The minute of meeting of this Committee of 18th August, 2014 was held as read.

I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II PLANNING APPLICATIONS

 

(a) 14-00399-FULL - THE OLD MILL, 19 BROWN STREET, DUNDEE - FORMATION OF STUDENT ACCOMMODATION - FOR CROSSLAND STUDENT ACCOMMODATION FUND

 

The Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

It was further agreed that this planning permission shall not be issued unless and until an agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 as amended between the Council and parties with appropriate interests in the land has been recorded. This agreement will restrict the occupancy of the proposed student accommodation.

 

(b) 14-00496-FULM - SIDLAW VIEW PRIMARY SCHOOL, HELMSDALE PLACE, DUNDEE - CONSTRUCTION OF NEW SECONDARY SCHOOL - FOR DUNDEE CITY COUNCIL

 

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development, together with the additional conditions that:-

 

(vi) prior to the commencement of works, a traffic management plan for all construction works on site shall be submitted to the planning authority for approval and, if approved, construction traffic shall operate only in accordance with the approved management plan, in order to ensure that construction traffic is sufficiently managed to minimise the impact on the surrounding area; and the safety of pupils being dropped-off and picked-up from Sidlaw View Primary School adjacent to the site; and

 

(vii) prior to the commencement of works on site, a revised parking layout shall be submitted to the planning authority for approval and, if approved, shall be completed in accordance with the approved details and prior to the operational opening of the secondary school hereby approved. The level of parking for the replacement secondary school hereby approved shall be as close as possible to 100%. the FTE level of staff at the school. in order to ensure that there is a sufficient level of parking to serve the secondary school.

 

III PLANNING APPEAL DECISIONS

 

There was submitted Agenda Note AN203-2014 advising of the undernoted planning appeal decisions:-

 

(a) LAND TO WEST OF ST MARTIN CRESCENT, DUNDEE - ERECTION OF 25 HOUSES AND ANCILLARY WORKS

 

Reference was made to Article I(a) of the minute of meeting of this Committee of 20th January, 2014, wherein the above proposal was refused planning permission on the grounds that inadequate information had been submitted to demonstrate that the development would not exacerbate existing flooding problems in the area contrary to the provisions of the Development Plan, that the proposal would increase traffic congestion and affect safety and that there was no capacity within the local primary school to accommodate the additional pupils generated by the proposed development.

 

It was reported that the decision was subsequently appealed by the applicant and the Reporter had allowed the appeal and granted planning permission subject to conditions.

 

(b) ASDA KINGSWAY EAST, DUNDEE - VARIATION OF CONDITION TO ALLOW UNRESTRICTED DELIVERIES TO THE SUPERMARKET

 

Reference was made to Article II(a) of the minute of meeting of this Committee of 12th May, 2014 wherein the above proposal was refused planning permission on the grounds that the original restrictions imposed by Condition 16 of Planning Application Ref: D13779 to allow for restricted deliveries to the supermarket element of the retail park were imposed to safeguard the amenity of surrounding residents from noise disturbance and the proposal failed to demonstrate that by allowing unlimited delivery hours the amenity of the surrounding residents would be protected.

 

It was reported that the decision was subsequently appealed by the applicant and the Reporter had dismissed the appeal.

 

IV SCOTS - NATIONAL ROADS DEVELOPMENT GUIDE

 

There was submitted Agenda Note AN209-2014, making reference to Article V of the minute of meeting of the City Development Committee of 25th August, 2014, wherein it was agreed that the above document be referred to this Committee as a material planning consideration.

 

The Committee noted accordingly.

 

V DELEGATED APPLICATIONS

 

There was submitted Agenda Note AN204-2014, advising that from 22nd July to 21st August, 2014, 52 applications were decided under delegated powers. Five of these applications had attracted objections and all five were approved.
