I DECLARATION OF INTEREST
There were no declarations of interest.
II DUNDEE CENTRAL WATERFRONT - ENVIRONMENTAL AND LANDSCAPING WORKS
There was submitted Agenda Note AN165-2015, advising of works involving the enhancement of the Dundee Central Waterfront Project, including the Discovery Walk of Fame, the commemorative Royal Arch of trees and associated lighting, the outline formation of Waterfront Showcase Gardens within Slessor Gardens for tenure, enhanced landscaping and planting adjacent to the Tay Road Bridge, SUDS Pond feature lighting, seating, sculpture and gardens.
It was reported that an offer for these works was received from Sir Robert McAlpine as part of the current Dundee Central Waterfront Contract 4 - Infrastructure, SUDS Pond and Public Open Space, (Article IX of the City Development Committee of 9th December, 2013 refers).
Given the limited timescales available, the Chief Executive and the City Engineer, after consultation with the Convener, Labour Group spokesperson, Bailies Borthwick and Scott and Councillor Macpherson, accepted the offer from Sir Robert McAlpine by way of variation to the contract. The offer amount was for 244,995.05 which together with an allowance of 25,004.95 for contingencies, made a total expenditure of 270,000.
The Committee noted accordingly.
III CITY QUAY DOCK GATE REPLACEMENT - CONSULTANCY SERVICES
There was submitted Agenda Note AN166-2015, advising that as part of the City Quay Marina Development Project, there was a requirement to replace the existing dock gates at Camperdown Docks as they were no longer fully functional or appropriate for a fully operational marina. It was proposed to procure the new dock gate and associated infrastructure through a Design and Build contract and, in order to do so, specialist professional advice was required to prepare the outline design, specification and contract documentation for the contract.
It was reported that Tenders were issued to 11 specialist consultants through the Scotland Excel Framework for Professional Services and four offers were received.
Given the limited timescales available, the Chief Executive and the City Engineer, after consultation with the Convener and Labour Group spokesperson, Bailies Borthwick and Scott and Councillor Macpherson, accepted the lowest offer from Mott MacDonald. The contract amount was for 101,810 which, together with allowances of 10,000 for City Engineer's professional fees, 20,000 for bathymetric, diver and topographical surveys and 18,190 for contingencies, made a total expenditure of 150,000.
The Committee noted accordingly.
IV NEW ROADS - ROAD CONSTRUCTION CONSENTS
There was submitted Agenda Note AN167-2015, making reference to Article IV of the minute of meeting of the Policy and Resources Committee on 27th April, 2009, wherein the Committee delegated the grant of road construction consent to the Director of City Development with the proviso that any consents granted be reported to this Committee as soon as practicable thereafter.
It was reported that the undernoted had been submitted and the Director of City Development had approved the applications subject to conditions which had been agreed with the applicants.

V NEW STREET NAMES - NORTH OF WHITFIELD TERRACE/EAST OF WHITFIELD LOAN
There was submitted Agenda Note AN168-2015 advising of the results of a consultation for new street names associated with the housing development at land to north of Whitfield Terrace/east of Whitfield Loan, Dundee.
The Committee approved the following names which had been proposed:-
- Braefield Terrace; and
- Braefield Lane
VI CHILDREN GOING TO OR FROM SCHOOL TRAFFIC SIGNS, VARIOUS SCHOOL LOCATIONS
There was submitted Agenda Note AN169-2015, advising that the installation of 18 children going to or from schools traffic signs complete with flashing amber lights for various school locations within Dundee was proposed to improve safer routes to schools, at a total cost estimate of 31,500.
It was reported for the information of members that the foregoing was approved by the Director of City Development in view of the timescales involved, in consultation with the Convener, Labour Group spokesperson, Bailies Borthwick and Scott and Councillor Macpherson.
The Committee noted accordingly.
VII HIGH STREET, LOCHEE (VARIATION OF WAITING RESTRICTIONS) ORDER 2015
There was submitted Report No 263-2015 by the Executive Director of City Development relative to a request for alterations to waiting restrictions required in the High Street, Lochee area following extensive regeneration works and ongoing discussions with local traders.
The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Order for Dundee.
VIII WESTERN GATEWAY, DUNDEE (20 MPH ZONE) ORDER 2015
There was submitted Report No 258-2015 by the Executive Director of City Development relative to a proposal to introduce a 20 mph zone for all lengths of road to be constructed as part of the Western Gateway Development.
The Committee approved the preparation of the necessary Traffic Regulation Order to introduce a 20 mph zone on all lengths of carriageway contained within the residential development known as Western Gateway.
IX WHITFIELD DRIVE (STOPPING-UP OF ROADS AND FOOTPATHS) ORDER 2015
There was submitted Report No 262-2015 by the Executive Director of City Development relative to a proposal to stop-up and remove from the list of public roads various lengths of roads and footpaths within the Whitfield Drive area of Dundee utilising the powers of the Roads (Scotland) Act 1984.
The Committee approved the preparation of a Stopping-Up Order to stop-up and remove from the List of Public Roads lengths of roads and footpaths in the Whitfield Drive area of Dundee, as detailed in the report.
X HARESTANE ROAD AREA, DUNDEE (20 MPH ZONE) ORDER 2015
There was submitted Report No 266-2015 by the Executive Director of City Development relative to a proposal to introduce a 20 mph zone in an area surrounding the replacement Baldragon Academy and Sidlaw View Primary schools in the Harestane Road area of Dundee and to introduce lengths of School Keep Clear restrictions in areas where there had been an identified risk to pupils and pedestrians by parked vehicles.
