I 50-60 LOCHEE ROAD - APPEAL DECISION
Reference was made to the decision of the Council on 15th June, 2000 under powers delegated to the Director of Planning and Transportation, in consultation with the Convener, to refuse planning permission in respect of the above proposal.
The Committee noted that the applicants had subsequently appealed against the foregoing decision and that the appeal had been dismissed.
II PLANNING APPEALS PERFORMANCE 1999/2000
The Committee noted Report No. 424-2000 by the Director of Planning and Transportation relative to the above.
III AMENDMENT TO PROPOSED SECTION 75 AGREEMENT TO CONTROL PHASING OF DEVELOPMENT AT FORMER DRI BUILDING
Reference was made to the minute of meeting of this Committee of 27th March, 2000 wherein a master plan was approved for the development of the former Dundee Royal Infirmary subject to conditions and to a Section 75 Agreement to control the phasing of the development.
It was reported that the applicant had requested that the Section 75 Agreement be amended to allow phases 1 and 2 of the development to proceed concurrently with the remainder of the phasing being unchanged.
The Committee agreed to the foregoing amendment to the Section 75 Agreement.
IV PLANNING APPLICATIONS
(a) DS00170 - 51 Beach Crescent, 312 King Street, Broughty Ferry, Dundee - Demolition of Social Club at 51 Beach Crescent and Pottery at 312 King Street for Building Craftsmen (Hong Kong) Ltd.
After considering objections received, the Committee refused the application on the grounds that a case for the demolition of these buildings has not been made because the proposed replacement buildings on the site are of an unacceptable scale and massing and will therefore detract from the visual amenity of the Broughty Ferry Conservation Area.
(b) D24456 - 51 Beach Crescent and 312 King Street, Broughty Ferry, Dundee - Erection of 45 Bedroom Hotel and Car Park for Building Craftsmen (Hong Kong) Ltd.
The Committee acceded to requests which had been received for deputations to be heard in support of and relative to objections to the above application. Once the deputations had stated their cases, they were thanked for their attendance and withdrew.
Thereafter the Committee refused the application on the grounds that;-
1. The proposal represents overdevelopment of the site, creating a building with a scale and massing that detracts from the visual amenity of the Broughty Ferry Conservation Area and the setting of the adjoining listed buildings to the west of the site contrary to Policy BE11 of the Dundee Local Plan 1998.
2. The proposed development will adversely affect the residential amenities enjoyed by adjoining occupiers by reason of overlooking and overshadowing and noise and disturbance from the operation of the premises and will therefore contravene Policies H4, EU27 and LT8 of the Dundee Local Plan 1998.
3. Inadequate provision is made for servicing and off street parking for the proposed development which will result in traffic congesting and parking problems on adjoining streets to the detriment of the residential amenities enjoyed by adjoining occupiers.
(c) D24490 - 'Cidhmore', Perth Road, Dundee - Erection of Garage and Associated Landscaping and Bin Stores for Trojan Metals Ltd.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
The Committee further noted that the applicant was a neighbour of the Director of Planning and Transportation and in the circumstances he had taken no part in the processing of the application or the preparation of the reports.
(d) D24550 - Dundee Port, Land East of Camperdown Street/Stannergate Road, Dundee - Erection of 30M Telecommunications Mast, Supporting 3 No Cross Polar Antenna and 2 No Microwave Dishes for One to One Communications Ltd.
The Committee noted that the above application had been withdrawn.
(e) D24576 - 147 Fintry Drive, Dundee - Erection of Temporary Building for Office Accommodation in the Car Park of Existing Offices for Abertay Housing Association.
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(f) D24581 - Broughty Ferry Railway Station, Gray Street, Broughty Ferry, Dundee - Formation of Covered Enclosures, Glazed Roofs and Installation of New Access Ramp for Railtrack FOR.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(g) DLB01796 - Broughty Ferry Railway Station, Gray Street, Broughty Ferry, Dundee - Removal for subsequent relocation, of Signal Box, Footbridge and Cabmen's Shelter and Removal of Other Associated Structures, Refurbishment of Building Facades for Railtrack PLC.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(h) D24584 - Phase 4D, Balgillo Park, Balgillo Road, Dundee - Erection of 60 Dwellinghouses and Associated Infrastructure and Development of Public Open Space and Landscaping Bund for Bett Homes.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(i) D24614 - The Post Office Building, 4 Meadowside, Dundee - Change of Use and Associated Alterations to Provide a Public House/Restaurant at Ground Floor Level and a Night Venue outlet at First Floor for Dean Entertainments Ltd.
