The minute of meeting of this Committee of 25th September, 2000 was held as read.

I ELIZA STREET/MAIN LOAN AND VICTORIA STREET/ALBERT STREET DEVELOPMENT BRIEFS

 

Reference was made to the minute of meeting of the Planning and Transportation Committee of 21st September, 2000 which approved the above briefs as marketing tools.

 

The Committee agreed that the briefs be adopted as material considerations in the determination of planning applications and in the discharge of related responsibilities.

 

II 72 CAMPHILL ROAD - REQUEST FOR DIRECT ACTION

 

There was submitted Report No 667-2000 by the Director of Planning and Transportation relative to the above.

 

The Committee agreed that action be authorised under the terms of Section 135 of the Town and Country Planning (Scotland) Act 1997 to enter onto land at 72 Camphill Road, Broughty Ferry, Dundee and take the necessary steps to comply with en enforcement notice following the non-compliance of its terms by the landowner and to recover from the landowner or lessee any expenses reasonably incurred.

 

It was further agreed that the Director of Planning and Transportation be authorised to enter onto the land concerned and execute the necessary works to seek compliance with the enforcement notice

 

III PLANNING APPLICATIONS

 

(a) D24677 - Baldragon, off Strathmartine Road, Dundee DD3 9RD - Erection of 70 detached and semi-detached single two storey dwellings with associated roads, services and landscaping for Bett Homes Limited

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager and subject to the additional condition that details of the access and road layout shall be submitted to this Authority for approval before any development is commenced and that the works shall be completed in accordance with such approved details.

 

(b) D24746 - Arrol Road, Wester Gourdie Industrial Estate, Dundee - Erection of two Child Care Nurseries for Oranges & Lemons Child Care Nurseries

 

The Committee acceded to a request which had been received for a deputation to be heard in support of the above application. Once the deputation had stated its case it was thanked for its attendance and withdrew.

 

Thereafter, the Committee, having considered objections received, refused the application on the grounds that (i) the proposed development is contrary to Policy EU2 of the Dundee Local Plan 1998 as it does not constitute an industrial or business use as defined by Classes 4, 5 and 11 the Use Classes Order 1989 and there are no material considerations of sufficient strength which would support the granting of consent contrary to that policy, (ii) the proposed development is contrary to Policy SCE4 of the Dundee Local Plan 1998 by reason of the provision of insufficient outdoor play space and (iii) the proposed development is contrary to Policy SCE4 of the Dundee Local Plan 1998 as revised by Planning and Transportation Committee on 22nd May 200 as the development is for two 50 space nurseries when the policy supports only one 50 place unit and is to be located within Wester Gourdie Industrial Estate where planning consent for a 50 space nursery has already been granted and the policy supports only one nursery in each industrial estate.

 

(c) D24751 - 33 Seafield Road, Dundee DD1 4NR - Erection of single storey Children's Nursery for Logieview Ltd

 

The Committee acceded to a request which had been received for a deputation to be heard in support of the above application. Once the deputation had stated its case it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(d) D24763 - Queen Elizabeth Dock, South Victoria Dock Road, Dundee DD1 3BP - Erection of 246 Townhouses and Flats and one Commercial Unit, Car Parking and hard and soft landscaping for Morrison Homes

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager and subject to the additional condition that recycling facilities be provided in the vicinity of the development.

 

(e) D24820 - 5-9 Fairfield Road, Broughty Ferry, Dundee DD4 1NX - Erection of dwellinghouse (amendment to house permitted - D21969) for Mr and Mrs G Harper

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(f) D24830 - 11 Oxford Street, Dundee DD2 1TJ - Extension of rear elevation of dwellinghouse for Mr Gani

 

After considering objections received, the Committee approved the application.

 

(g) D24836 - 4 Thirlstane Place, Dundee - Erection of single storey extension for Mr and Mrs Debbage

 

After considering objections received, the Committee approved the application subject to the condition recommended by the Building Quality Manager.

(h) D24854 - Former Densfield Works, Tannadice Street, Dundee DD3 7JY - Change of use to open air retail market on one day per week (Tuesday) for Kirkcaldy Indoor Market

 

The Committee acceded to a request which had been received for a deputation to be heard in support of the above application. Once the deputation had stated its case it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Committee refused the application on the grounds that (i) the proposed development contravenes Policy S24 of the Dundee Local Plan 1998 because it is not located in or adjacent to a shopping location, (ii) the proposed development is contrary to Policy EU1 of the Dundee Local Plan 1998 as it involves retailing at a location which is allocated for general industrial use and there are no material, considerations which would justify a departure from the Local Plan policies.

 

(i) D24856 - 7 Symers Street, Dundee DD3 9EZ - Erection of conservatory and trellis fencing for Mr and Mrs Brodie

 

After considering objections received, the Committee approved the application subject to the condition recommended by the Building Quality Manager.

 

(j) D24858 - Flat 11, Ground Floor & Basement, Panmure Street, Dundee DD1 2BG - Change of use from Shop to Indoor Amusement Centre for Mr Henry Horne

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(k) D24862 - 3-5 Raglan Street, Dundee DD4 6NT - Change of Use from Taxi Office, Joiners Workshop, Car Sales and Spray Shop to Private Nursery for 33 Children for Mrs E A Bremner

 

The Committee approved the application subject to the conditions recommended by the Building Quality Manager.

 

(l) D24871 - 69 Victoria Street, Dundee DD4 6EA - Change of Use from Hall and Meeting Rooms to Licensed Social Club for Mr Gillen (Secretary)

 

After considering objections received the Committee refused the application on the grounds that (i) the proposed development is not in accordance with Policy LT8 of the Dundee Local Plan 1998 as the nearest residential properties are approximately 13 metres away and there are no material consideration which would justify approval contrary to the Local Plan and (ii) the proposed development does not provide any on site parking in circumstances where there are limited on-street parking facilities.

 

(m) DLB01842 - 69 Victoria Street, Dundee DD4 6EA - New Access Ramps, Toilet Extension and covered pend to provide Licensed Social Club

 

The Committee approved the application subject to the condition recommended by the Building Quality Manager.
