councillor Hay, moved that the application be refused on the grounds that:-

 

1. The proposed illuminated signage would increase the amount of lighting at the car dealership, exacerbating existing issues with the level of illumination at the site.

 

2. This would have a detrimental impact on the amenity of residential properties to the north of the site.

 

3. The approval of advertisement consent would not discharge the statutory requirements of the Town and Country Planning Control (Control of Advertisements) (Scotland) Regulations 1984.

 

4. The application fails to comply with Policy 47 (Environmental Protection) of the Dundee Local Development Plan (2014), and Policy 39 (Environmental Protection) of the Proposed Dundee Local Development Plan (2017). There are no material considerations of sufficient weight to justify approval of the application.

 

On a division, there voted for the motion - the Convener, Lord Provost Borthwick, Bailies Sawers, Wright and Scott and Councillors Alexander, Cordell, Flynn, Hunter, Murray, Rendall, Short, Smith, Richardson and Scott (15); and for the amendment - Depute Lord Provost Campbell, Bailies Keenan and Macpherson and Councillors McCready, McIrvine, Malone, Marra, May and Duncan (9); Bailie Roberts being absent when the vote was taken - whereupon the motion was declared carried and the application approved.

 

III DELEGATED APPLICATIONS

 

There was submitted Agenda Note AN11-2019 advising the Committee that from 1st December, 2018 to 31st December, 2018 there were 55 delegated decisions. Six of those applications attracted objections. Of those six, four applications were approved and two were refused.
