(a) VARIATIONS (MAJOR)

The Board, having heard from the Chief Constable's representative, the Director of City Development's representative, an agent on behalf of the applicant, the Board's Legal Adviser and noted letters of support, the Convener moved to grant a variation to allow on sales to 3.00 am on Fridays and Saturdays only. As an amendment, Councillor Murray moved to grant approval to 3.30 am with terminal hour for sale of alcohol to be 2.45 am to be reviewed after a period of three months.

 

On a division, there voted for the motion - the Convener, Depute Lord Provost Roberts and Councillors Gordon and Cruickshank (4); and for the amendment - Councillors Murray, Hunter and Cordell (3) - whereupon the motion was declared carried.

 

II UPDATES

 

Reference was made to Articles II(i) and II(ii) of the minute of meeting of this Board of 27th November, 2014, where it was agreed to defer the updates to the January meeting of this Board.

 

(i) THE BARRELS, 43-45 STRATHMARTINE ROAD

 

The Board, having heard from the Director of City Development's representative, the licence holder on their own behalf and the Board's Legal Adviser, agreed to defer the update to the February meeting of this Board.

 

(ii) OUT NIGHTCLUB, 124 SEAGATE

 

The Board, having heard from the Director of City Development's representative, the licence holder on their own behalf and the Board's Legal Adviser, agreed to defer the update to the February meeting of this Board.

 

III PERSONAL LICENCE REVIEW HEARING

 

(i) BRIAN MACKIE

 

The Board, having heard from the Chief Constable's representative, the licence holder on their own behalf and the Board's Legal Adviser, the Convener moved to endorse the licence. As an amendment, Councillor Gordon, moved to take no further action and issue a warning.

 

On a division, there voted for the motion - the Convener and Councillor Murray (2); and for the amendment - Depute Lord Provost Roberts and Councillors Hunter, Cordell, Gordon and Cruickshank (5) - whereupon the amendment was declared carried.
