I DRAFT PERTH AREA/CENTRAL AREA LOCAL PLAN REVIEW
There was submitted Report No 81-2005 by the Director of Planning and Transportation advising the Committee of the publication of the Draft Perth Area/Central Area Local Plan Review - December 2004 and outlining matters of interest to Dundee City Council as a neighbouring authority.
The Committee agreed to -
(i) note the publication of the Draft Perth Area/Central Area Local Plan Review, and
(ii) approve the report as Dundee City Council's response to the Draft Perth Area/Central Area Local Plan Review.
II PANMURE STREET - EXTENSION TO PROHIBITION OF DRIVING
There was submitted Report No 79-2005 by the Director of Planning and Transportation seeking Committee approval for the implementation of a Traffic Regulation Order to vary the prohibition of driving at Euclid Crescent to include a length of Panmure Street.
The Committee approved the preparation of the necessary Traffic Regulation Order to make that part of Panmure Street between Euclid Crescent and the McManus Galleries a prohibition of driving in the same terms as Euclid Crescent at the southern frontage of the High School of Dundee.
III VICTORIA STREET - RELOCATION OF BUS LANE
There was submitted Report No 71-2005 by the Director of Planning and Transportation seeking Committee approval for the implementation of a Traffic Regulation Order to remove the contra-flow bus lane in Victoria Street to allow two-way traffic over the entire length.
The Committee approved the preparation of the necessary Traffic Regulation Order to remove the bus lane in Victoria Street and allow two-way traffic.
IV PENALTY CHARGE NOTICE SYSTEM - REPORT ON TENDERS
There was submitted Report No 68-2005 by the Director of Planning and Transportation detailing tenders received in respect of the purchase and installation of a computerised Penalty Charge Notice System.
The Committee approved acceptance of the most advantageous offer from Civica Systems Limited, in the sum of 96,204.
V BRIDGE STREET BRIDGE - WEIGHT LIMIT
There was submitted Report No 2-2005 by the Director of Planning and Transportation seeking Committee approval to promote a Traffic Regulation Order in order to impose a more stringent weight limit on Bridge Street following its reassessment.
The Committee approved the preparation of a permanent Traffic Regulation Order to reduce the current maximum gross weight restrictions on Bridge Street Bridge to 3 tonnes from the current 7.5 tonnes.
VI HAPPYHILLOCK ROAD - PROPOSED CYCLE PATH AND PEDESTRIAN FOOTPATH
There was submitted Agenda Note AN55-2005 advising that proposals had been prepared for carrying out works at Happyhillock Road footways. This work would involve the implementation of a cycle route and widening of footpaths.
The Committee approved acceptance of negotiated rates from Dundee Plant Co to carry out this work amounting to 30,000, together with allowances of 2,500 for professional fees and 2,500 for contingencies, giving an overall expenditure of 35,000.
VII CITY CENTRE IMAGE IMPROVEMENTS
There was submitted Agenda Note AN56-2005 advising that works to the pedestrainised areas in the Murraygate and High Street had been identified as part of a rolling programme of improvements to maintain the high quality streetscape in these areas.
In order to achieve the expenditure by March 2005, it was agreed that the work be carried out by Tayside Contracts as an extension to the partnering agreement for Broughty Ferry Junctions which contained similar work and the Committee approved the additional expenditure of 20,000 which included allowances for contingencies and fees.
VIII NEW ROADS
There was submitted Agenda Note AN57-2005 advising the Committee of the undernoted applications for road construction consent.
Councillor Webster declared a non-financial interest in item CC05/03, Hawkhill-Heathfield, detailed below, by virtue of being employed by the applicant.

The Committee approved the applications subject to conditions agreed between the applicant and Director of Planning and Transportation and further agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.
IX CONFIRMATION OF TREE PRESERVATION ORDERS
There was submitted Agenda Note AN58-2005 seeking approval for confirmation of the undernoted Tree Preservation Orders:-
(i) 11/2004 63A CAMPHILL ROAD BROUGHTY FERRY, DUNDEE
The Committee noted that on 10th November 2004 the Council had made a provisional Tree Preservation Order on the above mentioned site, due to their arboreal and visual amenity and no objections had been received to this Tree Preservation Order.
(ii) 12/2004 9A SEABOURNE GARDENS, BROUGHTY FERRY, DUNDEE
The Committee noted that on 16th December 2004 the Council had made a provisional Tree Preservation Order on the above mentioned site, due to their arboreal and visual amenity and no objections had been received to this Tree Preservation Order.
