The Committee noted that application (a) above had been withdrawn and agreed that the remaining applications be granted.
II AKEIR DEVELOPMENTS LTD - ONE 2 ONE CALL CENTRE, DUNDEE TECHNOLOGY PARK - REQUEST FOR WAIVER OF SECTION 50 (NOW SECTION 75) AGREEMENT
It was reported that Akeir Developments Limited had requested that the Council as statutory successors of Dundee District Council and Tayside Regional Council, grant a formal Waiver of the two existing Section 50 Agreements between the former Councils and the SDA affecting the Technology Park, which prohibited certain office uses, to allow the development to proceed without being in breach of the existing planning controls and thus facilitate the project's funding.
The Committee formally waived the existing Section 50 Agreements to the extent noted above it being noted that SET, successors to SDA, had indicated their willingness to grant such a waiver.
III REDEVELOPMENT OF SHOPPING PRECINCT AT TURNBERRY AVENUE
Reference was made to the minute of meeting of this Committee of 25th September, 2000 which advised that the Compulsory Purchase Order covering the shopping precinct and the owner occupied flats above had been confirmed by the Scottish Ministers and that the properties had vested in the City Council on 30th November, 2000.
It was reported that timescales for the demolition and redevelopment of the Turnberry Avenue Shopping Centre were now being developed and this would be phased to allow the continuing operation of some shops with a probable first phase start in April, 2001.
The Committee agreed:-
(a)that the site be disposed of to Sanctuary Scotland Housing Association on the terms and conditions to be agreed and at the District Valuer's valuation; and
(b)it be remitted to the Director of Support Services to prepare the necessary offer and draft Disposition.
IV DUNDEE AND ANGUS JOINT STRUCTURE PLAN - CONSULTATION ARRANGEMENTS
Reference was made to the minute of meeting of this Committee of 18th December, 2000 which approved the Joint Structure Plan which was subsequently approved by Angus Council on 11th January, 2001. It was reported that it was proposed to publish the Plan for statutory consultation at the end of January, 2001 and that the plan would be free to Statutory Consultees and available for inspection at the Council offices and local libraries as well as being made available for purchase at a cost of 5.
The Committee noted that a period of approximately eight weeks would be allowed for comments and that it was proposed to consult as widely as possible within that period with statutory consultees, Community Councils, Tenants' Associations, Specific Interest Groups, a Business and Development Forum and the use of the Community Local Environment Awareness Raising Project.
V DRAFT URBAN DESIGN GUIDELINES
There was submitted Report No. 1-2001 by the Director of Planning and Transportation relative to the above.
The Committee approved the recommendations in the Report that:-
(a) the Draft Urban Design Guidelines be endorsed
(b)it be remitted to the Director of Planning and Transportation to consult with relevant Council Departments, Community Councils, Amenity Societies and Developers on the draft guidelines and to report back to Committee in August 2001, and
(c)the Urban Design Guidelines to the Development Quality Committee as a material consideration for development control purposes.
VI PLANNING AND TELECOMMUNICATIONS - CONSULTATION ON PROPOSED CHANGES TO PERMITTED DEVELOPMENT ARRANGEMENTS FOR TELECOMMUNICATIONS DEVELOPMENTS AND DRAFT NATIONAL
There was submitted Report No. 3-2001 by the Director of Planning and Transportation relative to the above.
The Committee approved the recommendations in the Report that the comments outlined in Section 7.8 of the Report be endorsed and that it be remitted to the Director of Planning and Transportation to transmit the Council's views to the Scottish Executive and to COSLA and to report back to the Committee on the outcome of the consultation exercise in due course.
VII 432 BLACKNESS ROAD - CONFIRMATION OF TREE PRESERVATION ORDER
There was submitted Report No. 4-2001 by the Director of Planning and Transportation relative to the above.
The Committee noted the serving of the Provisional Tree Preservation Order as detailed in the Report, approved the proposed boundary of the TPO and further authorised the Directors of Support Services and Planning and Transportation to undertake the necessary procedures to confirm the Order within the statutory six month period.
VIII COMMERCIAL STREET/EXCHANGE STREET DESIGN BRIEF
There was submitted Report No. 12-2001 by the Director of Planning and Transportation relative to the above.
The Committee approved the content of the Design Brief and agreed that its content be commended to the Development Quality Committee as a material consideration for development control purposes.
IX SOCIAL INCLUSION PARTNERSHIPS (SIP'S) SOCIAL SURVEY
There was submitted Report No. 15-2001 by the Director of Planning and Transportation relative to the above.
The Committee approved the implementation framework for completing the social survey as outlined in the project plan.
X BALLINARD ROAD TRAFFIC STUDY
There was submitted Report No 19-2001 by the Director of Planning and Transportation relative to the above.
The Committee noted the conclusions of the traffic study as detailed in the report and agreed that no further action be taken at this time.
XI SCOTTISH EXECUTIVE DEVELOPMENT PLAN PILOT AUDIT
There was submitted Report No 20-2001 by the Director of Planning and Transportation relative to the above.
The Committee noted the conclusions of the pilot audit as detailed in the report.
XII CONSULTATION EXERCISE FOR THE REVIEW OF WEST END CONSERVATION AREAS AND DESIGNATION OF BAXTER PARK CONSERVATION AREA
There was submitted Report No 40-2001 by the Director of Planning and Transportation relative to the above.
The Committee noted the responses and conclusions of the consultation as summarised in the report and agreed to approve the indicative boundaries of the conservation areas which were revised following the consultation exercise and otherwise approved the terms of the report.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
XIII PROPOSED EXCAMBION OF PROPERTY - 8 FORFAR ROAD/19 VICTORIA STREET
There was submitted Report No 745-2000 by the Director of Economic Development relative to the above.
The Committee approved the recommendations in the report.
XIV REDEVELOPMENT OF ARDLER SHOPPING CENTRE
(a) Short Term Leases
Reference was made to the minute of meeting of this Committee of 25th September 2000 wherein it was noted that the Compulsory Purchase Order covering the above shopping precinct and flats had been confirmed.
The Committee noted that a number of owners of the flats had expressed their desire to remain in occupation of their property subsequent to the date of vesting pending the Council's redevelopment of the shopping centre and that, in view of the timescales involved, the Director of Planning and Transportation, in consultation with the Convener and appropriate Opposition Spokespersons, had entered into appropriate short term leases with such owners on a month to month basis or other appropriate period pending the redevelopment of the shopping centre.
(b) 631 Turnberry Avenue - Compensation
The Committee noted that, in view of the timescales involved, the Director of Planning and Transportation, in consultation with the Convener and appropriate Opposition Spokespersons, had authorised payment of compensation as fixed by the District Valuer in respect of the Compulsory Purchase of the property at 631 Turnberry Avenue.
