I DEVELOPMENT BRIEF - RIVERSIDE DRIVE, DUNDEE - FORMER SAINSBURY HOMEBASE DIY STORE

 

There was submitted Report No 7-2003 by the Director of Planning and Transportation advising the Committee of the outcome of consultations on the abovementioned Development Brief contents with the local Community Council and other interested parties.

 

The Committee agreed to:-

 

(i) note the consultees' comments on the Development Brief;

 

(ii) approve the finalised Development Brief and refer it to the Development Quality Committee as a material consideration in the determination of planning applications; and

 

(iii) advise the owners of the site that the Development Brief is to remain unchanged.

 

II DEVELOPMENT BRIEF - PARKER STREET, DUNDEE

 

There was submitted Report No 10-2003 by the Director of Planning and Transportation advising the Committee of the outcome of consultations on the abovementioned Development Brief contents with interested parties.

 

The Committee agreed to:-

 

(i) note the consultees' comments on the Development Brief;

 

(ii) approve the finalised Development Brief and refer it to the Development Quality Committee as a material consideration in the determination of planning applications; and

 

(iii) remit the Director of Economic Development to include the Development Brief in any sales' particulars for the site.

 

III CITY CENTRE FACADE ENHANCEMENT GRANT SCHEME AND HILLTOWN FACADE ENHANCEMENT GRANT SCHEME

 

There was submitted Report No 20-2003 by the Director of Planning and Transportation advising the Committee as to the progress being made in implementing the Facade Enhancement Grant Scheme (FEGS) in the City Centre and Hilltown.

 

The Committee agreed to the undernoted grants in the City Centre and Hilltown:-

IV SCOTTISH PLANNING POLICY 2: "ECONOMICDEVELOPMENT"

 

There was submitted Report No 27-2003 by the Director of Planning and Transportation advising the Committee of the publication of Scottish Planning Policy 2: "Economic Development" and outlining some of its main provisions for land use planning in Dundee.

 

The Committee agreed to:-

 

(i) note the context set by the new Scottish Planning Policy (SPP) for the development plan and development control functions of the Council;

 

(ii) note that the recently approved Dundee and Angus Structure Plan affirms the principles established in the guidance; and

 

(iii) agree that the Finalised Dundee Local Plan Review is in line with SPP2.

 

V FINALISED DUNDEE LOCAL PLAN REVIEW

 

There was submitted Report No 48-2003 by the Director of Planning and Transportation seeking the Committee's approval of the Finalised Dundee Local Plan Review detailing the Council's recommended Development Strategy in accordance with the recently approved Dundee and Angus Structure Plan.

 

The Committee agreed to:-

 

(i) approve the Finalised Dundee Local Plan Review;

 

(ii) remit the Director of Planning and Transportation to make the necessary arrangements to print the Finalised Local Plan and thereafter advertise its availability and invite formal objections;

 

(iii) remit the Director of Planning and Transportation to report back to Committee with details of formal objections submitted and to recommend how the Council should respond to these;

 

(iv) note that objections submitted to the Finalised Local Plan and not withdrawn will require to be considered at a Public Local Inquiry convened by the City Council;

 

(v) agree that the Finalised Local Plan be referred to the Development Quality Committee for information as a material consideration in making planning decisions including the determination of planning applications;

(vi) approve the proposal to make a charge of 15.00 for copies of the Finalised Local Plan, with the exception of the statutory consultees who will receive a free copy: Copies of the Plan would also be available for inspection free of charge at libraries, Council offices and on the Internet; and

 

(vii) reaffirm the Council's commitment to any housing developments in the east of the city being restricted to small numbers of high quality dwellings which must be in accordance with the detailed terms of the Finalised Local Plan Review.

 

VI THE SCOTTISH SAFETY CAMERA PROJECT 2003

 

There was submitted Report No 12-2003 by the Director of Planning and Transportation advising the Committee of an initiative to introduce a cost recovery system for speed and red light running safety cameras within Scotland at identified high risk accident sites.

 

The Committee approved Dundee City Council's participation in principle in a Cost Recovery Local Partnership Scheme between Dundee City Council, the neighbouring authorities of Angus Council and Perth and Kinross Council, Tayside Police and the Scottish Executive, subject to a satisfactory business case being made.

 

VII MELFORT PLACE - STOPPING-UP

 

There was submitted Report No 13-2003 by the Director of Planning and Transportation relative to a proposal to improve road safety by the construction of a new access and the stopping-up of the existing access from Old Glamis Road to Melfort Place.

 

The Committee approved the preparation of an Order under the powers of the Roads (Scotland) Act 1984 to stop-up a length of Melfort Place and to delete it from the List of Public Roads as detailed in the report.

