It was reported that a request had been received for a deputation to address the Committee in support of the above application.

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development and, in the circumstances, declined to hear the deputation.

III PLANNING APPEAL DECISION - SAINSBURYS - 1 TOM JOHNSON ROAD, DUNDEE - MODIFICATION OF PLANNING OBLIGATION TO PERMITNOT LESS THAN 70% OF THE NET SALES FLOOR AREA TO BE ALLOCATED TO THE DISPLAY

There was submitted Agenda Note AN2-2015 making reference to Article II(a) of the minute of meeting of this Committee of 16th June, 2014, wherein the Council refused to modify the above mentioned planning obligation on the grounds that increasing the area allocated to comparison goods to 30% of floor space would have a detrimental impact on Broughty Ferry District Centre and was contrary to the City Council's stated aims in the Local Development Plan of maintaining and enhancing the vitality and viability of the District Centre as a sustainable location.

It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 75B of the Town and Country Planning (Scotland) Act 1997 and had been allowed.

IV DELEGATED ITEMS

There was submitted Agenda Note AN3-2015 advising the Committee that from 22nd November to 21st December, 2014, 49 applications had been decided under delegated powers. 13 of these applications had attracted objections and of these, 10 were approved and three were refused.

The Committee noted accordingly.
