The Board, having noted that the objectors to the application were not present, agreed that the matter be considered in their absence. Thereafter, having heard from the agent on behalf of the applicant, the representative of the Chief Constable, a Licensing Standards Officer and the Boards Legal Adviser, the Board agreed to grant the application subject to the conditions proposed by the Chief Constable and the Licensing Standards Officer that the standard pavement cafe conditions be applied and that the outdoor drinking area close at 10pm (July and August) and 9pm for the remaining months and that the premises may open prior to the commencement of core licensed hours (11am to 1am Monday to Sunday) for the provision of teas, coffees, breakfasts etc and that children and young persons may be admitted to the premises provided they were accompanied by an adult and that they must vacate by 10pm.

Councillor Cruickshank declared a non-financial interest in this application by virtue of a family member being a Business Partner in the premises. Thereafter, having heard the Boards Legal Adviser, the matter was deferred to the meeting of the Board scheduled for 28th October, 2021.
II ANNUAL LICENSING REPORT FROM POLICE SCOTLAND
There was submitted by the Chief Constable, Iain Livingstone of Police Scotland, the Dundee Licensing Report for 2020/2021 emphasising the new way of working over the past year due to COVID-19.
The Board thanked Police Scotland for the informative report and agreed to note what was in the report.
III PERSONAL LICENCE - REVIEW HEARING
(i) SANTANU ROY CHOWDHURY
The Board agreed to defer the review hearing until the Board meeting scheduled for 28th October, 2021.
(ii) JEFFREY STEWART
The Board noted that consideration of the matter had been deferred from the meeting of 19th August, 2021 to allow the licence holder to be present. The Board noted that the licence holder was not present and agreed that the matter be considered in their absence. The Board, having heard the representative of the Chief Constable and the Boards Legal Adviser, agreed that the licence holder was not a fit and proper person to be the holder of a Personal Licence and that the licence be revoked.
