I PLANNING APPLICATIONS
(a) DS00173 - 33 Seafield Road, Dundee - Demolition of Existing Offices
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(b)D24751 - 33 Seafield Road, Dundee - Erection of Single Storey Children's Nursery
The Committee agreed that consideration of the application be deferred for further information on car parking provision in the area.
(c)D24198 - Kingsway West/Clepington Road, Dundee - Re-development of Kingsway Retail Park to provide 14 Units, Fast Food Outlet, Detention Pond, Bus Terminus, Cycle Parking and Service Yards
The Committee acceded to requests which had been received for deputations to be heard relative to objections to and in support of the above application. Once the deputation had stated their cases they were thanked for their attendance and withdrew.
Thereafter, Councillor Farquhar, seconded by the Convener, moved that consideration of the application be deferred.
As an amendment Councillor Dave Beattie, seconded by Councillor Bowes moved that consideration of the application be not deferred.
On a division there voted for the motion - the Convener and Councillors de Gernier, Letford, Ward, Shimi, Presswood, Regan, Farquhar, Sturrock, Glen, Rolfe, Barrie, Dawson, FitzPatrick, Petrie, Build, Powrie, Mackie, Wallace and Scott; (20) and for the amendment - Councillors Richard Beattie, Dave Beattie, Fordyce, Bowes and Borthwick; (5) - whereupon the motion was declared carried.
(d)D24288 - Kingsway West/Clepington Road, Dundee - Re-development and Expansion of Existing Tesco Superstore to form a New Superstore, Petrol Filling Station, New Customer Vehicular Access, Bus Stance, Associated Car Parking, Servicing and Landscaping
The Committee acceded to requests which had been received for deputations to be heard relative to objections to and in support of the above application. Once the deputation had stated their cases they were thanked for their attendance and withdrew.

(e)D24319 - Former Van Leer Site, Kingsway West, Dundee - Erection on Non-Food Retail Warehouse with Ancillary Buildings
The Committee acceded to a request which had been received for a deputation to be heard in support of the above application. Once the deputation had stated its case it was thanked for its attendance and withdrew.
Thereafter, having considered objections received, the Committee refused the application on the grounds that:-
(1)the proposed development is not in accordance with Employment Uses Proposals EP4 of the Local Plan as it would result in the loss of a site identified as a unique opportunity for business, leisure and non-retail uses. There are no material considerations that would justify from departing from the policies of the development plan in this instance;
(2)the proposed development is not in accordance with Retailing Policy RP4A and RP1 of the Tayside Structure Plan 1993 and Retailing Policy S20 of the Dundee Local Plan 1998 as it would result in the loss of an opportunity site for business, leisure and non-retail uses, would have a detrimental impact on existing shopping provision within the City and is of a design and scale that would detrimentally affect the visual character of the surrounding area and therefore not satisfy all the criteria of these policies as required. There are no material considerations that would justify department from the policies of the development plan in this instance;
(3)that the proposed development is not in accordance with the guidance contained within National Planning Policy Guideline 8 Town Centres and Retailing as it would result in the loss of a unique opportunity site for Business, leisure and non-retail uses, adversely impact on the vitality and viability of the existing shopping provision and would adversely affect the visual quality of the surrounding area; and
(4)that the proposed development is not in accordance with Environment Policy ENV14 of the Tayside Structure Plan 1993 and Natural Environment Policy ENV11 of the Dundee Local Plan 1998 as the location, scale and design are inappropriate for the site and would detrimentally affect the visual character of the setting of Camperdown House Designed landscape and Camperdown Country Park. There are no material considerations that would justify departing from the policies of the development plan in this instance.
(f)D24655 - 67-71 Reform Street, Dundee - Change of Use from Public Pavement to External Seating Area
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(g)12 Harefield Road, Dundee - Erection of 6 Dwellings Comprising 4 Houses and 2 Flats
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.
(h)32 Reform Street, Dundee - Change of Use from Retail Shop to Amusement Centre with Elevational Alterations
After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

After considering objections received, the Committee approved the application.
(p)D24794 - Unit 6, Shopping Parade, Panmurefield Village, Dundee - Use of Unit 6 as a Hot Food Takeway
After considering objections received, Councillor Wallace, seconded by Councillor Mackie, moved refusal of the application on the grounds that the proposal was contrary to Policy L78 of the Local Plan and was premature in light of present development in the area.
As an amendment the Convener, seconded by Councillor Sturrock, moved approval of the application subject to the conditions recommended by the Building Quality Manager.
On a division there voted for the motion - Councillors de Gernier, Letford, Farquhar, Dawson, Guild, Powrie, Mackie, Wallace, Scott and Borthwick; (10) - and for the amendment - the Convener and Councillors Ward, Shimi, Presswood, Regan, Sturrock, Glen, Rolfe, Barrie, Richard Beattie, FitzPatrick, Petrie, Dave Beattie, Fordyce and Bowes; (15) whereupon the amendment was declared carried.
