III STAFFING RESOURCE FOR IMPLEMENTATION OF CONTAMINATED LAND REGIME

 

With reference to Article II of the minute of meeting of this Committee of 17th January, 2000 there was submitted Report No.374-2000 by the Director of Environmental and Consumer Protection which outlined the resource implications of carrying out the statutory duties required under the new Contaminated Land Regime and made recommendations for the implementation of the initial stages of the new regime.

 

Following consideration the Committee approved:-

 

(i) the creation of a post of Scientific Officer, grade PO1-4, within the Environmental and Consumer Protection Department for an initial period of two years after which a review would be undertaken and a decision made on the retention, or otherwise, of the post; and

 

(ii) the establishment of a Contaminated Land Working Group to be chaired by the Scientific Officer with representation from Environmental and Consumer Protection, Planning and Transportation, Economic Development, Support Services, Finance and other departments with the remit:-

 

(a) to prepare and publish within the given legislative timeframe, a written strategy detailing how the Council intended to identify the incidence of contaminated land in the Dundee;

 

(b) to set up the necessary information and data management systems for the preparation and implementation of the regime;

 

(c) to set up the necessary practical working arrangement systems and procedures for the internal management and implementation of the regime; and

 

(d) to establish clear links with other agencies and, where necessary, consultants that will be involved in the implementation of the provisions of the regime.

 

(iii) the constant review of the financial and human resources implications required for the effective implementation of the new regime.

 

IV INTRODUCTION OF FURTHER WHEELED BIN ROUTE

 

There was submitted Report No.428-2000 by the Director of Environmental and Consumer Protection seeking approval for the introduction of a further wheeled bin route comprising 7,000 properties with a proposed starting date of September 2000 dependent on the delivery of a new wheeled bin refuse collection vehicle.

 

The Committee agreed to the introduction of a further wheeled bin route at the area delineated in Appendix 1 to Report 428-2000.

 

V THE NATIONAL AIR QUALITY STRATEGY - STAGE TWO AND STAGE THREE REVIEW AND ASSESSMENTS

 

With reference to Article I of the minute of meeting of this Committee of 14th December, 1998 the Committee noted that Dundees Stage 1 Review and Assessment Report had found that, although Dundees air quality was generally very good there was insufficient information available to be confident that the national objectives would be met in all parts of the city. It concluded that a Stage 2 and/or Stage 3 review and assessment would be required for all seven key pollutants.

 

The Stage 1 report had identified traffic and industrial point sources throughout the city, which had the potential to emit significant quantities of key pollutants. Following receipt of comments from the Scottish Executive and SEPA in the autumn of 1999, it was agreed that only six of the key pollutants required to be considered as 1-3 butadiene was not considered to be significant. Progress was made with the Stage 2/3 review following the guidance and standards available at that time, and additional monitoring was established, funding applied for, additional monitoring equipment tendered for and specific information requested from SEPA and process operators.

 

It was evident towards December 1999, that this initial completion deadline for the submission of the Stage 2 Review and Assessment Reports would not be achievable. Along with a number of other Local Authorities Dundee City Council wrote to the Scottish Executive and asked them to extend the deadline.

A copy of the draft revised technical guidance was received in late December 1999 in which the deadline for completion of the Stage 2 has been extended to 31st March, 2000 and Stage 3 to the 30th June, 2000. The guidance was lengthy and complex and took considerable time to read and evaluate. To progress to Stage 2/3 of the review and assessment process the Council was instructed to take cognisance of the revised guidance. As there were a number of changes to specific standards and assessment protocol it had necessitated the review of some previous decisions. It was apparent that monitoring and modelling assessments, not previously required would now have to be undertaken. In certain circumstances the new technical guidance underlined the need for 12 months of monitoring data for validation purposes.

 

Progress with the Stage 2/3 review and assessment had also been hindered by the delay in information being available from SEPA, the Council's Planning and Transportation Department and the process operators. Information had been received from SEPA on the 27th March 2000, however, there were still a number of issues to be clarified, prior to finalising what further monitoring/modelling would be required to complete the Stage 2 assessment. Staff within the Planning and Transportation Department are working to provide sufficient traffic data to complete Stage 2. There had also been a delay in siting the new static air quality monitoring unit, as planning consent had to be applied for. Approval was received in mid April and arrangements were now underway for the installation of the unit.

 

In view of the above difficulties the Scottish Executive had agreed to accept an interim report, pending completion of valid monitoring and modelling information. A number of other Local Authorities are in a similar position to this Council. The Scottish Executive had, therefore, asked to attend the next meeting of the regional pollution groups to discuss the various difficulties being encountered by authorities and will be attending the Central/East Pollution Control Group on the 15th June 2000.

 

The Committee noted accordingly.

 

VI FIREWORKS/EXPLOSIVES STORAGE IN DUNDEE

 

With reference to the recent tragic incident in Enschede, Netherlands, on 13th May, 2000 when more than 14 people died and over 550 people were injured due to an explosion at a fireworks depot, the Committee noted that premises storing explosives in Dundee were registered with the Trading Standards Section under two different classifications.

 

The Committee noted accordingly.

 

VII APPOINTMENT OF TEMPORARY SPECIALIST ELECTRICAL INSPECTOR UNDER THE HEALTH AND SAFETY AT WORK ETC ACT 1974

 

The Committee noted that in view of the concerns regarding safety following an inspection of premises the Chief Executive and Director of Environmental and Consumer Protection, in consultation with the Convener and the SNP and Conservative spokespersons, approved the appointment of a Temporary Specialist Electrical Inspector under the Health and Safety at Work etc Act 1974.

 

The Committee noted that the Convener had agreed that the undernoted item be considered as a matter of urgency in terms of Standing Order 50(I)(3)(b) in view of the timescales involved.

 

VIII CLEAN AIR ACT 1993 - CHIMNEY HEIGHT ETC APPROVAL FOR GLEBELANDS, ST JOSEPHS, ANCRUM, CLEPINGTON AND PARK PLACE PRIMARY SCHOOLS

 

There was submitted Report No.426-2000 by the Director of Environmental and Consumer Protection advising that under the Clean Air Act 1993 all furnaces rated at more than 366 kw input were fitted with plant for arresting grit and dust but gas fired plants could be granted exemptions from this requirement.

 

The Committee agreed to grant chimney height approval for Glebelands Primary School at a height no less than 20 metres above the ground, St Josephs Primary School at a height no less than 12 metres above the ground, Ancrum Primary School at a height no less than 18.5 metres above the ground, Clepington Primary School at a height no less than 20 metres above the ground, Park Place Primary School at a height of no less than 5.5 metres above the ground and also further agreed to approve the application for exemptions from the requirement that arrestment plants for grit and dust.