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(j) D24627 - 5-9 Westfield Road, Broughty Ferry, Dundee - Change of Use of Store at 9 Westfield Road to Class 2 Office Use with Elevational Changes to 5-9 Westfield Road for W L Russell Trust.
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(k) D24632 - King George V Wharf, East Camperdown Street, Dundee - Construction of an Above Ground Stormwater Storage Tank, Control Building, Below Ground Pumping Station and Association Landscaping for Catchment Tay Ltd.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(l) D24634 - William Fitzgerald Way/Emmock Woods Drive, Claverhouse, Dundee - Erection of 4 Flatted Dwellings and a Shop Unit with 4 No Lock-Up Garages serving the Flats for Baldragon Homes Ltd.
The Committee acceded to a request which had been received for a deputation to be heard relative to objection to the above application. Once the deputation had stated its case and answered questions if was thanked for its attendance and withdrew.
Thereafter, having considered objections received, the Committee agreed that consideration of the application be deferred for further information.
(m) D24647 - 6 Claypotts Castle Gardens, Broughty Ferry, Dundee - Erection of Conservatory to West Elevation for Mr and Mrs McIntosh.
The Committee acceded to a request which had been received for a deputation to be heard relative to objections to the above application. After the deputation had stated its case it withdrew.
Thereafter the Committee agreed that consideration of the application be deferred to allow discussions to take place between the applicant and objector.
(n) D24653 - The Esplanade, Broughty Ferry, Dundee - Construction of Below Ground Sewage Pumping Main (Variation of Route from that approved by Application D23798) for Catchment Tay Ltd.
The Committee acceded to requests which had been received for deputations to be heard in support of and relative to objections to the applications. After the deputations had stated their cases they thanked for their attendance and withdrew.
Thereafter the Committee agreed that consideration of the application be deferred for further information.
(o) D24665 - South Balmossie, Barnhill, Dundee - Construction of Below Ground Pumping Station, Stormwater Storage Tank, Above Ground Control Building and Enclosure for Catchment Tay Ltd.
The Committee acceded to requests which had been received for deputations to be heard relative to objections and in support of the above application. Once the deputations had stated their cases and answered questions they withdrew.
Thereafter, Councillor Mackie, seconded by Councillor Wallace, moved refusal of the application on the grounds that (I) the proposed development would adversely affect the residential amenity enjoyed by local residents and would therefore contravene Policy H1 of the Dundee Local Plan 1998 and (ii) the proposed development would not conform to Policy OS1 in that the development would take up valuable open space as identified in the Dundee Local Plan 1998.
On a division there voted for the motion - Councillors Letford, Farquhar, Sturrock, Glen, Richard Beattie, Dawson, Petrie, Guild, Dave Beattie, Fordyce, Bowes, Mackie, Wallace, Scott and Borthwick (15); and for the amendment - the Lord Provost and Councillors Presswood, de Gernier, Shimi, Regan, Luke, Sawers and Corrigan (8) - whereupon the motion was declared carried.
(p) D24434 - Kingsway East, Mid Craigie Road, Dundee - Erection of Car Showrooms, Workshops and Display Areas for MacDonald Estates plc.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(q) D24598 - Ninewells Hospital and Medical School, Dundee - Outline Application for Erection of 3-Storey Extension at the North East of the Laboratory Block for University Court of the University of Dundee.
The Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(r) D24631 - Douglas Terrace, Broughty Ferry, Dundee - Construction of Below Ground Pumping Main, Pumping Station, Stormwater Storage Tank, an Above Ground Boat Ramp, Control Kiosk and Associated Pipework for Catchment Tay Ltd.
The Committee acceded to a request which had been received for a deputation to be heard in support of the application. Once the deputation had stated its case it withdrew.
Thereafter the Committee agreed that consideration of the application be deferred for further information.
