The minute of meeting of this Board of 15th August, 2024 was held as read.

 

Councillor Coleman declared an interest in Article I(4) of this minute by virtue of being a member of the SFA and withdrew from the meeting during its consideration.

The Board, having heard from an agent on behalf of the applicant, and the Board's Legal Adviser, agreed to defer the above application to the November meeting of the Board to enable a Noise Impact Assessment to be submitted.

The Board, having heard from an agent on behalf of the applicant, a Licensing Standards Officer and the Board's Legal Adviser, agreed to grant the variations to allow entry to children and young persons to the lounge bar until 10pm and the function suite until 1am, noting that in both these circumstances, children and young persons would require to be accompanied by an adult, noting the undertaking from the applicant that the outside drinking area was not currently in use.

The Board heard from an agent on behalf of the applicant, a Licensing Standards Officer, the Chief Constables representative and the Board's Legal Adviser.

 

Thereafter, the Convener moved that this application be deferred to the November meeting of the Board to allow further discussions between the applicant and Licensing Standards, Police Scotland and the Licensing Team to take place. As an amendment, Councillor Cruickshank moved that the application be refused.

 

On a division, there voted for the motion - the Convener, Bailie Roberts and Councillors Anderson, Lynn, Smith, McIrvine and Coleman (7); and for the amendment - Councillors Cruickshank and Shears (2) - whereupon the motion was declared carried and the application deferred.

The Board agreed to defer the application to the November Board meeting in order that the applicant could attend.

(i) PREMISES, 65/67 PROVOST ROAD

 

The Board, having heard from an agent on behalf of the applicant, a Licensing Standards Officer and the Board's Legal Adviser, agreed to refuse the application on the grounds that granting this would be inconsistent with one or more of the licensing objectives, in particular in relation to the public health objective.
