I LICENSING (SCOTLAND) ACT 2005

 

(a) VARIATIONS (MAJOR)

The Board, having heard from the applicant on their own behalf, the Chief Constables representative, the Director of City Developments representative and the Boards Legal Adviser, agreed to grant a variation to allow on sales until 1.00 am on Fridays and Saturdays and to allow on and off sales from 11.00 am on Sundays and to allow outdoor drinking until 9.00 pm (10.00 pm July and August).

The Board, having taken into account an objection, heard from the applicant on their own behalf and the Head of Environmental Healths representative, agreed to a variation to amend the terminal hour for on sales Monday to Wednesday from 11.00 pm to 12 midnight, amend the terminal hour for on sales Friday and Saturday from midnight to 1.00 am as per Board policy, remove all details in 5(f) in relation to other activities as this will be highlighted in local conditions, add private functions in 5(f) other activities, remove all current access to children and young persons, and add access to children and young persons to attend private functions only.

 

To amend and add musical entertainment to Condition 1 of the local conditions attached to the premises licence to the following:-

 

TV, automatic music playback system during core hours, live bands, karaoke and DJs from opening until 12 midnight Mondays to Sundays for avoidance of doubt live bands, karaoke and DJs will not be permitted beyond 12 midnight on Fridays and Saturdays, however background music will be permitted until 1.00 am.

The Board, having heard from the licence holder on their own behalf and the Chief Fire Officers representative, agreed to take no further action.

The Board, having heard from the licence holder on their own behalf, and the Head of Environmental Protections representative, agreed to take no further action.

 

(iii) DOLPHIN BAR, 92 FINTRY ROAD

 

The Board, having heard from an agent on behalf of the licence holder, the Head of Environmental Protections representative and the Boards Legal Adviser agreed to take no further action.

 

(iv) MERCANTILE, 100 COMMERCIAL STREET

 

The Board agreed to defer the above.

 

(v) NO 25, 25 SOUTH TAY STREET

 

The Board, having heard from an agent on behalf of the licence holder, agreed to defer the above to the June meeting of this Board.

 

(vi) THE SOCIAL, 10 SOUTH TAY STREET

 

The Board, having heard from an agent on behalf of the licence holder, agreed to defer the above to the June meeting of this Board.

 

III REVIEW HEARINGS

 

(a) PREMISES LICENCE

 

(i) Park Bar, 1/5 Albert Street

 

The Board, having heard from the Head of Environmental Protections representative, an agent on behalf of the landlords and the Boards Legal Adviser, agreed to adjourn the premises licence hearing to the April meeting of this Board and further agreed to hold a personal licence review in respect of Mr Dale Handy.

 

(ii) Deja Vu Nightclub, 25 Cowgate

 

The Board, having heard from the Chief Constables representative, an agent on behalf of the licence holder and the Boards Legal Adviser, agreed to adjourn the hearing to the June meeting of this Board.

 

(iii) Cafe Buorigiorno, 11 Bank Street

 

The Board, having heard from the Clerk, agreed to revoke the licence.

 

(iv) Downfield Fc Social Club, Balgowan Avenue

 

The Board, having heard from the Clerk and the Head of Environmental Protections representative, agreed to take no further action.

 

(v) Lifestyle Grocers, 111 Whitfield Drive

 

The Board, having heard from the Clerk and Head of Environmental Protections representative, agreed to take no further action.

 

(vi) Mos Convenience Store, 293 Hilltown

 

The Board, having heard from the Clerk, noted that the licence had been surrendered.

 

(vii) Slavyanski, 263 Blackness Road

 

The Board, having heard from the Clerk, the Head of Environmental Protections representative, and the licence holder on their own behalf, agreed to take no further action.

 

(b) BETTING OFFICE LICENCE

 

(i) Barrett Bookmakers, 188A Strathmartine Road

 

The Board agreed to take no further action.

 

 

(d) REQUEST FOR REVIEW HEARINGS

 

(i) Premises Licence

 

The Board agreed to hold a review hearing in respect of Spice Restaurant, 140 Perth Road.

 

(ii) Personal Licence
