The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to allow a variation to change Local Condition 1 to remove the words occasionally but on a regular basis with regards to karaoke and live bands and to amend the ages of children and young persons allowed access to the premises from 5-17 years to 0-17 years.
II PREMISES LICENCE - REVIEW HEARINGS
(i) BALGAYHILL BAR, 1 ROSEFIELD STREET, DUNDEE
The Board, having heard from the licence holder, the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser agreed to adjourn the hearing to the November meeting of this Board for submission of further information from Police Scotland.
(ii) ROSS BAR, 1 BAFFIN STREET, DUNDEE
The Board heard from the licence holder, the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser.
Thereafter, the Convener moved that the Board impose a two month suspension of the licence. As an amendment, Councillor McIrvine moved that the Board issue a Written Warning. On a division, there voted for the motion, the Convener and Councillors Alexander, Rome and Scott (4); and for the amendment - Councillors McIrvine, Malone and Cruickshank (3) - whereupon the motion was declared carried and a two month suspension imposed.
III PERSONAL LICENCE - REVIEW HEARINGS
(i) PAUL PATRICK MURPHY
The Board, having heard from the licence holder, the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser agreed to adjourn the hearing to the November meeting of this Board for further submissions from Police Scotland.
(ii) LYNN MACKIE
The Board, having heard from the licence holder, the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser, agreed to endorse the licence.
(iii) ARSALAN HAIDER
The Board, having noted that licence holder was not present but had intimated that he wished the Review to proceed in his absence and, having being advised of the contents of correspondence from the licence holder in this respect, having heard from the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser, agreed to endorse the licence.
IV PREMISES LICENCE - REQUESTS FOR REVIEW
The Board agreed to hold Premises Licence Review Hearings in respect of GJs, Dexys Bar, and Albert Bar.
V PERSONAL LICENCE - REQUESTS FOR REVIEW
The Board agreed to hold Personal Licence Review Hearings in respect of Helen Moncrieff and Andrew Hendry.
