Local Review Body - 16/11/2021
At a MEETING of the LOCAL REVIEW BODY held at Dundee on 16th November, 2021.

The Chair welcomed those present to the meeting and briefly outlined the role of the Local Review Body and officers, in particular advising that, although the Planning Adviser was an employee of the Planning Authority, he had not been involved in the determination of the case under review and was present to provide factual information and guidance only.

The minute of meeting was approved.
III LOCAL PLANNING REVIEW LRB7/2021 - 7B CASTLEWOOD AVENUE, DUNDEE
There was submitted Agenda Note AN41-2021 giving details of a request for a review of the refusal of planning permission for the erection of fencing and childrens play area in front garden (retrospective) at 7B Castlewood Avenue, Dundee.
Papers had been circulated and the Local Review Body had requested an accompanied site visit, which had taken place on 9th November, 2021.
The Local Review Body noted all of the above, and agreed in terms of the Local Review Procedure Regulations, to determine the review without further procedure on the basis of the information before it.
Thereafter, having considered all the information, the Local Review Body, having taken into account the provisions of the Development Plan, all material considerations, the findings of the accompanied site visit and all matters raised at the review, upheld the Appointed Officer's decision to refuse planning permission 20/00765-FULL for the following reason:-
The development, by virtue of its scale, function and location would be at odds with the character and appearance of the surrounding area. It also has an adverse impact on the character and quality of surrounding neighbouring properties in terms of physical impact and overlooking. The development is therefore contrary to criterion 1 and 3 of Policy 11 (Householder Development) of the Dundee Local Development Plan (2019) and associated Householder Development Supplementary Guidance (2019). There are no material considerations of sufficient weight to justify a decision contrary to this.
