The minute of meeting of this Committee of 8th December, 2008 was held as read.

I TAYSIDE AND CENTRAL SCOTLAND TRANSPORT PARTNERSHIP - DELIVERY PLAN

 

There was submitted Report No 1-2009 by the Director of Planning and Transportation advising the Committee of the content of the Tayside and Central Scotland Transport Partnership's (TACTRAN) Delivery Plan.

 

The Committee agreed to:-

 

(a) welcome and approve, in principle, the TACTRAN three year implementation and 15 year investment plan as contained in the appendices to the report;

 

(b) approve the utilisation of the Regional Transport Partnership (RTP) Capital Funding provided to the Council to support the TACTRAN three year Implementation Plan; and

 

(c) note that officers were continuing to work with TACTRAN to bring forward proposals associated with schemes detailed in the Delivery Plan that were related to improving transport for residents and visitors to the City.

 

II FUTURE CEMETERY PROVISION IN DUNDEE - SITE PROFILES - PRELIMINARY ASSESSMENT

 

There was submitted Joint Report No 5-2009 by the Director of Leisure and Communities and the Director of Planning and Transportation advising the Committee of the results of a preliminary examination of sites with the potential to contribute to future cemetery provision in Dundee.

 

The Committee agreed to:-

 

(a) approve the outcome of this examination of future cemetery provision as a reference document for the forthcoming review of the Development Plan; and

 

(b) remit the Director of Leisure and Communities to carry out a feasibility study and cost estimates to establish the potential for additional cemetery provision north of West Pitkerro Industrial Estate.

 

III WHITFIELD DESIGN FRAMEWORK - ABERLADY DRAFT SITE PLANNING BRIEF AND LOTHIAN DRAFT SITE PLANNING BRIEF - RESULTS OFCONSULTATION PROCESS

 

There was submitted Report No 11-2009 by the Director of Planning and Transportation advising the Committee of the outcome of the consultation exercise with the local community and interested parties for the abovementioned two sites within Whitfield.

 

The Committee agreed to:-

 

(a)                                        approve the final Site Planning Briefs;

 

(b)                                        remit the appropriate officers to issue the approved Site Planning Briefs to prospective developers; and

 

(c)                                        refer the approved final Site Planning Briefs to the Development Quality Committee as material considerations.

 

IV DUNDEE CENTRAL WATERFRONT, DUNDEE STATION BRIDGE NETWORK RAIL - BASIC ASSET PROTECTION AGREEMENT

 

There was submitted Agenda Note AN11-2009 advising the Committee that as part of the Dundee Central Waterfront Development, Dundee Station bridge required to be strengthened or replaced. In order to progress the option appraisal and design of the project, Network Rail required Dundee City Council to enter into a legal Basic Asset Protection Agreement for them to provide interface activities relating to the rail network, health and safety, industry standards, regulations and necessary approvals. This allowed Network Rail to recognise the project and recharge Dundee City Council for agreed staff costs incurred in providing these services. The estimated cost for Network Rail providing these services for this project was 2,500 which could be met from the allowances within the Cities Growth Fund 2008/2009 and 2009/2010.

 

The Committee authorised the Depute Chief Executive (Support Services) in consultation with the Depute Chief Executive (Finance) to agree terms and conditions with Network Rail and to sign the Agreement on behalf of the Council.

 

V REVIEW OF CAR PARKING CHARGES

 

There was submitted Agenda Note AN1-2009 advising that, as with effect from Monday, 1st December, 2008 the Value Added Tax (VAT) rate had been reduced from 17.5% to 15%, Dundee City Council was required to review its charging regime for off-street car parking.

 

It was not proposed to amend the Pay and Display meter payment tariff. However, off-street car park season ticket charges had been reduced to reflect the change in the rate of VAT from 1st December, 2008 as detailed below. No changes were planned for on-street parking as VAT was not applicable to this activity.

