I TRAFFIC MANAGEMENT - CITY CENTRE - WHITEHALL STREET/UNION STREET

 

There was submitted Report No 475-2002 by the Director of Planning and Transportation informing the Committee of a proposed design competition to provide high quality public transport facilities in the City Centre as part of the "Bringing Confidence into Public Transport" project and the need to commence the Traffic Regulation Order process necessary in Whitehall Street and Union Street to protect the structural condition of the carriageway in Union Street and enhance public transport operations in the Whitehall Street area.

 

The Committee approved the preparation of Traffic Regulation Orders for restrictions to traffic in Union Street and Whitehall Street.

 

II WAITING RESTRICTION REVIEW - LOGIE STREET AT LOONS ROAD

 

There was submitted Report No 476-2002 by the Director of Planning and Transportation informing the Committee of the proposed on-street parking on the east side of Logie Street at the retail frontage immediately south of Loons Road.

 

The Committee approved the preparation of a Traffic Regulation Order to relocate the on-street parking from the shop frontages to the laybys provided within the revised junction layout.

 

III ROAD SAFETY MEASURES IMPLEMENTATION 2002/03

 

There was submitted Report No 488-2002 by the Director of Planning and Transportation advising the Committee of all the locations in the city where road safety intervention measures had been requested from various sources, informing the Committee of locations where it was considered conditions warranted action, prioritising those locations and seeking Committee approval for a programme of road safety initiatives in 2002/03 based on those priorities and the financial resources available.

 

The Committee agreed:-

 

(a) that Road Safety Schemes be implemented in priority order as set out in Appendix A to the report; and

 

(b) that two portable Speed Indicator Display Signs be purchased and utilised in Dundee in partnership with Tayside Police.

 

IV NORTH EAST ARTERIAL CAPITAL EXPENDITURE - ALBERT STREET ENVIRONMENTAL IMPROVEMENTS

 

There was submitted Report No 478-2002 by the Director of Planning and Transportation seeking approval for the allocation of 472,000 for the North East Capital Budget Expenditure 2002/03.

 

The Committee agreed to remit the Director of Planning and Transportation to implement the following improvement works to upgrade the whole of the Albert Street District Centre:-

 

repaving of the Stobswell Junction footway with new slabs and associated street furniture formation of build out areas to provide on-street parking facilities and bus stops and services upgrading of the street lighting to Albert Street upgrading and re-orientation of the Dura Street car park upgrading and realignment of the Ferguson Street car park.

 

V RESPONSES TO CONSULTATION DRAFTS OF REVISED GOVERNMENT GUIDANCE ON PLANNING FOR HOUSING

 

There was submitted Report No 498-2002 by the Director of Planning and Transportation seeking the Committee's approval for the submission of the comments on behalf of the City Council to the Scottish Executive in relation to the proposed revisions of National Planning Policy Guideline 3 (NPPG3) - Planning for Housing; and Planning Advice Note 38 (PAN38) - Housing Land.

 

The Committee noted and endorsed the report prepared for submission to the Scottish Executive as the City Council's response to the consultation drafts of NPPG3: Planning for Housing and PAN38: Housing Land.

 

VI THE DUNDEE LOCAL PLAN REVIEW CONSULTATION DRAFT

 

There was submitted Report No 242-2002 by the Director of Planning and Transportation seeking the Committee's approval for the publication of the text of a Consultation Draft of the Dundee Local Plan Review 2002 and to update and roll forward the existing Plan which was adopted in 1998.

 

The Committee:-

 

(a) approved the Review of the Dundee Local Plan for public consultation purposes;

 

(b) noted that the Consultation Draft Plan would not count as a Material Consideration in the determination of Planning Applications;

 

(c) approved the proposal to make a nominal charge of 5.00 for copies of the Draft Local Plan except for statutory consultees and voluntary organisations: copies of the Plan would also be available for inspection, free of charge, at the Main Reception, Tayside House, and in the Central Wellgate and all Branch Libraries; and

 

(d) remit the Director of Planning and Transportation to report back to Committee on the results of the consultation process prior to bringing forward a Finalised Draft of the Local Plan Review before the end of the calendar year.

 

VII ROAD AND BRIDGE MAINTENANCE WORKS - ADDITIONAL FUNDING

 

There was submitted Report No 511-2002 by the Director of Planning and Transportation seeking approval for the expenditure of the additional revenue funding allocated to Dundee City Council for maintenance of roads and bridges.

 

The Committee agreed to:-

 

(a) note the requirement to carry out risk assessments and any consequent works associated with road/rail interfaces; and

 

(b) approve the expenditure of the additional funding made available for dealing with the above and the backlog in road and bridge maintenance works.

 

VIII THE FINALISED DUNDEE AND ANGUS STRUCTURE PLAN

 

It was reported that the Finalised Dundee and Angus Structure Plan had been submitted to the Scottish Executive in February of this year and the Executive, on 7th June 2002, had published Ministers' Draft Modifications to the Plan.

 

There was submitted Agenda Note AN129-2002 advising the Committee that in the circumstances, it was necessary for the Authorities to respond to these by the middle of July. Due to the recess period, it was agreed that if there were no substantive modifications proposed which would significantly alter the development strategy of the Structure Plan, that the Director of Planning and Transportation, in consultation with the Convener and spokespersons for the opposition groups, be authorised to approve the Council?s response, in consultation with Angus Council, in order to comply with the Scottish Executive?s timetable.

