The minute of meeting of this Committee of 17th August, 2015 was held as read.

I DECLARATION OF INTEREST

 

Lord Provost Bob Duncan and Councillors Hunter, Gordon and McCready declared a non-financial interest in item II(a) by virtue of their positions as Trustees of Leisure and Culture Dundee, and left the Chamber during consideration of this item.

 

II PLANNING APPLICATIONS

 

(a) 15-00530-FULL - SITE 1, FORTIES ROAD, BALDOVIE INDUSTRIAL ESTATE, DUNDEE - OUT OF CENTRE LEISURE DEVELOPMENT - FOR ACTIVE SOCCER

 

The Committee acceded to a request for a deputation to address the Committee in support of the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Councillor Lynn, moved refusal of the application on the grounds detailed in the report. As an amendment, Councillor Asif, seconded by Bailie Wright, moved approval of the application, subject to the conditions that (i) the total noise from the mechanical and electrical plant/services shall not exceed NR35 during night-time, as measured one metre external to the facade of adjacent residential property. (Night-time hours are 23:00 to 07:00 hours), (ii) the Indoor Football and Multi-Sports Centre hereby approved shall have operating hours between 09:00 and 21:00 only, in the interests of safeguarding the amenity of nearby houses, and (iii) the uses hereby approved shall cease by no later than 21st September, 2022 and the building returned to its original condition by no later than 21st December, 2022.

 

On a division, there voted for the motion - the Convener, Depute Lord Provost Roberts, Bailie Sawers and Councillors Guild, Campbell, Cordell, Dawson, Lynn, McDonald, Bidwell, Brennan and Ferguson (12); and for the amendment - Bailies Wright, Borthwick and Scott, and Councillors Melville, Murray, Asif, Cruickshank and McGovern (8) - Lord Provost Duncan and Councillors Hunter, Gordon and McCready having left the Chamber during consideration of this item, and Councillor Ross declining to vote as he had been absent for part of the proceedings - whereupon the motion was declared granted and planning permission refused.

 

(b) 15-00462-FULM - LAND TO WEST OF EARN CRESCENT AND SOUTH OF DICKSON AVENUE, DUNDEE - CONSTRUCTION OF NEW PRIMARY SCHOOL AND NURSERY DEVELOPMENT - FOR DUNDEE CITY COUNCIL

 

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development.

 

(c) 15-00489-FULM - LAND TO NORTH OF ANN STREET, WEST OF HILLBANK ROAD AND SOUTH OF ALEXANDER STREET, DUNDEE - RESIDENTIAL DEVELOPMENT - FOR DUNDEE CITY COUNCIL IN PARTNERSHIP WITH HILLCREST HOUSING ASSOCIATION

 

The Committee approved the application, subject to the conditions recommended by the Executive Director of City Development.

 

III DELEGATED ITEMS

 

There was submitted Agenda Note AN175-2015, advising the Committee that from 22nd June, 2015 to 21st July, 2015, 81 applications were decided under delegated powers. Six of these applications had attracted objections and, of these, all six were approved.
