I LOCAL TRANSPORT STRATEGY

 

There was submitted Agenda Note AN179-2004 advising the Committee that the process of revising the Local Transport Strategy would commence in May 2004.

 

The Committee noted that the revision process would commence with a review of targets, the results of which would be reported to Committee in due course.

 

II SCOTTISH PLANNING POLICY - PLANNING FOR RURAL DEVELOPMENT - CONSULTATION DRAFT, JANUARY 2004

 

There was submitted Agenda Note AN180-2004 advising the Committee of the updating of National Planning Policy Guidelines (NPPG15) on Rural Development and the implications for Dundee.

 

The Committee noted and approved the Director of Planning and Transportation's comments on the policy.

 

III PERFORMANCE INDICATORS 2002/03

 

There was submitted Report No 280-2004 by the Director of Planning and Transportation outlining the aspects of Audit Scotland's report on Performance Information for Scottish Councils 2002/2003 as far as it related to the repair of faulty street lights and traffic signals.

 

The Committee noted the high level of service provided in the repair of street lights and traffic signal faults, and extended their congratulations to the officers and staff of the Planning and Transportation Department.

 

IV DUNTRUNE DEMONSTRATION GARDEN SITE DEVELOPMENT BRIEF - CONSULTATION RESPONSE

 

There was submitted Report No 248-2004 by Director of Planning and Transportation advising the Committee of the results of the consultation for the above mentioned draft site planning brief and seeking approval of the brief as guidance for the development of the site.

 

The Committee agreed to:-

 

(a) note the response to the consultation for the draft site planning brief;

 

(b)confirm the amendments to the brief as indicated in Appendix 1 to the report;

 

(c)approve the site-planning brief as guidance for the development of the site; and

 

(d)refer the brief to the Development Quality Committee as a material planning consideration.

 

V ARMITSTEAD HOUSE - DRAFT SITE PLANNING BRIEF - CONSULTATION RESPONSE

 

There was submitted Report No 272-2004 by Director of Planning and Transportation advising the Committee of the results of the consultation stage for the above mentioned draft site planning brief and seeking approval of the brief as guidance to the owners, appropriate design teams and developers.

 

The Committee agreed to:-

 

(a)note the response to the consultation stage for the draft site planning brief as indicated in Appendix 1 to the report;

 

(b)confirm the terms of the amended site planning brief as indicated in Appendix 2 to the report;

 

(c)remit the Director of Planning and Transportation to issue the final approved site planning brief to client, appropriate design teams and developers; and

 

(d)refer the final site planning brief to the Development Quality Committee as relevant material planning considerations.

 

VI PITALPIN VILLAGE DRAFT SITE PLANNING BRIEF - CONSULTATION RESPONSE

 

There was submitted Report No 274-2004 by Director of Planning and Transportation advising the Committee of the results of the consultation stage for the above mentioned draft site planning brief and seeking approval of the brief as guidance to the owners, appropriate design team and developers.

 

The Committee agreed to:-

 

(a)note the response to the consultation stage for the draft site planning brief as indicated in Appendix 1 to the report;

 

(b)confirm the terms of the amended site planning brief as indicated in Appendix 2 to the report;

 

(c)remit the Director of Planning and Transportation to issue the final approved site planning brief to the owners, appropriate design teams and developers;

 

(d)remit the Director of Planning and Transportation to serve an emergency Tree Preservation Order on trees around Pitalpin House; and

(e)refer the final site planning brief to the Development Quality Committee as a relevant material planning consideration.

 

VII QUALITY OF LIFE FOOTPATH REPAIRS

 

There was submitted Joint Report No 269-2004 by Director of Planning and Transportation and Director of Housing updating the Committee on progress with the city-wide survey of housing footpaths and seeking authority to commence a programme of footpaths repairs for 2004/2006.

 

The Committee agreed to:-

 

(a)note the contents of this report and agree the prioritisation of footpath repairs in accordance with Appendix 1 and 2 to the report; and

 

(b)authorise the City Engineer to obtain tenders for carrying out this work based on the Unit Rate Contract for minor roadworks.

 

VIII ALBERT STREET FACADE ENHANCEMENT GRANT SCHEME

 

There was submitted Report No 273-2004 by the Director of Planning and Transportation advising of an application from the proprietor of 169-171 Albert Street for a grant under the above mentioned scheme.

 

The Committee approved an estimated grant of 9,170.

 

IX PITKERRO ROAD SERVICE ROAD - PROHIBITION OF DRIVING

 

There was submitted Report No 267-2004 by Director of Planning and Transportation proposing the closure of Pitkerro Road Service Road to through traffic.

 

The Committee approved the preparation of a Traffic Regulation Order to close the service road, as detailed in the report.