 

It was noted that the full response would be considered by the Dundee and Angus Joint Structure Plan Panel as normal and subsequently reported to the Committee at its meeting in August.

 

IX CONFIRMATION OF TREE PRESERVATION ORDER - 7 HILL ROAD, BROUGHTY FERRY

 

There was submitted Agenda Note AN130-2002 advising members that on 6th February, the Council made a Provisional Tree Preservation Order on the above mentioned site in order to protect the two individual trees within the garden ground of the property and a woodland area adjoining the said garden ground.

 

The Committee authorised the Director of Support Services and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Order.

 

X CONFIRMATION OF TREE PRESERVATION ORDER, 28 LONG LANE, BROUGHTY FERRY

 

There was submitted Agenda Note AN131-2002 advising members that on 6th February, the Council made a Provisional Tree Preservation Order on the above mentioned site in order to protect the trees within an area of ground that was to be developed for housing.

 

It was reported that one representation on behalf of the owner had been received noting that Tree No T2 had already been granted consent for removal.

 

The Committee authorised the Director of Support Services and the Director of Planning and Transportation to undertake the necessary procedures and confirm the Tree Preservation Order subject to the modification that Tree Preservation Order No T2 be deleted therefrom.

 

XI DUNDEE CITY COUNCIL (HIGH STREET AND REFORM STREET, DUNDEE) (EXEMPTION FOR WEDDINGVEHICLES) ORDER 2001

 

Reference was made to Article XXII of the minute of meeting of the Planning and Transportation Committee of 25th June 2001 instructing and authorising the preparation of an Order to enable vehicles carrying wedding parties to wedding ceremonies in the City Chambers to gain access to High Street and exit via Reform Street.

 

There was submitted Agenda Note AN132-2002 informing the Committee that the proposed Order was duly drafted and during the statutory consultation an objection was received from the Chief Constable. However, on 25th March 2002, the Planning and Transportation Committee authorised publication of the Order as drafted.

 

The Order was duly advertised and there were no further objections. The objection received from the Chief Constable had not been withdrawn.

 

The Committee agreed to make the Order as advertised.

 

XII DUNDEE CITY COUNCIL (NINEWELLS HOSPITAL AREA, DUNDEE) (VARIATION OF WAITINGRESTRICTIONS) ORDER 2002

 

Reference was made to Article X of the minute of meeting of the Planning and Transportation Committee of 25th February 2002 instructing and authorising the preparation of an Order to revoke unnecessary restrictions on unadopted roads following the decision of the Car Park Operator to enforce the restrictions privately.

 

There was submitted Agenda Note AN133-2002 informing the Committee that proposed Order was duly drafted and during the statutory consultation period an objection was received from Travel Dundee and was later withdrawn.

 

The Committee agreed to authorise formal publication of the order as drafted.

 

XIII TENDER RECEIVED BY CITY ENGINEER

 

There was submitted Report No 548-2002 by the Director of Planning and Transportation detailing tenders received in respect of environmental improvements to Commercial Street North.

 

The Committee approved the lowest offer from Tayside Contracts in the sum of 130,141.80, together with allowances, giving a total project cost of 248,000.

 

XIV CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - PROPOSED STREET NAMES

 

There was submitted Agenda Note AN134-2002 detailing proposed new street names.

 

(a) Reference was made to Article XVII of the minute of meeting of the Planning and Transportation Committee of 25th February 2002 wherein the Committee agreed to name streets at the former Taybank Works site adjacent to Baxter Park Terrace, "Wurzburg Glebe" and "Wurzburg Place".

 

The Committee agreed to suspend Standing Order No 38(i) in order to consider this item.

 

It was reported that subsequently, a letter and petition containing 128 signatures had been received from local residents and house purchasers requesting that the Council reconsider its decision on the grounds that the name was incongruous in the context of proposals for the restoration of Baxter Park.

 

Accordingly the Committee agreed that these streets be named:-

 

"Baxter Park Court" and "Baxter Park Glebe".

 

However, it being noted that it was appropriate that the Council's strong Twinning Links with Wurzburg be recognised in the street naming procedures, the Committee agreed that the access road to an approved development on the north side of Tom McDonald Avenue at the Medipark be named "Wurzburg Court".

 

(b) Reference was made to Article XIII of the minute of the meeting of the Planning and Transportation Committee of 27th May 2002 wherein the naming of a road within the former DRI development as "Smillie Court" was deferred at the request of the developer who wished an opportunity to make further representations.

 

It was reported that the developer's agent had argued that to name the street "Smillie" would not convey the most appropriate image for a street within a new prestigious development, and it was therefore recommended that this road be named Goodwin Court.

 

The Convener, seconded by Councillor Shimi, moved that the road be named Goodwin Court.

 

As an amendment, Councillor Barrie, seconded by Councillor FitzPatrick, moved that the road be named Smillie Court.

 

On a division, there voted for the motion - the Convener, Lord Provost Letford and Councillors de Gernier, Wright, Ward, Shimi, Farquhar, Glen, Rolfe, Wallace and Borthwick (11); and for the amendment - Councillors Barrie, Richard Beattie, Dawson, Sawers, FitzPatrick, Petrie, Guild, Dave Beattie, Fordyce, Bowes, Powrie, Mackie and Scott (13) - whereupon the amendment was declared carried.
