The minute of meeting of this Committee of 16th January, 2016 was held as read.

I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II PLANNING APPLICATIONS

 

(a) 15-00872-FULL - 11 OSBORNE PLACE, DUNDEE - GARDEN LANDSCAPING WORKS - FOR DR MICHAEL ALLAN

 

The Committee acceded to requests for deputations to address the Committee both relative to objections and in support of the above application. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Councillor Black, moved that the application be approved, subject to the conditions recommended by the Executive Director of City Development.

 

As an amendment, Councillor Macpherson, seconded by Lord Provost Duncan, moved that the application be refused on the grounds that:-

 

the proposed landscaping would reduce security and privacy at the application site by creating a stepped access to the rear garden ground, the landscaped garden ground would be detrimental to the visual appearance of this terrace of properties and detrimental to the appearance of the West End Lanes Conservation Area, the application was contrary to Policy 10 and 50 of the Dundee Local Development Plan 2014, and that there were no material considerations that would justify approval of the application.

 

On a division, there voted for the motion - the Convener, Depute Lord Provost Roberts and Councillors Black, Dawson, Hunter, Lynn, Murray, Bidwell, Brennan, Cruickshank, Ferguson, Gordon and McGovern (13); and for the amendment - Lord Provost Duncan, Bailies Wright and Borthwick and Councillors Campbell, Cordell, Keenan, Asif, McCready and Macpherson (9) - whereupon the motion was declared carried.

 

(b) 15-00440-FULL - 20A THOMSON STREET, DUNDEE - CHANGE OF FORMATION USE FROM FOUR BEDROOM FLAT TO FOUR PERSON HMO FOR MR JOHN KERR

 

The Committee acceded a request for a deputation to address the Committee in support of the proposed development. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Councillor Lynn, moved approval of the application, subject to the conditions recommended by the Executive Director of City Development.

 

As an amendment, Councillor Macpherson, seconded by Councillor McCready, moved refusal of the application on the grounds that:-

 

the proposed development would generate a parking demand beyond that which the existing property would provide, the proposal would therefore increase the number of vehicles parking on the street in an area heavily congested. Therefore the proposed development would be detrimental to road and pedestrian safety on account of exacerbating existing parking pressures on Thomson Street and the surrounding area, a further HMO would be detrimental to the character and residential amenity of Thomson Street given the existing provision of Houses in Multiple Occupation; and the application was contrary to Policy 15 of the Dundee Local Development Plan 2014. There were no material considerations that would justify approval of the application.

 

On a division, there voted for the motion - the Convener, Lord Provost Duncan, Depute Lord Provost Roberts, Bailie Borthwick and Councillors Black, Cordell, Dawson, Hunter, Lynn, Murray, Asif, Bidwell, Cruickshank, Ferguson and Gordon (15); and for the amendment - Bailie Wright and Councillors Campbell, Keenan, Brennan, McCready, McGovern and McCready (7) - whereupon the motion was declared carried.

 

(c) 15-00659-FULL - LAND TO SOUTH OF 53A STRATHMARTINE ROAD - ERECTION OF TWO WORKSHOP BUILDINGS, YARD AREAS, PARKING AND ACCESS AREAS OVER TWO SITES ON THE WESTERN SIDE OF STRATHMARTINE ROAD - FOR ALPINE FENCING (DUNDEE) LTD

 

The Committee acceded to a request for deputations to address the Committee both in support of and relative to objections to the proposed development. After the deputations had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee refused the application on the grounds that:-

 

(i) The proposed development by virtue of the volume of traffic generated, the inability of large vehicles to enter and exit Site 2 in a forward gear and the requirement for deliveries to be unloaded on Strathmartine Road will exacerbate existing issues of traffic congestion and on-street parking pressure on Strathmartine Road. This would be to the detriment of road and pedestrian safety and consequently the environmental quality enjoyed by local residents. Therefore the proposed development is contrary to Policy 16 of the Dundee Local Development Plan. There are no other material considerations that would justify the approval of planning permission contrary to Policy 16 of the Local Development Plan; and

(ii) The proposed development by virtue of noise and disturbance generated by the cutting of materials and the comings and goings of staff, customers and deliveries to the premises will adversely impact on the environmental quality enjoyed by local residents. Therefore the proposed development is contrary to Policies 16 and 47 of the Dundee Local Development Plan 2014. There are no material considerations that would justify the approval of planning permission contrary to Policies 16 and 47 of the Local Development Plan.

 

III DELEGATED ITEMS

 

There was submitted Agenda Note AN10-2016 advising the Committee that from 23rd December, 2015 to 22nd January, 2016, 43 applications were decided under delegated powers. Nine of these applications attracted objections. Six were approved and three were refused.

 

The Committee noted accordingly.