 

The VAT rate would revert to 17.5% with effect from 1st January, 2010. Therefore, from 1st January, 2010, all parking tariffs would revert to those in force prior to the 1st December, 2008.

VI KINNOULL ROAD LAY-BYS - STOPPING-UP

 

There was submitted Report No 10-2009 by the Director of Planning and Transportation relative to a proposal to stop-up the two lay-bys situated on the north side of Kinnoull Road utilising the powers of the Town and Country Planning (Scotland) Act 1997.

 

The Committee approved the preparation of a Stopping-Up Order to stop-up the two lay-bys on the north side of Kinnoull Road between Kinnoull Street and Broomhill Road to accommodate a new development following planning consent.

 

VII DUNDEE CITY COUNCIL (SANDEMAN STREET, DUNDEE) (MAJOR EVENTS RELATED TRAFFIC CONTROL) ORDER 2009

 

There was submitted Agenda Note AN2-2009, making reference to Article XV of the minute of meeting of this Committee of 8th September, 2008, wherein it was agreed to authorise the preparation of an Order to facilitate crowd control and relieve congestion on occasions of major events at Dens Park and Tannadice Park.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

The Committee therefore authorised formal publication of the Order as drafted.

 

VIII DUNDEE CITY COUNCIL (PERTH ROAD, RIVERSIDE DRIVE AND NINEWELLS AVENUE, DUNDEE) (VARIATION OF SPEED LIMITS) ORDER 2009

 

There was submitted Agenda Note AN3-2009, making reference to Article VI of the minute of meeting of this Committee of 8th September, 2008, wherein it was agreed to authorise the preparation of an Order to improve safety by reducing the current 40 mph speed limit to 30 mph.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

The Committee therefore authorised formal publication of the Order as drafted.

 

IX DUNDEE CITY COUNCIL (RESTRICTED ROADS) (VARIATION) ORDER 2009

 

There was submitted Agenda Note AN9-2009, making reference to Article IV of the minute of meeting of this Committee of 9th June, 2008, wherein the Committee authorised the preparation of an Order to amend the descriptions of the restricted roads following reclassification of the roads.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received. Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

X PROPOSED NEW STREET NAMES

 

There was submitted Agenda Note AN4-2009 proposing the undernoted new street name:-

In addition, Committee approval was sought to re-introduce two historic street names around the City Churches area which had been removed from the street register some time ago, these being:-

The Committee approved these proposals.

 

XI DUNDEE, PERTH, ANGUS AND NORTH FIFE STRATEGIC DEVELOPMENT PLANNING AUTHORITY JOINT COMMITTEE

 

There was submitted Report No 49-2009 by the Director of Planning and Transportation advising the Committee of the proceedings of the meeting of the Dundee, Perth, Angus and North Fife Strategic Development Planning Authority Joint Committee which was held on 25th November, 2008.

 

The Committee agreed to endorse the remits of the Joint Committee, as detailed in the report.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraphs 6 and 8 of Part I of Schedule 7A of the Act.

 

XII VACANT AND DERELICT LAND FUND PROGRAMME 2008/2011

 

There was submitted Report No 18-1009 by the Director of Planning and Transportation updating the Committee on the proposed Vacant and Derelict Land Fund (VDLF) Delivery Plan 2008 to 2011 and reporting progress on those projects approved by Scottish Government.

 

The Committee agreed to:-

 

(a) approve the updated schedule of projects to be pursued through the Vacant and Derelict Land Fund as set out in the report;

 

(b) note the need for flexibility and responsiveness in the Vacant and Derelict Land Fund Delivery Plan to any opportunities which may arise, particularly in light of the challenges faced during the current economic climate; and

 

(c) remit the Director of Planning and Transportation to amend the VDLF Delivery Plan as required during the programme period and subject to Scottish Government approval, to ensure that Dundee City Council maximises the benefits of the VDLF and achieves full expenditure.