 

VIII MELFORT PLACE - PROPOSED ALTERATIONS

 

There was submitted Agenda Note AN15-2003 advising that, following the demolition of Trottick, Mains and Claverhouse Courts, the access to the remaining properties in Melfort Place involved negotiating a corner with poor advance visibility and it was proposed to provide a new junction onto Old Glamis Road directly from Melfort Place. These works would include traffic calming measures and would reduce speed and improve sightlines.

 

The Committee agreed that these works be carried out as an extension to the existing contract with Torith Limited for the Road Safety Measures 2002/03 - Clepington Road/Strathmartine Road, based on competitive rates for similar works at an estimated additional cost of 25,000.

 

IX WHITFIELD COMMUNITY WOODLAND

 

On a reference to Article XI of the minute of meeting of the Housing Committee of 20th January 2003 there was submitted Joint Report No 825-2002 by the Director of Planning and Transportation, Director of Housing and Director of Contract Services seeking approval of the proposal to create an estate wide community woodland in Whitfield

 

The Committee agreed to:-

 

(i) approve the details of the proposal and note the development of an estate wide framework of future developments which will be reported to future Committees;

 

(ii) remit appropriate officers to begin consultations on the estate wide programme of community woodlands within interested community groups;

 

(iii) remit appropriate officers to reach agreement with a local training organisation regarding training placements;

(iv) approve the allocation of parts of the budgets already assigned within the Housing Capital Expenditure Plan to the projects;

 

(v) accept the offer from Dundee Contract Services of 135,000 for the first scheme at Dunbar Park; and

 

(vi) approve the overall expenditure on this first scheme of 150,000 which includes further allowances of 15,000 for fees and contingencies.

 

X SEAGATE/GELLATLY STREET/COMMERCIAL STREET - VARIATION OF TRAFFIC REGULATIONS

 

There was submitted Report No 14-2003 by the Director of Planning and Transportation relative to adjustments necessary to resolve specific problems of access and servicing following the implementation of traffic measures in the above area in late 2000.

 

The Committee approved the preparation of a Traffic Regulation Order to vary the restrictions in the area to take into account servicing and access requirements as detailed in the report.

 

XI TRAFFIC ORDERS ETC

 

There was submitted Agenda Note AN23-2003 relative to the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (OFF-STREET) (ARTS AND SCIENCE CENTRE CAR PARKS) (VARIATION) ORDER 2003

 

Reference was made to Article X of the minute of meeting of this Committee of 25th February 2002 instructing and authorising the preparation of an Order to restrict the use of the Arts and Science Centre car parks for patrons of these establishments only.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received; thereafter the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(b) ROAD HUMPS (SCOTLAND) REGULATIONS 1998 - GLENEAGLES AVENUE AND GLENEAGLES ROAD, DUNDEE

 

Reference was made to Article V of the minute of meeting of this Committee of 28th October 2002 approving the introduction of speed cushions in Gleneagles Avenue and Gleneagles Road, Dundee with a view to improving road safety by slowing traffic speeds.

 

It was reported that during the statutory consultation and public notice period no adverse comments were received.

 

The Committee therefore authorised the scheme for the introduction of speed cushions in Gleneagles Avenue and Gleneagles Road.

 

(c) DUNDEE CITY COUNCIL (KINGSWAY EAST AND LONGTOWN ROAD, DUNDEE) (PROHIBITION OF DRIVING AND ONE-WAY TRAFFIC) ORDER 2003

 

Reference was made to Article I of the minute of meeting of this Committee of 25th March 2002 instructing and authorising the preparation of an Order to:-

 

(i) improve safety by preventing traffic entering Kingsway East and merging from the right: a suitable alternative route exists via the eastbound carriageway of Kingsway East to the roundabout at Moffat Road thence via the westbound carriageway of Kingsway East; and

(ii) improve local traffic circulation in the Mid Craigie area by allowing traffic from Longtown Road easy access to Pitairlie Road and the local primary schools.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received; thereafter the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(d) DUNDEE CITY COUNCIL (BLACKNESS STREET, DUNDEE) (ONE-WAY TRAFFIC) ORDER 2003

 

Reference was made to Article V of the minute of meeting of this Committee of 29th April 2002 instructing and authorising the preparation of an Order to remove a turning movement in order to facilitate the provision of a pedestrian crossing on Blackness Road.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received; thereafter the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(e) DUNDEE CITY COUNCIL (LOGIE STREET AND LOONS ROAD, DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2003

 

Reference was made to Article II of the minute of meeting of this Committee of 24th June 2002 instructing and authorising the preparation of an Order to relieve congestion in the vicinity of a busy junction and to increase parking space following realignment of the Logie Street/Loons Road junction.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received; thereafter the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(f) DUNDEE CITY COUNCIL (MENZIESHILL AREA, DUNDEE) (CONTROLLED PARKING ZONE - RESIDENTS PARKING PERMIT SCHEME) ORDER 2003

 

Reference was made to Article VII of the minute of meeting of this Committee of 27th May 2002 instructing and authorising the preparation of an Order to relieve congestion, remove commuter parking, improve access to houses in the area and improve parking for residents.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period comments were received from the Menzieshill Community Action Group. However, on 2nd December 2002 the Planning and Transportation Committee authorised publication of the Order as drafted. Subsequently, the Order was duly advertised and three objections were received.

