The minute of meeting of this Committee of 15th February, 2016 was held as read.

I DECLARATION OF INTEREST

 

Councillor Asif declared a financial interest in Article II(b) by virtue of being the applicant and took no part in the discussion thereof.

 

II PLANNING APPLICATIONS

 

(a) 16-00147-FULL - LOCK-UPS, NEW ROAD, BROUGHTY FERRY, DUNDEE - DEMOLITION OF LOCK-UPS AND ERECTION OF SINGLE STOREY HOUSE - FOR MR AND MRS GRANT

 

The Committee acceded to requests for deputations to address the Committee both in support of and relative to objections to the above application. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application subject to the conditions recommended by the Executive Director of City Development.

 

(b) 15-00188-FULL - 223-227 ALBERT STREET, DUNDEE - ERECTION OF RAMP ACCESS FOR ASIF BROTHERS

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application.

 

The Committee approved the application subject to the conditions recommended by the Executive Director of City Development, and in the circumstances, declined to hear the deputation.

 

 

(c) 15-00683-FULL - 19-21 DOUGLAS STREET, DUNDEE - VARIATION OF CONDITIONS TO REMOVE RESTRICTIONS ON USE OF CAR PARK FOR MR LEE CHADWICK

 

The Committee acceded to a request for a deputation to address the Committee in support of the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, the Committee refused the application on the grounds that:-

 

(i) the proposal fails to comply with Policy 3 of the Adopted Dundee Local Development Plan (2014), the variation of Conditions 1 and 6 would render the proposal an inappropriate use within a General Economic Development Area. There are no material considerations that would justify the approval of planning permission; and

 

(ii) the proposal does not comply with the Central Dundee Car Parking Strategy (2007) as the use of the proposed car park to serve Campus Apartments Student Housing would exacerbate existing on street parking pressures and promote the use of the private car within Central Dundee. There are no other material considerations that would justify approval of planning permission contrary to the Central Dundee Car Parking Strategy 2007.

 

(d) 15-00831-FULL - 106 FINTRY ROAD, DUNDEE - CHANGE OF USE TO HOT FOOD TAKEAWAY

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Executive Director of City Development, and subject to the amendment of Condition 1 to "the total noise from all M & E services shall not exceed NR 35 during night-time, as measured one metre external to the facade of the adjacent residential accommodation. (For the avoidance of doubt night-time shall be 23:00hrs to 07:00hrs in the interests of preventing significant instances of noise disturbance from occurring)."

 

III DELEGATED ITEMS

 

There was submitted Agenda Note AN19-2016 advising that from 23rd January, 2016 to 22nd February, 2016, 41 applications were decided under delegated powers. Six of these applications attracted objections and three applications were refused.