The Committee approved:-
(a) the preparation of the necessary Traffic Regulation Order to introduce a 20 mph zone around the replacement schools. The existing flashing 20 mph zone which is currently operational on a part-time basis would be replaced by this new restriction;
(b) the preparation of the necessary Traffic Regulation Order to introduce lengths of School Keep Clear restrictions on Harestane Road; and
(c) the request to remove lengths of School Keep Clear restrictions on Helmsdale Place as they would no longer be required.
XI STATUTORY UNDERTAKERS REINSTATEMENT PERFORMANCE IN DUNDEE 2014/2015
There was submitted Report No 257-2015 by the Executive Director of City Development providing a summary of the performance of Statutory Undertakers operating in Dundee during 2014/2015 based on inspections under the New Roads and Street Works Act 1991 (NRSWA) and updating the Committee on the status of the Transport (Scotland) Act 2005, Part 2 - Road Works.
The Committee agreed to:-
(a) note the performance of Statutory Undertakers' reinstatements in Dundee based on the visual sample inspection regime and the local coring results for the last year;
(b) approve the continuation of the annual local coring programme and participation in the bi-annual national coring programme; and
(c) note the status of the Transport (Scotland) Act 2005, Part 2 - Road Works, different parts of which came into force on 1st April, 2008 and 1st October, 2008.
XII WHITFIELD PLANNING FRAMEWORK
There was submitted Report No 268-2015 by the Executive Director of City Development advising the Committee of progress with implementation of regeneration proposals in Whitfield and requesting them to approve the updated Whitfield Planning Framework.
The Committee agreed to:-
(a) note the progress that had been made with the implementation of regeneration proposals in Whitfield;
(b) approve the updates to the Whitfield Planning Framework 2015; and
(c) approve the updated Whitfield Planning Framework as non-statutory guidance for future development within the Whitfield area.
XIII PUBLIC CONSULTATION - DRAFT LAW TERRACES AND CRESCENTS CONSERVATION AREA APPRAISAL
There was submitted Report No 269-2015 by the Executive Director of City Development seeking Committee approval to consult on the Draft Law Terraces and Crescents Conservation Area Appraisals.
The Committee approved the proposed Draft Law Terraces and Crescents Conservation Area Appraisals and remitted the Executive Director of City Development to consult with the local community and interested parties, reporting back with the results of the consultation process.
XIV SCAPE FRAMEWORK
There was submitted Report No 275-2015 by the Executive Director of City Development updating the Committee as to the benefits of using the Scape Framework for procuring the construction of capital projects and seeking authority to procure the construction of the Coldside School, Community and NHS Project through the Scape Framework.
The Committee agreed to:-
(a) note the benefits of using the Scape Framework to procure capital projects and in particular that utilising the Scape Framework enables Robertson Construction to require all sub-contractors to pay the Living Wage as a minimum to all employees, and
(b) approve the procurement of the construction of the Coldside School Community and NHS Project through the Scape Framework.
XV TENDERS RECEIVED BY CITY ARCHITECT
There was submitted Report No 287-2015 by the Executive Director of City Development relative to the undernoted projects:-
(a) WELLGATE CENTRE - BOILER REPLACEMENT
The Committee agreed to accept an offer from the Environment Department (Construction Services) in the sum of 94,027.37, to which required to be added allowances amounting to 14,387, giving a total of 108,414.37.
(b) CRAIGIE HIGH SCHOOL - WINDOW REPLACEMENT
The Committee agreed to accept an offer from the Environment Department (Construction Services) in the sum of 54,560, to which required to be added allowances amounting to 11,184, giving a total of 65,744.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
XVI PROPOSED DISPOSAL OF THE FORMER DENS METAL SITE, DENS ROAD, DUNDEE
There was submitted Agenda Note AN170-2015, making reference to Article XV of the minute of meeting of this Committee of 24th March 2014, wherein the Committee approved the disposal of the Former Dens Metals Site, Dens Road, Dundee for the redevelopment of the site for residential use. This disposal was subject to the purchaser purifying a number of conditions contained within the original offer, particularly in relation to site contamination and environmental issues.
Whilst the Council had previously undertaken limited remediation works, the proposed purchaser had established that more extensive Abnormal Costs as defined in the Heads of Terms Agreement required to be carried out ahead of the redevelopment of the site.
It was therefore agreed that the Council would accept a reduction in the proposed acquisition price to reflect part of the additional costs of preparing the site for development.
It was further reported that the agents acting on behalf of the purchaser had indicated that the name of the purchaser was to be changed. All other terms remained unchanged.
It is reported for the information of members that the foregoing was approved by the Director of City Development in view of the timescales involved, in consultation with the Convener, Labour Group spokesperson, Bailies Borthwick and Scott and Councillor Macpherson.

There was submitted Report No 281-2015 by the Executive Director of City Development seeking approval for the sale of the former Downfield Primary School Annexe at East School Road, Dundee.
The Committee approved the sale on the terms and conditions detailed in the report.
XIX SALE OF LAND, LUNDIE AVENUE AND KINGS CROSS ROAD, DUNDEE
There was submitted Report No 280-2015 by the Executive Director of City Development seeking approval for sales of land at Lundie Avenue and King's Cross Road and the redevelopment of a site at Lundie Avenue.
The Committee approved the sales and redevelopment on the terms and conditions detailed in the report.
