The minute of meeting of this Committee of 12th May, 2014 was held as read.

I DECLARATION OF INTEREST

 

Councillor Asif declared a financial interest in Article II(a) by virtue of being a Broughty Ferry Trader and in Article II(b) by being the applicant and left the Chamber during their consideration.

 

II PLANNING APPLICATIONS

 

(a) 14-00277-MDPO - 1 TOM JOHNSTON ROAD, WEST PITKERRO INDUSTRIAL ESTATE, DUNDEE - REQUEST TO MODIFY TERMS OF SECTION 75 AGREEMENT TO REDUCE THE NET SALES FLOOR AREA FOR THE DISPLAY AND SALE OF FOOD AND OTHER CONVENIENCE GOODS FROM NOT LESS THAN 80% TO NOT LESS THAN 70% - FOR SAINSBURY'S SUPERMARKETS

 

The Committee acceded to a request which had been received for a deputation to address the Committee in support of the above application.

 

After the deputation had stated its case and answered questions from the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Lord Provost Duncan, moved approval of the request.

 

As an amendment, Bailie Scott, seconded by Councillor Cordell, moved refusal of the request on the grounds that increasing the area allocated to comparison goods to 30% of floor space would have a detrimental impact on Broughty Ferry District Centre and is contrary to the City Council's stated aims, in the Local Development Plan, of maintaining and enhancing the vitality and viability of the District Centre as a sustainable shopping location. The planning obligation should continue to have effect without modification.

 

On a division there voted for the motion the Convener, Lord Provost Duncan, Depute Lord Provost Roberts and Councillors Black, Lynn, Murray, Ross, Brennan, Cruickshank, Ferguson and McGovern (11); and for the amendment Bailies Borthwick and Scott, and Councillors Guild, Alexander, Campbell, Cordell, Hunter, McDonald, Keenan, Bidwell, Gordon, McCready and Macpherson (13); Councillor Asif being absent when the vote was taken whereupon the amendment was declared carried and the request refused.

 

(b) 14-00302-FULL - 258 TO 260 KING STREET, BROUGHTY FERRY - ALTERATIONS TO SHOP FRONT AND INSTALLATION OF AIR CONDITIONING UNITS - FOR MR MOHAMMED ASIF

 

The Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

(c) 14-00204-FULL - SOUTH COTTAGE, 477 BROOK STREET, BROUGHTY FERRY - ALTERATIONS AND EXTENSION TO EXISTING COTTAGE - FOR VOIGHT PARTNERSHIP LTD

 

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

III PLANNING APPEAL DECISIONS

 

There was submitted Agenda Note AN177-2014 detailing the undernoted Planning Appeal Decisions:-

 

(a) 28 INVERGOWRIE DRIVE, DUNDEE - EXTENSION TO HOUSE AND ALTERATIONS TO EXISTING ROOF (RETENTION OF EXTENSION)

 

Reference was made to Article I(b) of the minutes of this Committee of 16th December, 2013, wherein the above proposal was refused planning permission contrary to the Director's recommendation because the Council considered that the house extension as proposed and built was contrary to Policy 10 of the adopted Dundee Local Development Plan (Household Development) as the development had a detrimental impact on the character and environmental quality of the house and surrounding area by virtue of size and design and had a detrimental impact on the neighbouring property in terms of physical overshadowing; there were no material considerations that would justify departing from the Development Plan and approving planning permission.

 

It was reported that the decision was appealed by the applicant and the Reporter allowed the appeal and granted planning permission.

 

The Committee noted accordingly.

 

(b) THE OLD POLICE STATION, FINTRY ROAD, DUNDEE - PROPOSED NEW SHOP UNIT ON LAND NORTH EAST OF CORAL BOOKMAKERS

 

Reference was made to Article I(b) of the minute of meeting of this Committee of 17th February, 2014, wherein the above proposal was refused planning permission contrary to the Director's recommendation because the Council considered that the proposal was likely to result in increased traffic congestion and additional demand on limited parking opportunities in the locality leading to indiscriminate parking. Both factors were likely to have a detrimental impact on pedestrian safety in the vicinity of the application site.

 

It was reported that the decision was appealed by the applicant and the Reporter allowed the appeal and granted planning permission subject to conditions.

 

The Committee noted accordingly.

 

IV REQUEST FOR DIRECT ACTION AT 67 PERTH ROAD AND 1/2 71 PERTH ROAD

 

There was submitted Report No 242-2014 by the Director of City Development seeking Committee approval for taking appropriate action to seek compliance with an Advertisement Enforcement Notice in respect of 67 Perth Road and Flat 1/2, 71 Perth Road, Dundee.

 

The Committee authorised action under the terms of Section 26 of The Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 to allow the Council to enter onto land and take necessary steps to comply with the terms of the Advertisement Notice, having noted that any expenses reasonably incurred by the Council taking such action would be recovered from the landowner.

 

The Committee noted accordingly.

 

V DELEGATED APPLICATIONS

 

There was submitted Agenda Note 178-2014 advising that from 22nd April to 21st May, 2014, 42 applications were decided under delegated powers. Five of these applications attracted objections and all five were approved.