The Committee therefore authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures to confirm these two Tree Preservation Orders.
X DUNDEE CITY COUNCIL (GLENESK AVENUE, DUNDEE) (PROHIBITION OF ENTRY ORDER 2005
There was submitted Agenda Note AN74-2005 whereby reference was made to Article VIII of the minute of meeting of this Committee of 28th June 2004 authorising the preparation of an Order to remove extraneous traffic from this narrow residential street.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received. Thereafter, the Order was duly advertised and there were no objections.
The Committee therefore agreed to make the Order as advertised.
XI DUNDEE CITY COUNCIL (RIVERSIDE DRIVE - ESPLANADE WEST, DUNDEE) (PROHIBITION OF HEAVY VEHICLES ANDONE-WAY TRAFFIC) ORDER 2005
There was submitted Agenda Note AN75-2005 whereby reference was made to Article II of the minute of meeting of this Committee of 25th October 2004 instructing and authorising the preparation of an Order to enhance the appearance of the Ambassador Route into the west of the city as part of an environmental improvement scheme and to facilitate the upgrading of the service facilities in the area.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Committee therefore agreed to authorise formal publication of the order as drafted.
XII DUNDEE CITY COUNCIL (BROOK STREET AREA AND FISHER STREET, BROUGHTY FERRY, DUNDEE) VARIATION OF TRAFFICREGULATIONS) ORDER 2005
Councillor Webster declared a non financial interest in the undernoted item by virtue of living in close proximity to Fisher Street.
There was submitted Agenda Note AN76-2005 whereby reference was made to Article VI of the minute of meeting of this Committee of 25th October 2004 instructing and authorising the preparation of an Order to amend the parking and traffic regulations in Broughty Ferry following a trial period of the traffic measures, as follows:-
(i) to allow more parking spaces both for general use and for the disabled in Brook Street between Fort Street and Gray Street. This is at the expense of loading and unloading facilities;
(ii) to adjust the waiting restrictions in Brook Street between Fort Street and Lawrence Street following the relocation of the police station;
(iii) to convert the underused taxi rank east of Brown Street to limited waiting;
(iv) to remove the underused taxi rank in Gray Street south of Queen Street; and
(v) to improve traffic circulation by reopening Fisher Street.
It was reported that the proposed order was duly drafted and during the statutory consultation period no adverse comments were received.
The Committee therefore agreed to authorise formal publication of the order as drafted.
XIII DUNDEE CITY COUNCIL (ARBROATH ROAD LAYBY AT BALMOSSIE) (STOPPING-UP) ORDER 2005
There was submitted Agenda Note AN77-2005 whereby reference was made to Article V of this Committee of 15th November 2004 which authorised the preparation of an Order to stop up sections of roads at the Dundee - Arbroath Road lay-by at Balmossie to facilitate the new housing development in Elcho Drive.
It was reported that the Order was duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette and the relevant statutory undertakers were consulted. No objections were received.
The Committee therefore agreed to authorise and confirm the Stopping Up Order and authorise formal publication of the confirmation after which the Order would become operative.
XIV DUNDEE CITY COUNCIL (DERWENT AVENUE FOOTWAY, DUNDEE) (STOPPING UP) ORDER 2005
There was submitted Agenda Note AN78-2005 whereby reference was made to Article V of this Committee of 25th October 2004 which authorised preparation of an Order to stop up sections of road and footpath at Derwent Avenue, Dundee which would become unnecessary following the construction of the extended Keswick Terrace.
It was reported that the Order was duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette, and the relevant statutory undertakers were consulted. No objections were received.
The Committee therefore agreed to authorise and confirm the Stopping Up Order, and authorise formal publication of the confirmation, after which the Order would become operative.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in Paragraphs 6 and 9 of Part 1 of Schedule 7(A) of the Act.
XV SALE OF GROUND AT REAR OF 187 PERTH ROAD, DUNDEE
There was submitted Agenda Note AN79-2005 whereby reference was made to Article XVIII of this Committee of 26th April 2004 wherein members approved the sale of a site at the rear of 187 Perth Road, Dundee to Mr and Mrs G Morrison on the terms and conditions detailed.
It was reported that a request had been received for the purchase to now be in the name of JBF Properties Limited, and the Committee approved accordingly.
