I PLANNING APPEAL DECISION - 133 QUEEN STREET, BROUGHTY FERRY - FORMER LIMB FITTING CENTRE

 

(a) D24491 - Site at Marchfield Road/Western Cemetery, Dundee - Erection of one dwellinghouse with landscaping and new access road for Mr and Mrs Paul Sale

 

The Committee acceded to requests which had been received for deputations to be heard relative to objections to and in support of the above application. Once the deputations had stated their cases they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received Councillor Powrie, seconded by Councillor Mackie, moved refusal of the application on the grounds that (i) the proposed development is considered contrary to Policies H4 and H10 of the Dundee Local Plan 1998 by virtue of the significant impact the building will have on the privacy of the surrounding occupiers and the design of the dwellinghouse is inappropriate to the area and there are no material considerations which would justify the approval of the application contrary to the Local Plan and (ii) the proposed development is contrary to Policies BE1 and BE3 of the Dundee Local Plan 1998 in that the scale, from, siting and materials are inappropriate to the local area and there are no material considerations which would justify setting aside these Policies.

 

As an amendment Councillor Presswood, seconded by Councillor Shimi, moved approval of the application.

 

On a division there voted for the motion Councillor de Gernier, Regan, Farquhar, Sturrock, Glen, Dawson, Petrie, Guild, Fordyce, Bowes, Powrie, Mackie, Wallace, Scott and Borthwick (15); and for the amendment - The Lord Provost and Councillors Presswood, Letford, Ward, Shimi, Kemp, Richard Beattie, Sawers, FitzPatrick and Dave Beattie (10) - whereupon the motion was declared carried

 

(b) D2443 - 37- 39 Trades Lane, Dundee - Erection of Retail Units and 22 Residential Flats for Mr B Ower

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(c) D24450 'Doghouse', 13 Brown Street, Dundee - Use of Public Bar area as Restaurant outwith normal Licensing Hours for Ian Whyte

 

The Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(d) D24452 - 26 - 28 Rankine Street, Dundee - Erection of two new dwellinghouses for Mr T Anderson

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(e) D24466 - 24 - 26 Exchange Street, Dundee - Conversion of Upper Floors to form 12 flats and formation of 2 Shop Units at Ground Floor for Tayfield Investments Ltd

 

The Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(f) D24503 - 175 High Street, Lochee, Dundee - Change of Use from Retail to Amusement Arcade for Fair City Amusements Ltd

 

After considering objections received, the Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(g) D24512 - Third and attic floors, 15 Albert Square, Dundee - Change of Use from offices to 2 flats for Mr W Boyle

 

The Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(h) D24536 - 3 Shiell Street, Broughty Ferry, Dundee DD5 2TB - Change of Use from Storage area to Children's Nursery for Leanne Henderson

 

After hearing a deputation in support of the application, the Committee deferred consideration of the matter to allow further discussion between the applicant and the Planning Department.

 

(i) D24551 - 74 - 78 Strathern Road, Broughty Ferry, Dundee - Erection of 18 Flats within 4 Storey Block with Associated Garages and Car Parking

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(j) D24571 - Site 3C Ardler, Turnberry Avenue and Rosemount Road, Dundee - Demolition of Shops and Flats and the erection of 31 dwellinghouses, 37 flats, Foodstore with storage, Butcher, Post Office and 2 No of Offices

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
