At a MEETING of the LICENSING BOARD held remotely on 22nd September, 2022.

Councillor Coleman declared an interest in Articles I (5 & 6), III and IV of this minute by virtue of the agent for these matters being known to him in a personal capacity and took no part in the proceedings and withdrew from the meeting during their consideration.

I LICENSING (SCOTLAND) ACT 2005

(a) MAJOR VARIATIONS

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the variation to change the layout of the premises increasing the off-sales capacity from 25.169m2 to 30.26051m2.

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to defer the application to the October meeting of the Board.

The Board, having heard from the applicant and the Boards Legal Adviser, agreed to approve the variation to allow alcohol to be sold for consumption on the premises until 12 midnight on Fridays and Saturdays and from 11am on Sundays, to allow club/group meetings, recorded and live performances and theatre activity outwith core hours, to allow access to children and young persons from 0-12 years, and to allow alcohol to be consumed in the auditorium.

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the variation to the layout of the premises increasing the off-sales capacity from 4.2m2 to 12.13m2.

The Board, having heard from the agent on behalf of the applicant and the Boards Legal Adviser, agreed to approve the variation to the layout of the premises increasing the off-sales capacity from 8.3m2 to 16.51m2.

The Board, having heard from the applicant, an objector, the Licensing Standards Officer and the Boards Legal Adviser, agreed to allow the variation to allow on-sales in the back area increasing the capacity to 144, which would include an ice-cream shack and a childrens play area, subject to the local conditions that amplified music and vocals would not to be played in the outside or rear areas and alcohol could only be consumed in the outdoor area 11am to 9pm Monday to Sunday during the months September to June and 11am to 10pm Monday to Sunday in the months of July and August.

II STATEMENT OF LICENSING POLICY 2023-2028 - CONSULTATION

The Board agreed that the Draft Statement of Licencing Policy 2023-2028 be submitted to interested parties as part of a consultation exercise.

III PREMISES LICENCE REVIEW

(i) CLEP BAR, 96-98 CLEPINGTON ROAD

The Board, having heard from an agent on behalf of the applicant, the Chief Constables representative and Boards Legal Adviser agreed that a written warning be imposed.

IV PERSONAL LICENCE REVIEW

(i) DAVID C EVANS

The Board, having heard from an agent on behalf of the applicant, the Chief Constables representative and the Boards Legal Adviser agreed that the licence be endorsed.