 

X DUNDEE CITY COUNCIL (SEAGATE/GELLATLY STREET/COMMERCIAL STREET AREA, DUNDEE) (VARIATION OF TRAFFIC REULATIONS) ORDER 2004

 

There was submitted Agenda Note AN181-2004 making reference to Article X of the minute of meeting of this Committee of 27th January, 2003 authorising the preparation of an Order to introduce more flexible loading arrangements at Seagate/Gellatly Street to ease servicing of adjacent properties, and to adjust the loading facility in Commercial Street near Exchange Street to protect an access.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, objections were received from Strathtay Scottish Omnibuses and Travel Dundee.

 

The Committee agreed to authorise publication of the Order as drafted despite the objection.

 

XI CLOAN ROAD - TRAFFIC MANAGEMENT ALTERATIONS

 

There was submitted Report No 268-2004 by the Director of Planning and Transportation proposing improvements to road safety and residential traffic circulation at Cloan Road, between Fredrick Street and Strathmartine Road.

 

The Committee approved the preparation of the necessary Traffic Regulation Order to make Cloan Road one-way and to effect changes to the waiting restrictions as indicated in the report.

 

XII ARDLER REGENERATION - COMPULSORY PURCHASE ORDER, ROSEMOUNT ROAD

 

There was submitted Report No 271-2004 by Director of Planning and Transportation seeking authority to invoke compulsory purchase powers in order to secure the carrying out of the redevelopment of Ardler.

 

The Committee agreed to authorise the Depute Chief Executive (Support Services) to initiate Compulsory Purchase Procedures to acquire all interests at 1006, 1028 and 1114 Rosemount Road, and further authorised onward disposal of these properties at cost to Sanctuary Scotland Housing Association Ltd once purchase had been completed, and remitted to the Depute Chief Executive (Support Services) to obtain agreement with Sanctuary Scotland Housing Association Limited with regard to recovery of legal fees.

 

XIII ATTACHMENT OF CHRISTMAS DECORATION AND OTHER FIXTURES TO LIGHTING COLUMNS

 

There was submitted Joint Report No 73-2004 by Director of Planning and Transportation and Director of Economic Development highlighting the risks and possible consequences of attaching Christmas decorations and other fixtures to lighting columns and advising of ongoing work being carried out to find an alternative solution to this problem.

 

The Committee agreed to continuation of this work and a future report being prepared by Director of Economic Development into possible solutions and the outcome of discussions with Local Traders.

 

XIV STREET LIGHTING - NEW WHITE LIGHT LANTERN REPLACEMENTS 2004/05 AS PART OF THE QUALITY OF LIFE FUNDING

 

Councillor Roberts declared a non-financial interest in this item by virtue of being resident in one of the streets which would benefit from the replacements.

 

There was submitted Report No 254-2004 by Director of Planning and Transportation seeking approval to replace the existing old sox (orange light) street lighting lanterns in a number of areas with new white light lanterns.

 

The Committee agreed to:-

 

(a)approve the proposed programme of replacement of street lighting lanterns in the areas identified in Appendix 1 to the report, to white light; and

 

(b)authorise the City Engineer to prepare orders with Tayside Contracts under the existing Best Value Partnering Agreement at a cost of not exceeding 400,000.

 

XV REQUEST PERMISSION FOR SERVICE OF TREE REPLACEMENT NOTICE

 

There was submitted Report No 256-2004 seeking the agreement of the Committee to allow the service of a Tree Replacement Notice at "Woodcroft" 69 Dundee Road, Broughty Ferry, Dundee.

 

It was agreed to remit to the Director of Planning and Transportation, in consultation with the Depute Chief Executive, to serve a Tree Replacement Notice under the terms of Section 168 of the Town and Country Planning (Scotland) Act 1997 on the owners of the property of "Woodcroft", 69 Dundee Road, Broughty Ferry, Dundee who had failed to replace approximately 17 trees after unlawfully felling them.

 

XVI CONFIRMATION OF TREE PRESERVATION ORDERS

There was submitted Agenda Note AN182-2004 advising the Committee that the Council had made provisional Tree Preservation Orders on the above mentioned sites due to their arboreal and visual amenity. The Committee authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Orders.

 

XVII UNIT RATE CONTRACT FOR ROAD MAINTENANCE AND OTHER MINOR ROADWORKS APRIL 2004 - MAY 2005

 

There was submitted Report No 259-2004 by the Director of Planning and Transportation detailing the Unit Rate Contract for Road Maintenance and other Minor Roadworks submitted by Contractors from Dundee City Council's Current Select Tender List of Contractors.

 

The Committee approved acceptance of the Unit Rate Contract for the period of April 2004 to May 2005, as detailed in the report.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in Paragraphs 6 and 9 of Part 1 of Schedule 7(A) of the Act.

 

XVIII SALE OF GROUND TO THE REAR OF 187 PERTH ROAD

 

There was submitted Agenda Note AN183-2004 relative to the above.

 

The Committee approved the disposal of an area of ground at the rear of 187 Perth Road to Mr & Mrs G Morrison on terms and conditions negotiated by Director of Economic Development, and remitted to the Depute Chief Executive (Support Services) to conclude the necessary legal formalities.
