The minute of meeting of this Committee of 15th September, 2008 was held as read.

I PLANNING APPLICATIONS
(a) 08-00540-COU - WIMBERLEY HOUSES, GLAMIS DRIVE - CHANGE OF USE AND ELEVATIONAL ALTERATIONS TO FORM DWELLINGHOUSES AND FORMATION OF ADDITIONAL CAR PARKING - FOR BAKER STREET (UK) LTD
The Committee acceded to requests for deputations to address the Committee both in support of and relative to objections to the above mentioned application. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.
Thereafter, having considered objections received, Councillor Macpherson, seconded by Councillor Hay, moved refusal of the application on the grounds that:-
(i) the proposed development contravenes Policy 4 of the Dundee Local Plan Review 2005 by virtue of the failure of the applicants to provide the required level of private useable garden ground and off-street car parking provision within the curtilage area of each new dwellinghouse proposed resulting in a standard of development that would not be commensurate with the quality of housing located in the surrounding area; and
(ii) the proposed development will result in a significant increase in demand for on-street car parking in the surrounding suburban streets to the detriment of the environmental qualities currently enjoyed by local residents and the road traffic and pedestrian safety of the area.
As an amendment, the Convener, seconded by Councillor Bidwell, moved approval of the application subject to the conditions recommended by the Director of Planning and Transportation.
On a division, there voted for the motion - Bailies Regan, Wright, Scott and Borthwick, and Councillors Keenan, Asif, Ferguson, McCready, Macpherson, Dick, Barrie, Bowes, Lynn, Ross and Hay (15); and for the amendment - the Convener, Lord Provost Letford and Councillors Bidwell, Morrow, Guild, Black, Andrew Dawson, Will Dawson, Duncan, Hunter and Roberts (11) - whereupon the motion was declared carried.
(b) 08-00583-FUL - 9-11 SCOTT STREET - DEMOLITION OF EXISTING BUILDINGS AND ERECTION OF EIGHT FLATS AND ASSOCIATED GARAGES/CAR SPACES
The Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.
(c) 08-00592-FUL - 10 WEST GROVE AVENUE - ERECTION OF DETACHED DWELLING AND DOUBLE GARAGE - FOR MR AND MRS BUNTON
After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.
(d) 08-00666-FUL - 83 PERTH ROAD - ERECTION OF TIMBER FENCE AROUND ROOF EDGE - FOR I B MURRAY & SONS
After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of Planning and Transportation.
II MACALPINE PRIMARY SCHOOL - SITE PLANNING BRIEF
There was submitted Agenda Note AN199-2008, making reference to Article XVII of the minute of meeting of the Planning and Transport Committee of 8th September, 2008, wherein it was agreed to refer the above mentioned Site Planning Brief to this Committee as a relevant material planning consideration.
The Committee noted accordingly.
III ERSKINE STREET YARD SITE PLANNING BRIEF
There was submitted Agenda Note AN200-2008, making reference to Article XVIII of the minute of meeting of the Planning and Transport Committee of 8th September, 2008, wherein it was agreed to refer the above mentioned Site Planning Brief to this Committee as a relevant material planning consideration.
The Committee noted accordingly.
IV FORMER DENS METALS SITE PLANNING BRIEF
There was submitted Agenda Note AN201-2008, making reference to Article XIX of the minute of meeting of the Planning and Transport Committee of 8th September, 2008, wherein it was agreed to refer the above mentioned Site Planning Brief to this Committee as a relevant material planning consideration.
The Committee noted accordingly.
V PLANNING APPEAL DECISIONS
There was submitted Agenda Note AN186-2008 detailing the undernoted planning appeal decisions:-
(a) 93-95 HIGH STREET, LOCHEE - UNAUTHORISED INSTALLATION OF FOUR EXTERNAL MOUNTED ROLLER SHUTTERS WITH ASSOCIATED BOXES
Reference was made to the Listed Building Enforcement Notice served by the Council on 15th May, 2008 under powers delegated to the Director of Planning and Transportation, requiring that shutters and boxes at the above address be removed within 28 days of the service of the Notice.
It was reported that the terms of the Notice were appealed under the provisions of Section 34 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997, and the appeal had been dismissed and the Listed Building Enforcement Notice which took effect on the date of the appeal decision upheld.
(b) GROUND TO THE EAST OF 14 STRIPS OF CRAIGIE ROAD - ERECTION OF HOUSE AND FORMATION OF DRIVEWAY (OUTLINE)
Reference was made to Article I(i) of the minute of meeting of this Committee of 17th December, 1997, wherein the above application was refused planning permission because the Council considered that the proposal conflicted with Policies 1, 4 and 15 of the Dundee Local Plan Review (impact on existing dwellings area of garden ground; impact on prevailing densities; impact on trees) and that there were no material considerations which led the Council to granting an exceptional approval.
It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997 and had been dismissed.
VI BUILDING (SCOTLAND) ACT - SECTIONS 29 AND 30 - DANGEROUS BUILDINGS
There was submitted Report No 461-2008 advising the Committee of action taking in dealing with dangerous buildings during August 2008.
The Committee noted the contents of the report.
