I GREENMARKET CAR PARK - NETWORK RAIL - BASIC ASSET PROTECTION AGREEMENT

 

Reference was made to Article III of the minute of meeting of the Recess Sub-Committee of 11th July, 2005. There was submitted Agenda Note AN288-2005 advising that part of the Dundee Central Waterfront Development included the construction of a new multi-storey car park at Greenmarket with a site boundary adjoining the railway and Network Rail required the Council to enter into a legal Basic Asset Protection Agreement to provide interface activities relating to the rail network, health and safety, industry standards, regulations and necessary approvals.

 

The Sub-Committee authorised the appropriate officers to enter into the Agreement with Network Rail to allow the project to progress.

 

II DUNDEE'S STREETS AHEAD

 

There was submitted Agenda Note AN289-2005 requesting approval of the adoption of a revised roads standard guide entitled "Dundee's Streets Ahead", which would replace the former Tayside Regional Council roads standard document.

 

The Sub-Committee approved the adoption of the revised guide.

 

III TENDERS RECEIVED BY CITY ARCHITECTURAL SERVICES OFFICER

 

The City Architectural Services Officer submitted Report No 458-2005 giving details of an offer to carry out a partnering project by McGill Electrical Limited for electrical testing and remedial works at the City Square Complex.

 

The Sub-Committee agreed to accept the offer amounting to 75,669 together with the undernoted allowances:-

 

Remedial works following investigation of low resistance circuits

5,000.00

Allowance for removals required during the works

2,000.00

Allowance for security of the buildings for out of hours working

8,000.00

Planning Supervisor

770.00

Professional services

7,567.00

 

making a total expenditure of 99,006.00.

 

IV TENDER PROCEDURES

 

There was submitted Agenda Note AN290-2005 reporting that the value of works requiring a Contractor to enter into a Bond with a Bank or Insurance Company had remained at 250,000 for several years. Following a review by the City Architectural Services Officer, it was recommended that only works in excess of 1,000,000 would require a Contractor to enter into a Bond with a Bank or Insurance Company. This would not present any increased risk to the Council and would provide a saving on contracts below 1,000,000.

 

The Sub-Committee approved the increase in the limit requiring a Bond to 1,000,000.

 

It was reported that the Convener had agreed that the undernoted item be considered as a matter of urgency in terms of Standing Order 17(b) in view of the timescales involved.

 

V CHINESE STATE CIRCUS, CAIRD PARK, DUNDEE

 

There was submitted Agenda Note AN291-2005 advising that a request had been made from the European Entertainment Group on behalf of the Chinese State Circus for permission to hold circus performances at Caird Park from 4th to 8th August, 2005.

 

After consultation with the Director of Leisure and Arts, provisional agreement had been reached based on a rental for the period of let with the tenants arranging public liability insurance and a deposit to cover any reinstatement required to the site with all other terms and conditions being of the Council's standard conditions of let.

 

The Sub-Committee approved the request, noting that the use of performing animals was strictly prohibited, and authorised the Director of Economic Development to issue a formal Missive of Let.
