The minute of meeting of this Board of 20th January, 2022 was held as read.
I PREMISES LICENCE - REQUESTS FOR REVIEW
(i) In accordance with Schedule 3, Paragraph 10 of the Licensing (Scotland) Act 2005, each premises licence holder must pay the annual fee by the 1st October each year. The Licensing Department by law, have to send a reminder letter out before the annual fee is due. This letter was sent out to the registered address of the premises or their legal agent during August, 2020. If people had failed to pay by 1st October, 2021, then a second letter reminding them to pay immediately was sent out. During the month of January, 2022, LSOs contacted premises who had still failed to pay. The premises that have still not paid are listed below.
Normally LSOs would visit each premises or the registered address of the premises. However, due to Covid-19 restrictions LSOs were not permitted to do this and attempts were made to either speak with the licence holder or, if this failed, a voicemail was left with the telephone number the department had on record.
(a) Macalpine Bar and Function Suite, 101 Camperdown Road
(b) Shaheen Bangladeshi Restaurant, 89 Commercial Street
(c) The Dragons Den, 21 Princes Street
(d) Westport Serviced Apartments, 138 West Marketgait
The Board, having heard from the Licensing Standards Officer and the Boards Legal Adviser, agreed to revoke the licences for the undernoted premises:-
(a) Macalpine Bar and Function Suite, 101 Camperdown Road
(b) Shaheen Bangladeshi Restaurant, 89 Commercial Street
(c) The Dragon's Den, 21 Princes Street
(d) Westport Serviced Apartments, 138 West Marketgait
(ii) DEXYS
The Board, having heard from the Boards Legal Adviser, and noting that the premises licence had been surrendered, agreed to take no further action.
II PERSONAL LICENCE - REQUESTS FOR REVIEW
(i) HELEN MONCRIEFF
The Board, having heard from the Boards Legal Adviser, and noting that the personal licence had been surrendered, agreed to take no further action.
(ii) HANNAH BARCLAY
The Board agreed to defer the review hearing until the meeting scheduled for 17th March, 2022.
(iii) MARC ADRIAN JACKSON
The Board agreed to defer the review hearing until the meeting scheduled for 17th March, 2022.
