Dundee City Licensing Board - 19/01/2023

At a MEETING of the LICENSING BOARD held remotely on 19th January, 2023.

Councillor Coleman declared an interest in Article I(3) of this minute by virtue of the agent for these matters being known to him in a personal capacity and took no part in the proceedings and withdrew from the meeting during its consideration.

I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board, having heard from the agent on behalf of the applicant, the Licensing Standards Officer and the Boards Legal Adviser, agreed to approve the application, subject to the condition that children aged 0-15 must be supervised by a responsible adult after 9pm.

(b) MAJOR VARIATIONS

The Board, having heard from the Boards Legal Adviser, agreed to approve the variation to allow televised sports.

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the variation to allow an increase in off-sales capacity from 15.29m2 to 18.93m2.

II GAMBLING - NEW APPLICATION

(i) TENPIN, UNIT A1, KINGSWAY RETAIL PARK, DUNDEE, DD3 8RX

The Board, having heard from the applicant, the Licensing Standards Officer and the Boards Legal Adviser, agreed to approve the application.

III PREMISES ANNUAL FEE - CHARLESTON BAR

The Board, having heard from the Boards Legal Adviser, agreed to hold a Premises Licence Review Hearing.

IV PREMISES LICENCE - REQUEST FOR REVIEW

In accordance with Schedule 3, Paragraph 10 of the Licensing (Scotland) Act 2005, each Premises Licence holder must pay the annual fee by 1st October each year. The Licensing Department by law, have to send a reminder letter out before the annual fee is due. This letter was sent out to the registered address of the premises or their legal agent during August, 2022. If people had failed to pay by 1st October, 2022, then a second letter reminding them to pay immediately was sent out, a third letter was sent in November, 2022. During the month of December, 2022, LSOs contacted premises who had still failed to pay.

The Board agreed to hold Premises Licence Review Hearings in respect of the undernoted premises:-

(i) Albert Bar, 57/59 Albert Street

(ii) Brasserie Ecosse, 4 Shore Terrace

(iii) Carbon & Lush, 21 South Ward Road

(iv) Downfield Minimarket, 5/7 Teviotdale Avenue

(v) Dundee Carlton Hotel, 2 Dalgleish Road

(vi) Law Brewing, Unit 17, Mid Wynd

(vii) Lyrics Music Bar, St Andrews Lane

(viii) Vine of Life, 173 Strathmartine Road

V PERSONAL LICENCE - REQUEST FOR REVIEW

The Board agreed to hold a Personal Licence Review Hearing in respect of Ryan James Fleming.