 

The Committee agreed to make the Order despite the objections.

 

(g) ROAD HUMPS (SCOTLAND) REGULATIONS 1998 - WESTPORT AND OLD HAWKHILL, DUNDEE

 

Reference was made to Article XIII of the minute of meeting of this Committee of 2nd December 2002 approving the introduction of speed cushions in Westport and Old Hawkhill, Dundee, with a view to improving road safety by slowing traffic speeds.

 

It was reported that during the statutory consultation and public notice period one objection was received.

The Committee agreed to authorise the scheme for the introduction of speed cushions in Wesport and Old Hawkhill despite the objection.

 

(h) ROAD HUMPS (SCOTLAND) REGULATIONS 1998 - FINTRY ROAD, DUNDEE

 

Reference was made to the Article XIII of the minute of meeting of this Committee of 2nd December 2002 approving the introduction of speed cushions in Fintry Road, Dundee, with a view to improving road safety by slowing traffic speeds.

 

It was reported that during the statutory consultation and public notice period no adverse comments were received.

 

The Committee therefore agreed to authorise the scheme for the introduction of speed cushions in Fintry Road.

 

(I) ROAD HUMPS (SCOTLAND) REGULATIONS 1998 - HIGH STREET, LOCHEE, DUNDEE

 

Reference was made to Article XIII of the minute of meeting of this Committee held on 2nd December 2002 approving the introduction of speed cushions in High Street, Lochee, Dundee, with a view to improving road safety by slowing traffic speeds.

 

During the statutory consultation and public notice period two objections were received. As a result of these comments it is proposed to progress this scheme with the omission of the proposed zebra crossing.

 

The Committee agreed to authorise the scheme for the introduction of speed cushions in High Street, Lochee.

 

XII CONFIRMATION OF TREE PRESERVATION ORDER (NO 4) 2002 "THE ARBORETUM" TOM McDONALD AVENUE,DUNDEE

 

There was submitted Agenda Note AN20-2003 advising that a Provisional Tree Preservation Order at the above location was made on 19th August 2002. This was to protect the arboreal amenity of this area of Ninewells.

 

The Committee agreed to note the Order and instruct the Director of Planning and Transportation, in consultation with the Director of Support Services, to confirm the Provisional Tree Preservation Order.

 

XIII CONFIRMATION OF TREE PRESERVATION ORDER (NO 5) 2002 - KINGS CROSS HOSPITAL, CLEPINGTON ROAD, DUNDEE

 

There was submitted Agenda Note AN19-2003 advising that a Provisional Tree Preservation Order at the above location was made on the 16th August 2002. This was to protect the arboreal amenity of and to preserve existing trees from future development at land forming Kings Cross Hospital.

 

The Committee agreed to note the Order and instruct the Director of Planning and Transportation, in consultation with the Director of Support Services, to confirm the Provisional Tree preservation Order.

 

XIV ELIZA STREET CLOSURE

 

There was submitted Agenda Note AN17-2003 advising that within the ongoing programme of works in the North East Corridor it had been identified that the current closure of Eliza Street at its junction with Albert Street would be more appropriate at the Dura Street junction.

 

The Committee therefore approved the preparation of a Traffic Regulation Order to relocate the point of closure of Eliza Street from the Albert Street junction to the Dura Street junction.

 

XV CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - PROPOSED NEW STREET NAMES

 

There was submitted Agenda Note AN22-2003 detailing proposed new street names.

XVI NEW ROADS - APPLICATIONS FOR ROAD CONSTRUCTION CONSENT AND LIST OF PUBLIC ROADS

 

There was submitted Agenda Note AN21-2003 advising that the undernoted applications had been submitted and the Director of Planning and Transportation had recommended that they be approved subject to conditions which had been agreed with the applicants:

The Committee approved accordingly and invited the view of members regarding new street names for the above roads.

 

The Committee agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

XVII TENDER RECEIVED BY DIRECTOR OF PLANNING AND TRANSPORTATION

 

There was submitted Report No 43-2003 by the Director of Planning and Transportation detailing tenders received in respect of a Public Transport Information System.

 

The Committee agreed to accept the offer from Steer Davies Gleave in the sum of 919,367, the cost of which would be met in full from the Scottish Public Transport Fund allocation.

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting on the grounds that the business involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7(A) of the Act.

 

XVIII SITE AT VICTORIA STREET/CRESCENT LANE, DUNDEE

 

There was submitted Agenda Note AN28-2003 by the Director of Planning and Transportation relative to a request to purchase a small area of land amounting to 56.6 square metres at the above area.

 

The Committee approved the disposal of the land on the terms and conditions detailed in the note.
