I ANGUS LOCAL PLAN 2003 - CONSULTATIVE DRAFT

 

There was submitted Report No 272-2003 by Director of Planning and Transportation advising the Committee of the publication of the Angus Local Plan 2003 - Consultative Draft and outlining the implications of the Development Strategy it contained.

 

The Committee agreed to:-

 

(a) note the publication of the Angus Local Plan 2003 - Consultative Draft; and

 

(b) remit the Director of Planning and Transportation to submit a response to Angus Council highlighting the concern regarding the Housing land allocations.

 

The Convener and Councillor Rolfe declared an interest in the abovementioned item.

 

II ROAD SAFETY PROGRESS REPORT

 

There was submitted Report No 301-2003 by the Director of Planning and Transportation advising the Committee of the progress made in reducing road accident casualties in Dundee.

 

The Committee noted the progress made in reducing road accident casualties and endorsed the current policy of the Department in targeting pedestrian injury accidents.

 

III 20 MPH SPEED LIMITS

 

There was submitted Report No 286-2003 by the Director of Planning and Transportation advising the Committee of recent Scottish Executive guidance on the implementation of 20 mph speed limits and the recommended selection process.

 

The Committee agreed to:-

 

(a) note the extension for the three 20 mph sites in Dundee to the year 2007;

 

(b) request that the Director of Planning and Transportation examines all the current "Traffic Calmed" areas in the City to determine the feasibility and cost effectiveness of introducing 20 mph speed limits to these areas and report back to Committee with the funding implications; and

(c) reaffirm the commitment to the existing policy of prioritising the pedestrian accident injury sites for analysis and treatment prior to any consideration of further 20 mph sites.

 

IV DUNDEE TECHNOLOGY PARK - REQUEST FOR WAIVER OF SECTION 50 (NOW SECTION 75AGREEMENT)

 

Reference was made to Article IV(I) of the minute of meeting of the Development Quality Committee of 31st March, 2003 wherein a planning application for the erection of 16,500 square feet of Class 4 office development on a site within the Technology Park was granted permission.

 

There was submitted Agenda Note AN188-2003 advising that as the Technology Park was subject to a Section 50 (now 75) Agreement prohibiting certain office uses, Scottish Enterprise Tayside, as successors of the SDA, had requested that the Council, as statutory successors of Dundee District Council and Tayside Regional Council, grant a formal Waiver of the existing Section 50 Agreements between the former Councils and the SDA affecting the Technology Park to allow the development to proceed without being in breach of the existing planning controls and thus facilitate the project's funding.

 

The Committee agreed to formally waive the existing Section 50 Agreement to the extent noted above.

 

V PLANNING ADVICE NOTE 65: PLANNING AND OPEN SPACE

 

There was submitted Agenda Note AN191-2003 advising of the content of Planning Advice Note (PAN) 65 which raised the profile of open space as a planning issue by demonstrating good practice with regards to open space provision, management and maintenance, drawing heavily on the "Rethinking Open Space" research, commissioned by the Executive and published in March 2001.

 

The Committee noted the contents of the note and further noted that the Finalised Draft Dundee Local Plan Review 2003 fully accords with the contents of this PAN.

 

VI REVISED AGREEMENT GUIDANCE ON PLANNING FOR HOUSING

 

There was submitted Agenda Note AN192-2003, advising that the Scottish Executive had produced updated advice on planning and housing.

 

The Committee noted the contents of revised guidance as detailed in Scottish Planning Policy 3 "Planning for Housing" (SPP3) and Planning Advice Notes 38 "Housing Land" (PAN 38) and 67 "Housing Quality" (PAN 67).

 

It was also noted that the Finalised Dundee Local Plan Review was in line with the abovementioned guidance in relation to the development and design of housing.

 

VII NEW ROADS AND STREET WORKS (NRSWA) CODES OF PRACTICE - HIGHWAYS AUTHORITIES ANDUTILITIES COMMITTEE (HAUC) (UK) WORKING PARTY

 

There was submitted Agenda Note AN193-2003 advising the Committee that Alan Lewis, Network Management Team Leader, has been invited to join the Highways Authorities and Utilities Committee (HAUC) United Kingdom Working Party which would require attendance at periodic meetings (estimated 3 or 4 times per year) in London.

 

The Committee noted accordingly.

VIII NEW ROADS

 

APPLICATION FOR ROAD CONSTRUCTION CONSENT AND LIST OF PUBLIC ROADS

 

There was submitted Agenda Note 190-2003 detailing the undernoted application for road construction consent.

The Committee approved the application subject to conditions agreed with the applicant, and noted the suggestions for new street names of Harefield Place or Harefield Street.

 

It was further agreed that on satisfactory completion of this road and, if so requested by the applicants, it be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

IX DUNDEE CITY COUNCIL (ELIZA STREET AND ALBERT STREET, DUNDEE) (VARIATION OF TRAFFICREGULATIONS) ORDER 2003

 

There was submitted Agenda Note AN194-2003 making reference to Article XIV of the minute of meeting of this Committee of 27th January, 2003 wherein the Committee authorised the preparation of an Order, the effect of which would be to alter the access to Eliza Street from Albert Street following the transfer of most of the through traffic from Albert Street to Dura Street.

 

It was reported that the Order was duly drafted and during the statutory consultation period no adverse comments were received. Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

X SOCIAL INCLUSION PARTNERSHIP FUND 2002/2003 - STOBSWELL FACADE ENHANCEMENT

 

There was submitted Agenda Note AN212-2003 advising the Committee that the Neighbourhood Resources and Development Department had advised the Director of Planning and Transportation that a sum of 12,000 had been made available under the Social Inclusion Partnership Fund 2002/2003 to complement the Planning and Transportation Facade Enhancement Grant Scheme for Stobswell. One request for grant assistance had been received from S. & D. Properties, 140 Albert Street and the Director of Planning and Transportation had recommended the offer of a grant of 1,662.

 

In view of the short period before the end of the financial year, and the fact that no budget was in place for financial year 2003-2004, approval was given by the Director of Planning and Transportation in consultation with the Convener of the Planning and Transportation Committee and spokesperson for the major and minor opposition groups.

 

The Committee noted the above.

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting during consideration of the undernoted item on the grounds that the business involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part 1 of Schedule 7(A) of the Act.

 

XI QUEEN STREET CAR PARK, BROUGHTY FERRY, DUNDEE - LAND COMPENSATION (SCOTLAND) ACT 1973- SECTION 48 - REQUEST FOR PAYMENT

 

There was submitted Agenda Note AN195-2003 making reference to Article XVII of the minute of meeting of this Committee of 24th February, 1997 wherein it was noted that a Compulsory Purchase Order had been confirmed in respect of the former car display area in Queen Street, Broughty Ferry, Dundee.

 

It was reported that the former owners were entitled to claim compensation and the District Valuer had reported that provisional agreement in their claim had been reached. The former owners had now applied under Section 48 of the Land Compensation (Scotland) Act 1973 to receive an advance payment on account of the compensation. In terms of Section 48 this advance payment amounted to 90% of the provisionally agreed sum. In addition, in terms of Section 48(A) of the Land Compensation (Scotland) Act 1973 they are entitled to receive payment of interest on the provisionally agreed sum for the date of entry until payment of the advance payment and also annually thereafter, interest on the unpaid balance if this interest exceeds 1,000.

 

The Committee approved payment of the advance payment together with the interest due thereon and instructed the Director of Support Services to finalise the advance payment, having noted that a further report would be submitted in due course when final agreement had been reached.
